HomeMy WebLinkAbout12-07-04 Packet attachmentsLake Elmo City Council December 7, 2004 Agenda Section: Planning, Land Use & Zoning Agenda Item: Final Plat and Development Agreement — "Tapestry" Background Information for December 7, 2004: On October 5, 2004 the City Council approved the OP Development Stage Plan/CUP and Preliminary Plat of the Tapestry OP. This is a neighborhood of 67 single family lots on a site of 172 acres. With some minor reconfiguration of lot shapes, the submitted Final Plat drawing complies with the approved Preliminary Plat, including conditions that were attached. The City Engineer has reviewed all infrastructure construction drawings. and has found those plans to comply with City standards. The Minnesota Land Trust has agreed to hold the Preserved Open Space easements on all of the large Preserved Open Space outlots. The proposed Development Agreement is attached, and reflects some unique features as follow: I. The Valley Branch Watershed District has already issued the grading permit for this project and will be totally responsible for erosion control inspection/enforcement during the mass grading and storm pond construction phase. VBWSD will be holding an 5800,000 bond to secure the developer's compliance with the approved plan and Best Practices. The City's inspection responsibility for this early work will be minimal, and therefore the City's required development security is minimal for that work as well. The City will undertake its usual erosion control on a lot -by -lot basis upon completion of mass grading and provision by the developer of a mass grading "as -built" that is approved by both Valley Branch and the City Engineer. The developer will be constructing over 2.5 miles of paved trails within the neighborhood, of which about 1 mile will be Public (one East to West Public Corridor, and one South to North Public Corridor). The Park Dedication requirement will be credited $61,797 for the Public Trail construction and easement to the City. The balance of the Park Dedication requirement ($179,003) will be paid to the City Park Dedication Capital Fund in cash. 3. As the result of the water services issues that surfaced with the Heritage development, the City (through the City Engineer), will be undertaking "full time" inspection of the infrastructure construction (water, sewer, storm sewer, streets and trails) rather than the periodic inspections the City has done in the past. TKDA has advised that this full time inspection will be billed at 3% of the construction estimated costs ($58,000). The Agreement calls for the developer paying the City for those services — which are beyond those assumed the usual Administrative Fee ($50,605 for this project). 4. The developer will be installing a significant length of 16 inch water main, extending from East to West through the project — double the diameter required to serve those homes, but required by the City for trunk water system purposes as a part of the Lake Jane interconnect and water tower construction projects. As such, the developer will be compensated by the City Water Enterprise Fund for the cost of the water main oversizing ($66,500). The City treated trunk oversizing in Fields 11. in a like manner. In a related matter, this OP Plan has, from Concept Stage on, contemplated sale to the developer of the development rights (6 dwelling units) from the 16 acre parcel acquired by the City from the Berschen family in the mid-1990's for a public works building site. That building plan was later abandoned by the City as the result of neighborhood objections. The City has a written appraisal report valuing those development rights at $360,000 which will be paid the City. The 16 acre site will then be deeded back to the Berschen family in return for a Minnesota Land Trust easement (development rights forever extinguished) over 16 acres of Berschen land adjacent to the Tapestry site. A Resolution completing that transaction is also attached for Council action. CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 2004- A RESOLUTION APPROVING THE t INAL PLAT, FINAL OP PLAN AND DEVELOPMENT AGREEMENT OF TAPESTRY AT CHARLOTTE'S GROVE WHEREAS, the Lake Elmo Planning Commission reviewed the preliminary plat of TAPESTRY AT CHARLOTTE'S GROVE on September 27, 2004, and recommended approval to the City Council and; WHEREAS, the Lake Elmo City Council previously considered and approved the preliminary plat and OP Development Stage Plan/CUP of TAPESTRY AT CHARLO11E'S GROVE on October 15, 2004 and; WHEREAS, the Final Plat, Final OP Plan and Development Agreement of TAPESTRY AT CHARLOTTE'S GROVE presented to the City Council conforms to the standards of Section 300 and Section 400 of the City Code; and, conforms to the approved Preliminary Plat and Development Stage Plan. NOW, THEREFORE BE IT RESOLVED, that the Lake Elmo City Council does hereby approve and accept the Final Plat, Final OP Plan and Development Agreement of TAPESTRY AT CHARLOTTE'S GROVE as the same