ISSUE BEFORE COUNCIL: Should the City Council accept bids and award a contract for the Stonegate
Addition Street and Utility Improvements?
BACKGROUND: On March 17th, 2020, the City Council approved the plans and specifications for the
Stonegate Addition Street and Utility Improvements and authorized staff to advertise the project for bids.
The Project was advertised on QuestCDN.com and in the Oakdale-Lake Elmo Review in accordance with
the Minnesota Competitive Bidding requirements. The scope of improvements remains consistent with the
plans that were approved by the City Council on March 17, 2020.
The City of Lake Elmo was approved to receive grant funding from the Minnesota Pollution Control
Agency (MPCA) under the 2018 3M Settlement Agreement as an expedited project to extend municipal
water and connect each of the 65 homes in the Stonegate 1st and 2nd Additions. The grant is in the not to
exceed amount of $4,284,300. The terms of the grant are outlined in the Grant Agreement between the City
of Lake Elmo and the MPCA dated October 2, 2019. The neighborhood is located in a Special Well
Construction Area (SWCA) as designated by the Minnesota Department of Health (MDH) after the
discovery of PFAS groundwater contamination and many of the properties have received well advisories
from the MDH and are currently having their water supply treated using GAC filters supplied by the State.
The project extends the public watermain from the adjacent Inwood development along 10th Street North,
then along the public streets, making a looped watermain connection to the adjacent Savona development.
Individual water service stubs will be installed to the edge of right‐of‐way at each of the 65 residential
properties. The project will include restoration following the watermain installation, including a street
reclamation for the Stonegate 2nd Addition along with boulevard sodding throughout the project over the
disturbed areas. The project will include grant funding and administrative processes for ensuring each
property completes the private service connection from the right-of-way to each home, including water
meter installation, removal of granular activated carbon treatment systems (if applicable), sealing of any
private well, and all permitting and connection fees. The private water connection and well sealing
improvements will be contracted separately by each property owner.
PROPOSAL DETAILS/ANALYSIS: Bids were received, publicly opened, and read aloud on Thursday,
April 16, 2020. The City received 2 bids for this project, with A-1 Excavating, Inc. providing the lowest
bid in the amount of $2,692,593.75. Contractor references for A-1 Excavating, Inc. were reviewed and
verified. The City Engineer is therefore recommending that the Council award the contract to the lowest
responsible bidder, A-1 Excavating, Inc. as outlined in the attached letter.
As a part of this award staff is requesting Council to provide the City Administrator authorization to enter
into a material testing contract in the not-to-exceed amount of $40,000. This amount has been budgeted in
the total cost figures presented below and is necessary to complete the project.
FISCAL IMPACT: Approval of this resolution commits the council to enter into a construction contract
for the project. The post-bid total estimated project cost is $4,359,400. This includes the public watermain
improvements and service stubs, the private water service connections and well sealing improvements, and
the street and storm sewer improvements. The improvements will be funded through a grant from the
MPCA under the 2018 3M Settlement Agreement as an expedited project, and in accordance with the
MPCA-Lake Elmo Grant Agreement dated October 2, 2019. Additional grant funding has been requested
to fully fund the project.
RECOMMENDATION: Staff is recommending that the City Council approve a resolution accepting bids
and awarding a contract to A-1 Excavating, Inc. in the amount of $2,692,593.75 for the Stonegate
Street and Utility Improvements. The recommended motion for this action is as follows:
“Move to approve Resolution No. 2020–050, accepting bids and awarding a contract to A-1
Excavating, Inc. in the amount of $2,692,593.75 for the Stonegate Addition Street and Utility
Improvements.”
Staff is also recommending that the City Council authorize the City Administrator to enter into a material
testing contract in the not-to-exceed amount of $40,000. The recommended motion for this action is as
follows:
“Move to authorize the City Administrator to enter into a material testing contract in the not-to-exceed
amount of $40,000 for the Stonegate Addition Street and Utility Improvements.”

A RESOLUTION ACCEPTING BIDS AND AWARDING A CONTRACT
FOR THE STONEGATE ADDITION STREET AND UTILITY
IMPROVEMENTS
WHEREAS, pursuant to an advertisement for bids for the Stonegate Addition Street and
Utility Improvements, bids were received, opened, and tabulated according to law, and bids were
received complying with the advertisement; and
WHEREAS, bids were tabulated, checked and summarized to verify that all
requirements of the submittal were met; and
WHEREAS, the project engineer reviewed the bids and has provided a letter
recommending the award of the contract to the lowest responsible bidder, A-1 Excavating, Inc.,
for the amount of $2,692,593.75.
NOW, THEREFORE, BE IT RESOLVED,
1. That the Mayor and City Clerk are hereby authorized and directed to enter into a Contract
in the accordance with the above ordered Project, in the amount of the Contractor’s
lowest responsible bid, and according to the plans and specifications thereof approved by
the City Council.
2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, except that the deposits of the successful bidder and the
next two lowest bidders shall be retained until a contract has been signed.
