ISSUE BEFORE COUNCIL: Should the City Council receive contractor bids and reject all bids, or call
for both an improvement and final assessment hearing to be held on May 19, 2020 for the Heritage Farm
Street and Utility Improvements?
BACKGROUND: On March 4th, 2020, the City Council approved the plans and specifications for the
Heritage Farms Street and Utility Improvements and authorized staff to advertise the project for bids. The
improvements include the extension of sanitary sewer service to connect each of the 44 residential
properties in the neighborhood. Improvements also include the reconstruction of approximately 1.2 miles
of residential streets and minor storm sewer improvements. The street segments selected for improvements
include:
• Lisbon Avenue North, from 30th Street to the south end;
• Lisbon Avenue Court North, from Lisbon Avenue to the end of cul-de-sac; and
• 30th Street Circle North, from 30th Street North to 30th Street North
The scope of improvements remain consistent with the plans that were approved by the City Council on
March 4, 2020. The sanitary sewer improvements were initiated by a petition of 32 of the 44 properties.
The Project was advertised on QuestCDN.com and in the Stillwater Gazette in accordance with the
Minnesota Competitive Bidding requirements.
PROPOSAL DETAILS/ANALYSIS: Bids were received and publicly opened online via QuestCDN on
Thursday, April 2, 2020. The City’s design consultant has prepared and attached a Tabulation of Bids. The
City received 7 bids for this project, with S R Weidema, Inc. providing the lowest bid in the amount of
$3,221,642.40. Contractor references for S R Weidema, Inc. were reviewed and verified. The Council has
60 days (until June 1, 2020) to either accept or reject the bids.
Contractor bids exceeded the estimated costs presented in the feasibility report. The project involves deep
utility installation through narrow corridors and creates challenges for the contractor to maintain access
throughout the construction of the project. The contractor pool represented most of the major contractors
we would expect to be interested in this type of project. Of the seven bids received, the 3 lowest bids were
relatively close and appear competitive. With the increased post-bid project cost estimate, the project budget
and preliminary assessment amounts are exceeded. Therefore, the final assessment hearing, which was
scheduled to be held on April 21, 2020 was cancelled. Notice was sent out to each property owner cancelling
the hearing and informing property owners that project bids may be rejected or that costs may be increased.
FISCAL IMPACT: A breakdown of the total project costs are shown in the table below, comparing the
feasibility report costs, used to determine the preliminary assessment amounts, with the post-design cost
estimate and finally the post-bid project cost estimate.

OPTIONS: Staff has identified three options for council consideration.
1. Reject ALL bids that were received and direct the City Clerk to return all bid bonds. Provide staff
direction regarding the future project scope and scheduling.
2. Table action on the bids until the May 19, 2020 City Council meeting. Direct staff to amend the
preliminary assessment amounts for both the street and drainage improvements and sanitary sewer
improvements based on the post-bid project cost estimate. Adopt a resolution calling for both a
public hearing and final assessment hearing for May 19, 2020. This process allows staff and council
to receive property owner input on proceeding with the project at the higher project costs prior to
taking formal action on the bids.
3. Accept bids, award a contract, and complete the improvements as planned, while maintaining the
assessments per the preliminary assessment roll. Under this option, staff would also recommend
the City Council meeting adopt a resolution calling for the final assessment hearing on May 19,
2020 be adopted.
RECOMMENDATION: Staff has prepared two resolutions for City Council consideration.
To reject the bids, staff is recommending that Council approve a resolution receiving contractor bids and
rejecting all bids, thereby officially delaying the project. The recommended motion for this action is as
follows:
“Move to approve Resolution No. 2020–041, receiving and rejecting all bids for the Heritage Farms
Street and Utility Improvements.”
To defer taking action on the bids and to seek property owner input, staff is recommending that Council
table acting on the bids until the May 19, 2020 council meeting and adopt a resolution to Call for
Improvement and Final Assessment Hearing for the Heritage Farm Street and Utility Improvements to be
held on May 19, 2020. The recommended motion for this action is as follows:
“Move to approve Resolution No. 2020–042, to call for improvement and final assessment hearing to
be held on May 19, 2020 for the Heritage Farms Street and Utility Improvements.”