as on file with the City Administrator subject to the following conditions: . A RESOLUTION WAIVING PLANNING COMMISSION REVIEW AND AUTHORIZING SALE OF PROPERTY WHEREAS, the City of Lake Elmo ("Lake Elmo") is the fee owner of the real property described on Exhibit A attached hereto (the "Property"); and WHEREAS, the appraised market value of the Property is $360,000.00; and WHEREAS, Lake Elmo has received an offer from St. Croix Farms, LLC, a Minnesota limited liability company ("St. Croix Farms") to purchase the Property for its appraised value. NOW, THEREFORE, BE IT RESOLVED that the Lake Elmo City Council hereby determines that the sale of the Property bears no relationship to the City's Comprehensive Plan and dispenses with the Planning Commission review of the proposed sale; that the sale of the Property to St. Croix Farms for its appraised value is approved; and that the Mayor is authorized to execute the appropriate deed of conveyance subject to the following conditions: 1. St. Croix Farms will in turn convey the Property to John A. Berschens and Janet Berschens or, in the alternative, at the request of St. Croix Farms, Lake Elmo will convey the Property directly to John A. Berschens and Linda Berschens. 2. John A. CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 2004-086 A RESOLUTION APPROVING THE OP DEVELOPMENT STAGE PLAN, CONDITIONAL USE PERMIT, AND PRELIMINARY PLAT OF TAPESTRY AT CHARLOTTE'S GROVE WHEREAS, St. Croix Farm, LLC have made application for a Development Stage Plan, Conditional Use Permit, and Preliminary Plat to create 67 residential building lots and nine outlots on a parcel of 173 acres. The property is generally located south of 45th Street North and West of Keats Avenue and legally described as follows: Property 1.D. Numbers 11-029-21-32-0001, 10-029-21-44-0002 and an easterly 16 acre portion of Property I.D. No. 10-029-21-42-0001 WHEREAS, at its September 27, 2004 meeting, the Planning Commission reviewed and unanimously recommended approval of this application to plat a 173 acre parcel as a residential development of 67 building lots and nine outlots. WHEREAS, the Preliminary Plat of TAPESTRY AT CHARLOTTE'S GROVE was presented to the City Council at its October 5, 2004 City Council Meeting where the following Findings were made: 1. The OP Development. Stage Plan is consistent with the Lake Elmo Comprehensive Plan and the approved OP Concept Plan. 2. The OP Development Stage Plan complies with the doctunentation requirements and standards of the OP Ordinance, except as noted. The Preliminary Plat complies with the documentation requirements and standards of Section 400 of the City Code (Subdivision). NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of Lake Elmo does hereby approve and accept the OP Development Stage Plan, Conditional Use Permit, and Preliminary Plat of TAPESTRY AT CHARLOTTE'S GROVE, per plans that staff dated September 20, 2004, as the same on file with the City Administrator, based on the following Conditions: 1. N. de. 0.71H Sfr. N. AT CHARLOTTE'S OROVE LAKE ELMO, mnewsarn DEVELOPMENT AGREEMENT CITY OF LAKE ELMO TAPESTRY AT CHARLOTTE'S GROVE 1.00 Parties. This Agreement is dated the day of , 2004, and is entered into by and between City of Lake Elmo, a Minnesota municipal corporation (herein "City"); and St. Croix Farms, LLC, a Minnesota limited liability company (herein "Developer"). 2.00 Property Description. The Developer represents that it is the record fee owner of property described on Exhibit A, attached and incorporated herein, which will be platted as Tapestry at Charlotte's Grove. 3.00 Final Plat Approval. On the day of , 2004, the City Council approved the final plat of Tapestry at Charlotte's Grove, which is attached and incorporated as Exhibit B. The City's approval was conditioned upon the Developer entering into this Development Contract. 4.00 Terms and Conditions. NOW, THEREFORE, in reliance upon the representations contained herein; in compliance with the City's Zoning and Subdivision Regulations; and in consideration of the mutual undertakings herein expressed, the parties agree as follows: 4.01 Developer Improvements. The Developer shall construct the following improvements in compliance with plans and specifications which have been reviewed and approved by the City's Consulting Engineer, which are attached and incorporated herein as Exhibit C: A. Site Grading and Turf Restoration. Site grading improvements shall include common excavation, subgrade correction, embankment and pond excavation. Turf restoration shall include seeding, mulching and erosion control. 1. Site Grading Improvements shall be completed on or before the 1st day of September , 2005. 2. Turf restoration improvements shall be completed on or before the 15t day of September, 2005. B. Landscaping. Developer shall complete all landscaping improvements on or before the 10th day of June, 2006. C. Storm Sewer. Storm sewer improvements include all necessary storm sewers, catch basins, culverts, and other apparatus. Storm sewer improvements shall be completed by the 1st day of September , 2005. D. Street Improvements. Street improvements include subgrade preparation, grayel base, bituminous surfacing, bituminous curb and concrete curbs, where required. 