ISSUE BEFORE COUNCIL: Should the City Council approve Change Order No. 1 for the 2020 Mill
and Overlay project?
BACKGROUND: Minnesota Paving and Materials was awarded a construction contract on June 2, 2020
to complete the 2020 Mill and Overlay Project. Work has been delayed after investigating a sink hole along
the project corridor resulting in the discovery of a 24-inch RCP culvert crossing Jamaca Avenue that is in
need of replacement. The project has a substantial completion date of August 28, 2020 and final completion
date of September 18, 2020.
PROPOSAL DETAILS/ANALYSIS: Minnesota Paving and Materials has submitted a change order to
address additional work required to fully replace a 24-inch RCP culvert crossing Jamaca Avenue N. The
project bid included an item to make repairs to the culvert but upon excavation it was discovered that a 16-
inch HDPE watermain pipe installed in 2005 was drilled through the culvert creating a near full blockage.
Given the discovered condition, a full culvert removal and replacement is necessary prior to completing the
mill and overlay of the roadway. Due to the delay and added work, a contract time extension is also being
recommended for the project, extending the substantial completion date to September 18, 2020 and final
completion date to October 2, 2020.
FISCAL IMPACT: This change order will increase the contract in the amount of $33,100.00 bringing the
revised construction contract to $333,060.18. Since the correction is due to a storm sewer pipe staff is
recommending that 50% of the culvert replacement, or $16,550, be funded through the storm water fund
and 50% be funded through the street maintenance fund. With this change order both funds remain within
their respective 2020 budgets.
RECOMMENDATION: Staff is recommending that the City Council approve, as part of the Consent
Agenda, Change Order No. 1 for the 2020 Mill and Overlay Project. If removed from the consent agenda,
the recommended motion for the action is as follows:
“Move to approve Change Order No. 1 for the Mill and Overlay Project, thereby increasing the
contract amount by $33,100.00”.

CHANGE ORDER DESCRIPTION / JUSTIFICATION:
This change order is being processed at the direction of the City to amend the Contract to complete additional work. The Change Order includes
additional work to replace an existing 24-inch RCP culvert that was collapsed by the installation of watermain in 2005. The culvert was discovered
through exporatory digging to investigate a known sinkhole. A new pay item shall be added as follows: CO1-1 : CULVERT REPLACEMENT. This item shall
include payment for all work necessary for replacing an existing 24-inch RCP culvert, including traffic control, exploratory excacation, removal and
replacement of bituminous pavement, removal and replacement of storm sewer including installation of flared end sections and rip rap. This Change
Order shall also eliminate Bid Item No. 19 - CORRECT FAILED CULVERT as the culvert correction/repair work is not needed on the project.
This Change Order also provides for a change in the Substantion Completion date as outlined in Section 0520, Article 3.02.A. from August 18, 2020 to
September 18, 2020. The Final Completion date in Article 3.02.B shall be changed to October 2, 2020.
