ISSUE BEFORE COUNCIL: Should the City Council accept the improvements and approve Pay Request
No. 1 (FINAL) for the 2020 Crack Seal Project?
BACKGROUND: The 2020 Crack Seal Project has been fully completed for both Lake Elmo and
Denmark Township. The Project Engineer has prepared a Certificate of Completion and is recommending
acceptance of the improvements and release of payment in full. The one-year warranty period will begin
on July 21, 2020, and will extend to July 21, 2021.
PROPOSAL DETAILS/ANALYSIS: Gopher State Sealcoat, Inc. has submitted Pay Request No. 1
(FINAL) in the amount of $50,486.00. The work completed for Lake Elmo was $35,490.00, including
$30,322 for the original street areas and $5,168 for the public parking lot areas. The work completed for
Denmark Township was $14,996.00. The request has been reviewed and payment is recommended in the
amount requested. Per the Joint Services Agreement, Denmark Township will be invoiced for their portion
of the construction cost.
FISCAL IMPACT: Additional crack sealing work was completed for Lake Elmo to crack seal the Tablyn
Park parking lot, Demontreville Park parking lot and basketball court, Fire Station #1 parking lot, and Public
Works Shop parking area and entrance driveway. This additional work was completed in the amount of
$5,168.00 as directed by the Public Works Director.
RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda,
accept the improvements and approve Pay Request No. 1 (FINAL) to Gopher State Sealcoat, Inc. in the
amount of $50,486.00 for the 2020 Crack Seal Project. If removed from the consent agenda, the
recommended motion for the action is as follows:
“Move to accept the improvements and approve Pay Request No. 1 (FINAL) to Gopher State Sealcoat,
Inc. in the amount of $50,486.00 for the 2020 Crack Seal Project; which includes $35,490.00 for work
completed in the City of Lake Elmo, and $14,996.00 for work completed in Denmark Township”.

accordance with the Contract dated June 8, 2020. The above-mentioned improvement is hereby
declared to be complete and acceptance of this work is recommended.