1. Unusable material within the roadway shall be removed by the Developer. 2. All subgrade excavation and filling shall be completed by the Developer in accordance with MNDOT's specifications. The City reserves the right to test as necessary, at the Developer's expense, all grading work. A test roll of the street subgrade shall be passed prior to acceptance of the subgrade by the City. Subgrade and the initial course of street improvements shall be completed by the 15t day of September, 2005. The final wear course of the street shall be completed by the 1st day of September 2006. E. Waste Water Treatment System/Drain Field. The waste water treatment system/drain field shall be comprised of a series of pipes, septic tanks, treatment ponds, drain fields and appurtenances, and shall be completed prior to the issuance of any certificates of occupancy. F. Street Sins. The City will order and install street signs. The Developer shall pay for all costs incurred by the City. G. Water Main. Water main improvements include pipes, hydrants and appurtenances and shall be completed on or before theist day of September , 2005. The City Water Enterprise Fund will reimburse the developer $66,500 for water main oversizing upon acceptance of the improvement by the City. 4.02 Estimated Cost of Developer Secured Improvements. Prior to the City's endorsement of approval on the final plat, the Developer shall deposit security with the City Administrator in an amount equal to 125% of the City Engineer's estimate of the cost of constructing the Developer secured improvements which have not been completed and accepted by the City prior to final plat approval. The security may be in the form of a cash escrow fund, a performance bond, or a letter of credit. The form of security shall be approved by the City Attorney. 4.04 Reduction of Security. Upon completion of required improvements for the Property and acceptance by the City, the City Council shall reduce the amount of security for the completed improvements provided that in no case shall the total remaining security be equal to less than 125% of the estimated costs of the incomplete improvements. 4.05 Administrative Fees. Developer agrees to pay an administrative fee to the City in an amount equal to 2.5% of the Developer's secured improvements. The administrative fee for this project equals $50,605.00. 4.06 Utility Company Improvements. The utility improvements include underground gas, electric, and telephone service as installed by the appropriate utility company at the direction of the Developer. The Developer shall arrange for the installation of underground gas, electric, telephone and cable television after the first lift of asphalt is complete but before the final lift is started. Utility improvements shall be completed by the 1st day of September , 2005. 4.07 Recording Requirements. Prior to the conveyance of any of the lots in Tapestry at Charlotte's Grove, and except as hereinafter provided, prior to the issuance of any development permits, the Developer shall provide the City with evidence that the following documents have been recorded. A. Plat. B. A Declaration of Covenants in a form approved by the City's Attorney. The Declaration of Covenants shall include the following provisions: 1. Require the Homeowner Association to be responsible for the Owner's obligations as contained in the appropriate Conservation or Open Space Easements. 2. Require the Homeowner Association to maintain and operate the waste water treatment system/drain field. Require the Homeowner Association to maintain the landscaped island constructed within the right-of-way at the entrance to Tapestry at Charlotte's Grove. 4. Provide that, in the event of a failure by the Homeowner Association to satisfy the obligations defined in Section 4.07B and its subdivisions of this Development Agreement, as determined by the City's Consulting Engineer, the City may undertake such obligations and assess all costs incurred to the Homeowner Association; and in such event, the Developer for itself and for the Homeowner Association hereby waives the requirements otherwise imposed by MS 429. 5. Provide that any provisions in the Covenants relating to the obligations defined in Section 4.07B and its subdivisions of this Development Agreement may not be repealed or amended without consent of the City. C. Homeowner Association Articles of Incorporation. D. A Conservation Easement from the Berschens to the Minnesota Land Trust and the City, attached and incorporated as herein Exhibit D. E. A Conservation Easement from the Developer to the Minnesota Land Trust and the City, attached and incorporated herein as Exhibit E. F. Miscellaneous drainage, landscape, public utility, roadway and open space easements from the Berschens to the City, attached and incorporated herein as Exhibits F, G and H. G. The conveyance of the public trailway easement attached and incorporated herein as Exhibit I. H. Use and disposition of Outlots is as follows: 1. Outlots C, H, K, L, R, S, T, and V to be deeded to the Homeowner Association and be encumbered by a Minnesota Land Trust Conservation Easement 2. Outlots M, N, 0, and P shall be in the fee ownership of the Moris family, and encumbered by a Minnesota Land Trust Conservation Easement. 