ISSUE BEFORE COUNCIL: Should the City Council approve the Jurisdictional Transfer of Stillwater
Way from Washington County to the City of Lake Elmo, approve the designation of Stillwater Way as a
Municipal State Aid Street, and approve Municipal Concurrence for Washington County State Aid
Designations in the City of Lake Elmo?
BACKGROUND, PROPOSAL DETAILS/ANALYSIS: Washington County recently completed the
roadway realignment and reconstruction of County State Aid Highway 14 (Stillwater Boulevard) and
County State Aid Highway 15 (Manning Avenue) located in the City of Lake Elmo. Prior to the
improvements, Washington County and the City of Lake Elmo entered into Cooperative Agreements for
cost sharing, traffic signal maintenance responsibilities, and to address the turnback of Stillwater Way (a
portion of the project) to the local jurisdiction of the City of Lake Elmo. The Jurisdictional Transfer
Agreement. Agreement No. 11522, was approved by the City Council and Washington County Board and
is dated April 17, 2018.
In accordance with the agreement, the jurisdictional transfer is accomplished upon completion of the project
by the County and as of June 1, 2019, contingent upon the final completion of the project. The contingent
completion of the project includes 1) completion of all punch list items by the County’s contractor; 2)
receipt of all testing reports; 3) structure invert verification; and 4) 30-days following the submittal of record
drawings to the City.
In order to facilitate the jurisdictional transfer, the County must make County State Aid designation
revisions to the County State Aid Highway System, including the revocation of Stillwater Way as a County
State Aid Highway, and transfer the roadway and right-of-way to the jurisdiction of the City of Lake Elmo.
Lake Elmo may also elect to designate the newly acquired roadway to the City’s Municipal State Aid Street
System. Pursuant to State Aid Rules, a County Road Turnback may be added to the City’s Municipal State
Aid System and is not counted toward the City’s 20% statutory mileage limitation. Therefore, the City may
request the Turnback to be added to their MSA System to generate additional funding needs over and above
the allowable mileage allocation.
FISCAL IMPACT: The City of Lake Elmo shall own and be solely responsible for all operation,
maintenance, and replacement of Stillwater Way, including snow and ice control, the maintenance of the
storm sewer and culverts located within the transferred portions of the road right-of-way, and including the
bituminous trail.
RECOMMENDATION: Staff is recommending that the City Council approve, as part of the consent
agenda, a Resolution, thereby approving the Jurisdictional Transfer of Stillwater Way from Washington
County to the City of Lake Elmo in accordance with the Jurisdictional Transfer Agreement dated April 17,
2018; approving the designation of Stillwater Way as a Municipal State Aid Street; and approving
Municipal Concurrence for Washington County State Aid Designations in the City of Lake Elmo. If
removed from the consent agenda, the recommended motion for the action is as follows:
“Move to approve Resolution No. 2020-094 approving the Jurisdictional Transfer of Stillwater Way,
from County State Aid Highway 14 (CSAH 14) to County State Aid Highway 15 (CSAH 15), from
Washington County to the City of Lake Elmo, approving the designation of Stillwater Way as a
Municipal State Aid Street, subject to the approval of the Commissioner of Transportation, and
approving Municipal Concurrence for Washington County State Aid Designations in Lake Elmo .”