WHEREAS, pursuant to an advertisement for bids for the Heritage Farms Street and
Utility Improvements, bids were received, opened, and tabulated according to law, and bids were
received complying with the advertisement; and
WHEREAS, bids were tabulated, checked and summarized to verify that all
requirements of the submittal were met; and
WHEREAS, the project engineer reviewed the bids and has provided a letter
recommending the award of the contract to the lowest responsible bidder, S R Weidema, Inc., for
the amount of $3,221,642.40; and
WHEREAS, the low bid exceeds the preliminary assessment amounts and available
budget for the project; and
NOW, THEREFORE, BE IT RESOLVED,
1. The construction contract bids for Heritage Farms Street and Utility Improvements are
hereby rejected.
2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids and notice them the City of Lake Elmo is not proceeding
with the Heritage Farm Street and Utility Improvements project at this time.

A RESOLUTION CALLING HEARING ON IMPROVEMENT AND A RESOLUTION
DECLARING COST TO BE ASSESSED AND CALLING HEARING ON PROPOSED
ASSESSMENT FOR HERITAGE FARM STREET AND UTILITY IMPROVEMENTS
WHEREAS, pursuant to City Council authorization, adopted on July 16, 2019, a feasibility
report was prepared by FOCUS Engineering, Inc. and adopted by City Council on September 17, 2019 for
the Heritage Farms Street and Utility Improvements; and
WHEREAS, the feasibility report recommended that benefitting properties be assessed all or a
portion of the cost of the improvements pursuant to the City’s Special Assessment Policy and Minnesota
Statutes, Chapter 429; and
WHEREAS, the feasibility report provides information regarding whether the proposed
improvement is necessary, cost-effective, and feasible; whether it should best be made as proposed or in
connection with some other improvement; the estimated cost of the improvements as recommended; and a
description of the methodology used to calculate individual assessments for affected parcels; and
WHEREAS, estimated project costs have been calculated and updated based on contractor bid
information for the Heritage Farm Street and Utility Improvements including street, drainage, watermain,
and sanitary sewer improvements along Lisbon Avenue North, Lisbon Avenue Court North, and 30th
Street Circle North in the Heritage Farm Development; and
WHEREAS, the estimated total cost of the improvements has increased from $2,708,000 to
$3,725,600; and
WHEREAS, the City Clerk and City Engineer have prepared the proposed amended assessment roll
and will maintain said assessment roll on file in the City offices for public inspection.
NOW, THEREFORE, BE IT RESOLVED,
1. That the City Council will consider the improvements in accordance with the report and the
assessments of the abutting properties for all or a portion of the cost of the improvements
pursuant to Minnesota Statues, Chapter 429 at an estimated total project cost of $3,725,600.
2. A public hearing shall be held on such proposed improvements on the 19th day of May, 2020 and
conducted by electronic means pursuant to Minnesota Statutes Section 13D.021 because of the
COVID -19 pandemic during a regularly scheduled City Council meeting at or approximately
after 7:00 P.M. and the clerk shall give mailed and published notice of such hearing and
improvement as required by law.
3. The portion of the cost of such street and drainage improvements to be paid by the City is hereby
declared to be $1,703,100, and the portion of the cost to be assessed against benefited property
owners is declared to be $657,000.
4. The portion of the cost of such sanitary sewer improvements to be paid by the City is hereby
declared to be $0.00, and the portion of the cost to be assessed against benefited property owners
is declared to be $1,254,000.
5. The portion of the cost of such watermain improvements to be paid by the City is hereby declared
to be $111,500, and the portion of the cost to be assessed against benefited property owners is
declared to be $0.00.
6. The City Clerk, with the assistance of the City Engineer, has calculated the proper amount to be
specially assessed for such improvements against every assessable lot, piece or parcel of land to
be benefited by the improvements, and the Clerk has filed a copy of such proposed assessment in
the City offices for public inspection.
7. Assessments shall be payable in equal annual installments extending over 15 years for street and
drainage improvements, and 20 years for sanitary sewer improvements, the first of the
installments to be payable on or before the first Monday in January, 2021 and shall bear interest
at the rate of 3.50 percent per annum from the date of the adoption of the assessment resolution.
8. A public hearing shall be held on the 19th day of May, 2020 and conducted by electronic means
pursuant to Minnesota Statutes Section 13D.021 because of the COVID-19 pandemic during a
regularly scheduled City Council meeting at or approximately after 7:00 P.M. to pass upon such
proposed assessment. All persons owning property affected by such improvement will be given
an opportunity to be heard with reference to such assessment.
9. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to
be published once in the official newspaper at least two weeks prior to the hearing, and she shall
state in the notice the total cost of the improvement. She shall also cause mailed notice to be
given to the owner of each parcel described in the assessment roll not less than two weeks prior to
the hearings.
10. The owner of any property so assessed may, at any time prior to certification of the assessment to
the county auditor, pay the entire assessment on such property, with interest accrued to the date of
payment, to the City Clerk. No interest shall be charged if the entire assessment is paid before
June 19, 2020. A property owner may at any time thereafter, pay to the City Clerk the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made before October 31 or interest will be
charged through December 31 of the succeeding year.

