ISSUE BEFORE COUNCIL: Should the City Council accept the improvements and approve Pay Request
No. 1 (FINAL) for the 2020 Seal Coat Project?
BACKGROUND: The 2020 Seal Coat Project has been fully completed for both Lake Elmo and Denmark
Township. The Project Engineer has prepared a Certificate of Completion and is recommending acceptance
of the improvements and release of payment in full. The one-year warranty period will begin on September
15, 2020, and will extend to September 15, 2021.
PROPOSAL DETAILS/ANALYSIS: Allied Blacktop Company has submitted Pay Request No. 1
(FINAL) in the amount of $110,879.16. The work completed for Lake Elmo was $95,760.00. The work
completed for Denmark Township was $15,119.16. The request has been reviewed and payment is
recommended in the amount requested. Per the Joint Services Agreement, Denmark Township will be
invoiced for their portion of the construction cost.
FISCAL IMPACT: None. Payment is proposed in accordance with the contract for the project. Payment
remains within the authorized scope and budget amount for Lake Elmo streets. Denmark Township will be
invoiced for its remaining share of the project costs.
RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda,
accept the improvements and approve Pay Request No. 1 (FINAL) to Allied Blacktop Company in the
amount of $110,876.16 for the 2020 Seal Coat Project. If removed from the consent agenda, the
recommended motion for the action is as follows:
“Move to accept the improvements and approve Pay Request No. 1 (FINAL) to Allied Blacktop
Company in the amount of $110,879.16 for the 2020 Seal Coat Project; which includes $95,760.00 for
work completed in the City of Lake Elmo, and $15,119.16 for work completed in Denmark Township”.

accordance with the Contract dated June 16, 2020. The above-mentioned improvement is hereby
declared to be complete and acceptance of this work is recommended.