3. Outlots A, B, D and W shall be deeded to the Homeowner Association and encumbered by a roadway, utility and drainage easement to the City. 4. Outlots F, G, I, and J shall be deeded to the Homeowner Association. 5. Oudot Q shall be in fee ownership of the Moris Family and encumbered by a roadway, drainage and utility easement to the City. 6. (Berschen Site) - Outlots A and B shall be in fee ownership of the Berschen Family and encumbered by a roadway, drainage and utility easement to the City. 7. (Berschen Site) - Outlot C shall. be in fee title to the Berschen Family and subject to a Conservation Easement to the Minnesota Land Trust. 8. (Berschen Site) - Outlot D shall be in fee title to the Berschen Family and subject to a Landscaping Easement to the Homeowner Association. 4.08 Public Use Dedication. The Developer's public use dedication requirement for Tapestry at Charlotte's Grove shall consist of a payment in the amount of $179,003; the dedication of the public trail easement as specified by the City; and, the construction of Public Trails per plans approved by the City Engineer at a cost to the developer of $61,797. 4.09 Inspection. The City, through its City Engineer, shall provide for competent inspection during construction of publicly dedicated infrastructure and private waste water treatment systems/drain fields. The Developer shall pay the City the amount of 3% of the estimated cost of water main, sewer, street and storm sewer infrastructure to compensate the City for the construction inspection services. The City 5 Engineer shall provide continuous inspections at the site to insure that the Developer and its contractor are in compliance with the terms of this Agreement, and the infrastructure design standards of the City. The City Engineer shall be provided a minimum of 24 hours notice prior to the commencement of underground pipe laying; and prior to subgrade, gravel base, and bituminous surface construction. Developer's failure to comply with the terms of this section shall permit the City Engineer to issue a stop work order which may result in rejection of the work and which shall obligate the Developer to take all reasonable steps, as directed by the City's Engineer, to insure that the improvements are constructed and inspected pursuant to the terms of this Agreement; and shall further result in the assessment of a penalty in an amount equal to 1%, per occurrence, of the amount of security required in Section 4.03 of this Agreement. 4.10 Prior Land Occupancy. No Certificate of Occupancy shall be issued for any homes until the first wear course of a public street is completed and approved by the City Engineer. If homes are occupied prior to completion of street improvements and acceptance by the City, Developer shall provide all maintenance necessary for such streets including snowplowing, until final acceptance by the City. 4.11 Binding Effect. The terms and provisions of this agreement shall be binding upon and inure to the benefit of the heirs, representatives, successors and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Property. This Agreement, at the option of the City, shall be placed of record so as to give notice thereto to any subsequent purchasers and encumbrancers of all or any part of the Property and all recording fees, if any, shall be paid by the Developer. 4.12 Notices. Whenever in this Agreement notice is required to be given by one party to the other, such notice shall be delivered personally or shall be sent by certified mail, return receipt requested to the following addressees. Such notice shall be deemed timely given when delivered personally or when deposited in the mail in accordance with this section. All plans, special provisions, proposals, specifications and contracts for the improvements furnished and let pursuant to this Agreement shall be and hereby are made a part of this Agreement by reference as if fully set out herein. 4.14 Default. The occurrence of any of the following shall be considered an "event of default" in the terms and conditions contained in this Agreement: A. Failure of the Developer to comply with any of the terms and conditions contained in this Agreement. B. The failure of the Developer to comply with any applicable ordinance or statute with respect to the development of the Property. 