ISSUE BEFORE COUNCIL: Should the City Council accept the improvements and approve Pay Request
No. 4 (Final) for the Well No. 5 Connecting Watermain Improvements?
BACKGROUND: Miller Excavating, Inc. was awarded a construction contract on July 16, 2020 to
complete the Well No. 5 Connecting Watermain Improvements. The contractor has completed the work in
accordance with the contract, plans, and specifications, including all punch list items.
PROPOSAL DETAILS/ANALYSIS: Miller Excavating, Inc., has submitted Partial Pay Request No. 4
(Final) in the amount of $28,393.60. The Project Engineer has prepared a Certificate of Completion
indicating that all work is completed, including all punch list items, and is recommending the acceptance
of the improvements and release of final retainage. Project acceptance will initiate the one-year warranty
period for the improvements. The one-year warranty will begin on December 15, 2020 and will extend
through December 15, 2021.
FISCAL IMPACT: The final total construction cost is $519,469.60. This is 3.8% over the original
contract amount of $500,000.33, but remains within the overall project budget. The total project cost was
$601,000 which includes all engineering, geotechnical work, construction observation, and administration
costs. This amount does include a contingency for outstanding engineering costs including record plans and
warranty period review and follow up.
The project is partially funded by the MPCA grant agreement for construction of Well No. 5. The grant
agreement stipulates the cost split to be paid 90% by the MPCA ($540,900) and 10% by the City of Lake
Elmo ($60,100). The total project costs for the Well No. 5 Connecting Watermain project is within the
overall grant agreement budget amount.
RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda,
accept the improvements and approve Pay Request No. 4 (Final) for the Well No. 5 Connecting Watermain
Improvements. If removed from the consent agenda, the recommended motion for the action is as follows:
“Move to accept the Well No. 5 Connecting Watermain Improvements and approve Pay Request No. 4
(Final) to Miller Excavating, Inc. in the amount of $28,393.60”.