A RESOLUTION TO PROVIDE FOR THE TRANSFER OF
JURISDICTION OF STILLWATER WAY FROM WASHINGTON
COUNTY TO THE CITY OF LAKE ELMO AND
A RESOLUTION ESTABLISHING MUNICIPAL STATE AID STREETS,
MUNICIPAL CONCURRING RESOLUTION (Revoking CSAH
Designation), AND MUNICIPAL CONCURRING RESOLUTION (New
CSAH Designation)
WHEREAS, Washington County has completed the construction and realignment of County
State Aid Highway 14 (CSAH 14) and County State Aid Highway 15 (CSAH 15), known as the CSAH
14 & CSAH 15 Realignment Project (“Project”); and
WHEREAS, Washington County and the City of Lake Elmo entered into an Agreement,
Agreement No. 11522 dated April 17, 2018, for the Transfer of Stillwater Way, from County State Aid
Highway 14 (CSAH 14) to County State Aid Highway 15 (CSAH 15), to the Jurisdiction of Lake Elmo
upon the completion of the Project and conditions of the Agreement; and
WHEREAS, the City of Lake Elmo agrees that all conditions of the Transfer Agreement have
been met by Washington County; and
WHEREAS, Washington County has revoked Stillwater Way, from County State Aid Highway
14 (CSAH 14) to County State Aid Highway 15 (CSAH 15), from a County State Aid designation; and
WHEREAS, pursuant to Minnesota Statute 163.11, the Washington County Board of
Commissioners has transferred all that part of Stillwater Way from County State Aid Highway 14 (CSAH
14) to County State Aid Highway 15 (CSAH 15) to the City of Lake Elmo, as adopted by Washington
County Resolution No. 2020-091 on September 1, 2020; and
WHEREAS, the Washington County Board of Commissioners has adopted Resolution No. 2020-
111 on October 6, 2020, revising designation of County State Aid Highway No. 14 and 15 within the
corporate limits of the City of Lake Elmo, including County State Aid Highway No. 14 (Stillwater
Boulevard North) from the south junction of Lake Elmo Avenue North to Mendel Avenue North, and
County State Aid Highway No. 15 (Manning Avenue North) from 32nd Street North to McDonald Drive
North, and including the locating, establishing, designating and numbering the County State Aid Highway
System of Washington County; and
WHEREAS, said resolution locates and establishes certain County State Aid Highways
within the corporate limits of the City of Lake Elmo; and
WHEREAS, the City of Lake Elmo is requesting that all that part of Stillwater Way, from
County State Aid Highway 14 (CSAH 14) to County State Aid Highway 15 (CSAH 15), be designated a
Municipal State Aid Street under the provisions of Minnesota Law.
NOW, THEREFORE, BE IT RESOLVED, the City of Lake Elmo agrees to the jurisdictional transfer
of Stillwater Way from County State Aid Highway 14 (CSAH 14) to County State Aid Highway 15
(CSAH 15).
NOW, THEREFORE, BE IT RESOLVED, the City of Lake Elmo shall own and be solely responsible
for all maintenance, including snow and ice control, and the maintenance of the storm sewer and culverts
located within the transferred portions of the road right-of-way including the bituminous trail.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo that the
resolution adopted by the County Board, a copy of which is attached hereto and made a part thereof,
locating or establishing the County State Aid Highway system within the City limits (and revoking certain
portions of said system) is in all things approved.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lake Elmo that
Stillwater Way, described as follows, to-wit:
Municipal State Aid Street (MSAS) xxx (Stillwater Way North) from County State Aid
Highway (CSAH) 14 (Stillwater Boulevard North) to County State Aid Highway 15
(Manning Avenue North)
be and hereby is, established, located, and designated a Municipal State Aid Street subject to the approval
of the Commissioner of Transportation of the State of Minnesota.
BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to forward two
certified copies of this resolution to the Commissioner of Transportation for consideration, and upon
approval of the designation of said roads or portion thereof, that same be constructed, improved and
maintained as a Municipal State Aid Street of the City of Lake Elmo, to be numbered and known as (to be
provide by the Office of State Aid).
ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE FOURTH DAY OF NOVEMBER,
2020.

RESOLUTION APPROVING THE REVOCATION OF COUNTY STATE AID DESIGNATION ON
PORTIONS OF COUNTY STATE AID HIGHWAY (CSAH) 14 AND 15 AND ESTABLISHING COUNTY
STATE AID HIGHWAY 14 AND 15 IN THE CITY OF LAKE ELMO
WHEREAS, it appears to the County Board that portions of Stillwater Boulevard North, 40th Street North,
and Manning Avenue should be designated as a County State Aid Highway under the provisions of
Minnesota Law; and
WHEREAS, it appears to the County Board that portions of Stillwater Boulevard North, 40th Street North,
and Manning Avenue North should be revoked as a County State Aid Highway under the provisions of
Minnesota Laws.
NOW, THEREFORE, BE IT RESOLVED, that subject to the approval by the Minnesota Commissioner
of Transportation, the Washington County Board of Commissioners hereby determines that County State
Aid Highway 14 (Stillwater Boulevard North/Manning Avenue/40th Street North) from the south junction
of Lake Elmo Avenue North to Mendel Avenue North, and hereby is, revoked as a County State Aid
Highway. A map of this roadway is included in the attached Exhibit A.
NOW, THEREFORE, BE IT RESOLVED, that subject to the approval by the Minnesota Commissioner
of Transportation, the Washington County Board of Commissioners hereby determines that County State
Aid Highway 15 (Manning Avenue North) from 32nd Street North to 40th Street North, and hereby is,
revoked as a County State Aid Highway. A map of this roadway is included in the attached Exhibit A.
NOW, THEREFORE, BE IT RESOLVED, that subject to the approval by the Minnesota Commissioner
of Transportation, the Washington County Board of Commissioners hereby determines that County State
Aid Highway 15 (Stillwater Boulevard North) from the junction of Manning Avenue/Stillwater Boulevard
North to McDonald Drive North, and hereby is, revoked as a County State Aid Highway. A map of this
roadway is included in the attached Exhibit A.
NOW, THEREFORE, BE IT RESOLVED, that subject to the approval by the Minnesota Commissioner
of Transportation, the Washington County Board of Commissioners hereby determines that Stillwater
Boulevard/40th Street North from the south junction of Lake Elmo Avenue North to Mendel Avenue North
shall be established, located and designated a Washington County State Aid Highway and identified as
County State Aid Highway 14. A map of this roadway is included in the attached Exhibit A.
NOW, THEREFORE, BE IT RESOLVED, that subject to the approval by the Minnesota Commissioner
of Transportation, the Washington County Board of Commissioners hereby determines that Manning
Avenue North from 32nd Street North to McDonald Drive North shall be established, located and designated
a Washington County State Aid Highway and identified as County State Aid Highway 15. A map of this
roadway is included in the attached Exhibit A.
BE IT FURTHER RESOLVED, that the County Administrator is hereby authorized to forward two
certified copies of this resolution to the Commissioner of Transportation for their consideration.

of said road or portion thereof, that same be constructed, improved and maintained as a County State Aid
Highway of Washington County.