4.15 Remedies. Upon the occurrence of any event of default, the City, in addition to any other remedy which may be available to it, shall be permitted to do any of the following: A. City may make advances or take other steps to cure the default, and, where necessary, enter the Property for that purpose. The Developer shalt pay all sums so advanced or expenses incurred by the City, upon demand, with interest from the dates of such advances or expenses at the rate of 10% per annum. No action taken by the City pursuant to this section shall be deemed to relieve the Developer from curing any such default to the extent that it is not cured by the City or from any other default hereunder. The City shall not be obligated, by virtue of the existence or exercise of this right, to perform any such act or cure any such default. The Developer shall save, indemnify, and hold harmless, including reasonable attorney fees, the City from any liability or other damages which may be incurred as a result of the exercise of the City's rights pursuant to this section. B. Obtain an Order from a Court of competent jurisdiction requiring the Developer to specifically perform its obligations pursuant to the terms and provisions of this Agreement. 7 C. Exercise any other remedies which may be available to it including an action for damages. D. Withhold the issuance of any or all building permits and/or prohibit the occupancy of all building(s) for which permits have been issued. E. In addition to the remedies and amounts payable as set forth herein, upon the occurrence of an event of default, the Developer shall pay to the City all fees and expenses, including reasonable attorney, engineering and consulting fees, incurred by the City as a result of the event of default, whether or not a lawsuit or other action is formally taken. The Tapestry Architectural Guidelines and Performance Standards will be enforced by the ACC throughout the completion of the project. At project completion, which means that all houses have been constructed, the ACC at Tapestry will be ongoing and enforced by the Tapestry Homeowners Association. Any builder who has been approved to participate in this project will be contractually required to submit their plans for approval to *c. In addition, landscape plans are required to be submitted to the ACC foithen-approval. Whatever the style or artistic interpretation of the home, all sides of the home's exterior must be consistently detailed. Site Planning It is encouraged that all homes at Tapestry face the, street. However, this doesn't necessarily mean that the home should be parallel to the street. In fact, it is encouraged that the home, if appropriate, be sited in such a way as to not create formal patterns when combined with other homes on the same street. "Tilting" the front house line slightly off a parallel street relationship will provide a more natural, informal pattern. Therefore, tender care must be taken to insure that the improved state of the land responds gracefully to its existing condition. The artistic blending of landscaped home -sites with natural open space will be controlled by the Architectural Control Committee (ACC). Architectural Control Committee Each homeowner must submit a landscape plan to the ACC for approval 60 days prior to the completion of their home. This plan must be professionally designed by a qualified landscape designer. Each submission must inelude scaled drawings of the entire property including the pre -defined "natural zones" if applicable (see "natural zones"). In addition, name of the landscape firm, designer, phone number, fax number, owner's name, site address, lot and block, and completion date must be included. The landscape plan must include a plant schedule listing sizes of each proposed plant all of which need to conform to the minimum requirements established by the ACC (see "landscape requirements"). It is encouraged that larger containers (# 5 or greater) are used to create greater initial impact. Retaining walls inust indicate type of material and include the top and bottom elevation of the proposed wall. It is important that the retaining wall does not significantly alter the flow of water as determined by the grading plan approved by the City of Lake Elmo. The bid proposal must also be included to insure that the budget meets or exceeds Tapestry's minimum budget parameters. Timing Landscaping of each home must be completed within one year after the completion of the home. Homeowners in breach of this condition will forfeit their entire landscape escrow. Budget Each homeowner will be required to invest a minimum of 2-3% of the home and lot package price. Which means that if the package price is $500,000, S10 - $15,000 must be spent on landscape. This total is for "green-scape" only which does not include retaining walls, patios, sidewalks, irrigation, etc. RECEivED fi11: g AP 4 Final December 2004 2 Escrow A down payment of $2,000.00 payable at the initial land closing will serve as the landscape escrow which will be returned to the land owner when the landscape has been successfully completed in