PRESENT: Mayor Mike Pearson and Councilmembers Justin Bloyer, Dale Dorschner and Lisa McGinn. ABSENT: Councilmember Nelson Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Planning Director Roberts, and City Clerk Johnson APPROVAL OF AGENDA Councilmember Bloyer, seconded by Councilmember McGinn, moved TO APPROVE THE AGENDA AS PRESENTED. Motion passed 4 – 0. ACCEPT MINUTES Minutes of the July 7, 2020 Regular Meeting were accepted as presented. PUBLIC COMMENTS/INQUIRIES None PRESENTATIONS Richard Sachs Sr. was honored for his 43 years of service with the Lake Elmo Fire Department and Mayor Pearson declared Saturday, July 25, 2020 as Richard Sachs Day. CONSENT AGENDA 2. Approve Payment of Disbursements and Payroll 3. Accept June 2020 Building Department Report 4. Accept June 2020 Public Works Report 5. Approve Transfer of Liquor License for Village Wine & Spirits 6. Authorize Advertising for Permit Technician 7. Approve Pay Request No. 1 for Well No. 5. 8. Approve Pay Request No. 1 for Stonegate Addition Street and Utility Improvements. 9. Approve Pay Request No. 1 (Final) for the 2020 Crack Seal Project. 10. Approve Engineering Services Contract for Hamlet on Sunfish Lake Street and Utility Improvements. 12. Approve Lake Elmo Independent Living Brookfield Lease Councilmember Bloyer, seconded by Councilmember McGinn, moved TO APPROVE THE CONSENT AGENDA AS PRESENTED. Motion passed 5 - 0. ITEM 13: 2019 Audit Presentation Andy Hering, CPA with Redpath and Company, presented the 2019 audit report, noting that the City received the highest rating with a “clean” opinion. ITEM 14: Bruggeman Open Space PUD Concept Plan Review Planning Director Roberts reviewed the modifications made to the proposed conditions of approval based on comments received at the previous Council Meeting. Tim Mandel, 2479 Lisbon Avenue North, commented that the overall plan works well and asked for more detail on the buffer zone. Councilmember McGinn, seconded by Mayor Pearson, moved TO ADOPT RESOLUTION 2020 – 074 APPROVING THE OP PUD CONCEPT PLAN AS REQUESTED BY PAUL BRUGGEMAN OF BRUGGEMAN BUILDERS FOR PID# 24-029-21-13-0002 FOR THE PROPERTY LOCATED AT 2500 MANNING AVENUE NORTH. THIS APPROVAL INCLUDES CITY COUNCIL APPROVAL OF THE FOUR EXCEPTIONS AND MODIFICATIONS NOTED HEREIN AND SHALL SUBJECT TO RECOMMENDED CONDITIONS OF APPROVAL AS OUTLINED IN THE STAFF REPORT. Councilmember Bloyer, seconded by Councilmember Dorschner, moved TO AMEND THE CONDITIONS OF APPROVAL TO STRIKE THE WORDS “WITH AN HOA”. Motion passed 3 – 1. (Pearson – nay) Primary motion passed 4 – 0. ITEM 15: Shiltgen Farm Property PUD Concept Plan Review Planning Director Roberts presented an overview of the request for concept plan review of a proposed residential housing development on 105.3 acres located at 10880 Stillwater Boulevard. Ben Schmidt spoke on behalf of the applicant, Excelsior Group, commenting on trails, access, site plan and density. Mayor Pearson, seconded by Councilmember McGinn, moved TO DENY THE CONCEPT PLAN. LAKE ELMO CITY COUNCIL MINUTES JULY 21, 2020 Page 3 of 3 Councilmember Bloyer, seconded by Councilmember McGinn, moved TO TABLE THE CURRENT ITEM. Motion passed 4 – 0. COUNCIL REPORTS Mayor Pearson: Working with residents regarding flooding and water issues. Councilmember Dorschner: Working with residents regarding flooding and water issues. STAFF REPORTS AND ANNOUNCEMENTS Administrator Handt: Provided a recruitment update and reported no the Four Corners pre- construction meeting and stated that Mr. Emerson may not be starting construction August 3rd as expected.