Notice is hereby given that the City Council of Lake Elmo will conduct a public hearing
on Tuesday, May 19, 2020, at or approximately after 7:00 PM to consider the making of
the following improvements, pursuant to Minnesota Statutes, Sections 429.011 to
429.111.
Street, drainage and sanitary sewer improvements including new municipal sanitary
sewer service to replace individual on-site septic systems; a reconstructed
bituminous street with new concrete curb and gutter; and a repair or restoration of
the existing street drainage system for the following streets:
• Lisbon Avenue North, from 30th Street to the south end;
• Lisbon Avenue Court North, from Lisbon Avenue to the end of cul-de-sac; and
• 30th Street Circle North, from 30th Street North to 30th Street North.
The hearing will be conducted by electronic means pursuant to Minnesota Statutes
Section 13D.021 because of the COVID-19 pandemic. The meeting can be viewed online
by going to the City’s website (http://www.lakeelmo.org/). Instructions for participating
in the meeting via computer will be posted on the City’s website prior to the meeting.
During the meeting the city will also be accepting call‐ins at 213.929.4212, access code
569‐187‐751. Comments can also be provided prior to the meeting which will be
presented to the council. Written comments prior to the meeting must be sent to Julie
Johnson, City Clerk (jjohnson@lakeelmo.org) or voicemails left at (651.747.3914) prior
to the meeting.
The area proposed to be assessed for these improvements include properties abutting the
above referenced streets or properties that gain direct driveway access from the above
referenced streets, and properties that receive access to the municipal sanitary sewer
system. The estimated total cost for the project is $3,725,600. A reasonable estimate of
the impact of the assessment will be available at the hearing. Such persons as desiring to
be heard with reference to the proposed improvements will be heard during this meeting.

thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid,
with interest accrued to December 31 of the year in which such payment is made. Such
payment must be made before October 31 (date assessment certified to County Auditor)
or interest will be charged through December 31 of the succeeding year. If you decide not
to prepay the assessment before the date given above the rate of interest that will apply is
3.50 percent per year.
Once assessments are certified to the County, the assessments are payable in equal annual
installments extending over a period of 15 years for street and drainage improvements
and 20 years for sanitary sewer improvements, the first of the installments to be payable
on or before the first Monday in January 2021 and will bear interest at the rate of 3.50
percent per annum from the date of adoption of the assessment resolution. To the first
installment shall be added interest on the entire assessment from the date of the
assessment resolution until December 31, 2020. To each subsequent installment when
due shall be added interest for one year on all unpaid installments.
The proposed assessment roll is on file for public inspection at the City Clerk’s office and
is available by calling in advance. The total amount of the proposed street improvement
assessment is $657,000. The total amount of the proposed sanitary sewer improvement
assessment is $1,254,000. The City contribution for the overall improvement project is
$1,814,600. Written or oral objections will be considered at the meeting. No appeal may
be taken as to the amount of an assessment unless a written objection signed by the
affected property owner is filed with the municipal clerk prior to the assessment hearing
or presented, via electronic means, to the presiding officer at the hearing. The Council
may upon such notice consider any objection to the amount of a proposed individual
assessment at an adjourned meeting upon such further notice to the affected property
owners as it deems advisable.
An owner may appeal an assessment to district court pursuant to Minnesota Statutes,
Section 429.081 by serving notice of the appeal upon the Mayor or Clerk within 30 days
after the adoption of the assessment and filing such notice with the district court within
ten days after service upon the Mayor or Clerk.
The City Council is authorized in its discretion to defer the payment of an assessment for
any homestead property owned by a person for whom it would be a hardship to make
payment if the owner is 65 years of age or older and/or the owner is a person retired by
virtue of a permanent and total disability or by a person who is a member of the
Minnesota National Guard or other military reserves who is ordered into active military
service, as defined in section 190.05 subdivision 5b or 5c, as stated in the person’s
military orders, for whom it would be a hardship to make the payments. The owner must
request a deferment of the assessment at or before the public hearing at which the
assessment is adopted and make application on forms prescribed by the City Clerk within
30 days after the adoption.
Notwithstanding the standards and guidelines established by the City for determining a
hardship, a deferment of an assessment may be obtained pursuant to Minnesota Statutes
Section 435.193.