substantial conformance with the submitted landscape plan. Lawn Zones Many home -sites within Tapestry will include boundaries between lawn zones and natural zones which will discourage large quantities of lawn. These areas will be defined in Tapestry's final landscape plan. Within the lawn zone will be an appropriate plant list that will be different in content to the plant list within the natural zones. Final plant species list will be included with the final landscape plan. The ACC will control conformance to these standards. Natural Zones Within many sites at Tapestry will be pre -defined "natural zones" that will require a specific landscape approach that is consistent with the existing natural landscape. The purpose of these zones is to limit the quantity of lawn, especially in the larger lots. This will reduce run-off and also help in creating a more natural landscape. Each homeowner will be required to submit a landscape plan to the ACC that includes these "natural zones' to insure that the design successfully demonstrates the intent of these areas. A plant material list for these natural zones will be included in the final landscape plan. The general location of these zones will also be defined in the final plan. Planting Materials The following list of planting materials is considered to be a minimum amount of plantings and sizes that will be accepted within each individual lot's lawn zone area. It is encouraged that these sizes will be increased, as much as possible, to provide greater initial impact. No plan shall have minimum sizes on all varieties and size variation must be blended proportionally at initial installation. Other mulch types may be acceptable as approved by the ACC. In no case shall any mulch touch any public use pedestrian trail or roadway. A "green" edge shall be maintained at all these paved surfaces. Rock mulch — rock mulch is acceptable for foundation plantings but it may not be used in planting beds outside or disconnected from the foundation area unless specifically approved by the ACC. Acceptable rock mulches include: 1 Y2" — 2 1/2" river rock, 'A" to 1 1/4" CA granite, 3/4" to 1 1/4" Trap rock. Other rock mulches may be acceptable so long as they are approved by the ACC. Wood Mulch — Wood mulch is acceptable mulch at all areas of landscape. Shredded hardwood, pine needle, and shredded cedar mulches are all acceptable but must be noted on the landscape plan and be consistent with the natural area that the home site is located within. Edging is required to be installed with rock mulches. It is not required with wood mulches. Acceptable edging types include; Cobra or Valley View vinyl edging, steel, brick and stone. Retaining Walls Retaining walls within Tapestry must be natural stone type. Window well areas where the wall faces the house and generally cannot be seen by public view can be manufactured block type such as Diamond Block or approved equal. Color selection should be as natural as possible. Raw concrete color will be discouraged unless it is consistent with the color palette of the home. Other retaining wall types such as a "tumbled" manufactured block may be accepted upon approval ofthe ACC. Final December 2004 4 Fencing Any type of fencing must be approved by the ACC. No chain link fence of any variety will be acceptable, All fencing must conform to the standards as described in the City of Lake Elmo's fencing regulations. Dog Kennels and Dog Runs Dog kennels and dog runs may be permitted so long as they are approved by the ACC, Careful planning must be done to ensure that the kennel and run blend seamlessly into the home's original architecture, In so much as possible, these structures must be hidden from public view. Pools and Hot Tubs Any pool, hot tub or spa proposed to be within Tapestry must be approved by the ACC. All design features must be included such as size, location, decking, and other features must be clearly communicated on the plan. No above ground pools are allowed. All spas must be designed so their impact on the public's view is minimized. Trampolines, Basketball Hoops, Play Courts, Play Sets, and Gazebos All permanent and temporary accessory items such as the above or other must be approved by the ACC. A site plan showing location and elevation is required for the submittal. Grading Plan The landscape contractor installing the approved landscape plan must ensure that after all landscaping has been completed the final grades meet the intent of the grading plan as approved by the City of Lake Elmo. Landscape "berms" are allowed so long as they work with the approved grading plan. Boulevard Tree Policy Tapestry will have a master landscape plan that will seek to enhance the overall beauty of the entire neighborhood. Included in this plan is the allocation of boulevard trees and tree groupings that will be installed in the public right-of-way, in open space areas, and, in some cases, on private property. These trees, to be installed by the developer, must be carefully protected at all times. The developer will continue to maintain these trees until the home site is sold. All home sites are sold "as is" in regard to these trees and the home owner must take into consideration that all trees are not created equal and adjacent lots can have similar trees of different health, vigor, shape, color, etc. The land purchaser Final December 2004 should take note of these differences when selecting their home site and choose accordingly. Once construction begins, the contractor will be responsible for any damage to any tree located in these areas and will be responsible for the condition of these trees until the owner takes possession of the home at which time the owner will be responsible to replace any tree that dies with a tree of equal size (at the time of original installation) and species. It is recommended by the developer that all trees be properly protected during the course of construction by fencing or other means. Boulevard trees may be moved with the approval of the ACC. Minor Subdivision and Final Plan Amendment— Fields II/Dupuis The Planner introduced an amendment to the Fields of St, Croix 2nd Addition OP Final Stage Plan and the concurrent application for a Minor Subdivision to create three new parcels. He reported that the applicants' plan is to take an existing 3.5 acre parcel adjoining Fields II and divide it into three lots, two of which would be added to the Fields of St. Croix 2nd Addition. The third parcel would quarter the homestead. He reported that Outlot N was created in the Fields II plat in anticipation of the addition of these parcels. The Planner reported that the existing parcel of 3.5 acres is already non -conforming in area in the Rural Residential District, and all three proposed new lots would be as well. Therefore, the applicants are proposing amending the Fields II OP Plan to include all three of the lots to accommodate the proposed lot areas. The Planner reported that the applicant's engineer to recalculate the open space preserved in the Fields If OP Plan with the three new lots. There was enough excess Open Space to allow the creation of these three additional residential lots. The Planner continued that utility connections would be to the constructed wetland and city water that serve the development. The applicant says there are two connections that were created at the time of the plat. According to the City Engineer, city plans only show one connection. He said that Staff also questions the decision of where the applicants put the dividing line between the two north lots, One lot is smaller than the lot size that was allowed to be created in the OP Ordinance that exists today. He said would like the applicants to adjust the dividing line to make the area of both lots equal, and compliant with the current OP minimum lot area of .75 acres. The Planner said he recommends approval of the OP Final Plan Amendment and Minor Subdivision with the conditions that the applicant modify the lot line between Parcels B and C to bring both lots into area conformance, and amend the Homeowner's Association Declaration of Covenants to include Parcels B and C. He noted that historically, when a home already exists on a site, the city does not require that parcel to be a party to the Declarations because of existing non -conforming conditions. Creation of these two new lots would be subject to $1500 Park Dedication Fee each. The city does not calculate park fees on existing parcels. One more pair of utility leads must be constructed at the expense of the developer, assuming those stubs are not there already. Commissioner Johnson asked if staff is aware of issues of easements on the two newly created parcels. The Planner said there were no recorded easements that he is aware of. Lake Elmo Planning Commission Meeting Minutes of October 25, 2004 AMENDED'oc'APPROVED: 11/08/04 3. At*War-Wg Zoning Code — Neighborhood Conservation District The Planner reminded the commission of a variance for a garage in the Old Village where the property owner had a very old garage on the property line and asked to replace it in the exact same place. The City Council denied the request as recommended by the Planning Commission. He reported that he understood that it was the desire of the Council for many years to address the Old Village issues of endless variances like this one; and that this was the initial charge to the Old Village Commission. The Planner reported that a section in the draft new zoning ordinance addresses these variations for proposed neighborhood conservation districts to preserve what already exists in neighbor -hoods of small lots. In that draft, a strategy is also addressed for conversion of non -conforming uses to 'conforming' by Special Use Permit. The Planner suggested that neither of those vehicles really gets to the issue before the City in the older neighborhoods. Proposed NR quantitative standards are not much different from what we already have in R-1 which is where the problems are in the older neighborhoods today. He noted that one earlier suggestion was to inventory existing properties in those neighborhoods and come up with a least common denominator for lot size and setbacks and other standards we might wish to address. He noted that there might be 1,000 such parcels in the Old Village and Tri-Lakes — a huge task. Structure setbacks would require a visit to each site. The Planner then suggested considering adopting some version of the 'urban lot' standards proposed by the draft zoning ordinance for new residential development adjacent to the Old Village. He noted that those standards pretty well reflect what already exists in the Old Village. The Planner said the City Council would like this issue addressed now. He asked for direction from the Planning Commission saying he could structure it into the current ordinance language. Commissioner Deziel said fire emergencies and drainage are also considerations. Commissioner Ptacek said that those urban lot standards could be a solution. It would be a good idea and may free up additional space for emergency vehicles by having an alley space behind. If we could make it work in Tri-Lakes too, it would be fine. Two structures on a zero lot line do not work though; allowing setback all on one side seems to be a good answer. Commissioner Deziel said those neighbors in the recent example had a good compromise if we could be flexible enough to allow it, spacing between garages was good. The Planner said that applying it in built up areas may not be as simple as it sounds. If the first guy in gets that lot line. Nuances like that will have to be addressed so not every one becomes a Special Use Permit (SUP), Commissioner Johnson said many lots have garages on the lot line. She would be worried about being sure they are not all strictly ordered that way. We cannot rubberstamp everything because there is so much variety. The Planner said that if this is better than an SUP, this is all the direction he will need to begin working on it. He noted that this would not do much for Shoreland areas. Lake Elmo Planning Commission Meeting Minutes of October 25, 2004 AMENDEU ex APPROVED: 11 /08/04 Bob Engstrom, Developer Mr. Engstrom stated that in the corner of Parcel C there are two large white oak trees which is why that lot was created slightly larger, explaining the location of that lot line, Commissioner Schneider asked about the park being created between Tana Ridge and Fields. Residents have asked him about that park and ballfield. Mr. Engstrom said he thinks the contractors are waiting for soccer posts that are supposed to be installed this fall. Chairman Helwig reminded the Commission of the issue of a variance granted to an individual who promised to save a tree but cut it down along with several others. He asked the developer what assurance the City can have that he will save these trees. The Planner said that we can add the condition that significant trees are identified and marked. That will, guarantee those trees will live through the development process at least, Commissioner Ptacek said he would like the lot that is below .75 acre size adjusted to equal .75 acres. Mr. Engstrom said his agreement with Ms. Dupuis is that the parent parcel would be exactly the size shown on the plan. He has no right to take more of the parent parcel. He reminded the commission that most of the Fields II lots are .5 acres. Commissioner Sedro said that mathematically, it appears there are an infinite number of places the lot line can be relocated. Mr. McAdam, Builder Mr. McAdam said he will be building a home on that lot, The more encroachment there is on those white oak trees, the less chance they have of surviving. Narrowing the parcel brings side yard setbacks into play. That would limit buildable area too. Chairman Helwig said we have ,75 acre lots in the Code now, so it would require a variance to do it the way the applicant presents it. It would not qualify for a hardship. Commissioner Deziel said that regardless of what we recommend, the Council can approve it with a 4/5 vote anyway. The Planner agreed that the applicant would not need a hardship for a 4/5 OP variance and that Commissioner Deziel's suggestion is probably valid. The OP Development Stage Plan had been approved in September, 1999; and, the overall OP Concept Plan for the entire Fields neighborhood had been approved several years earlier. Outlot N of the Fields II plat was designed to facilitate additional lot(s) at the end of Lily Avenue at such time as the owners of the "Exception" parcel south of Outlot N was ready to divide their parcel. Discussion and Analysis: The owner of the Exception Parcel referred to above (Dupuis) has now joined with Engstrom in an application to amend the Fields II Plan for inclusion of the 3.5 acre Dupuis parcel, and the creation of three lots. One lot of 2.4 acres would continue to contain the Dupuis homestead, and access via the existing driveway south to State Highway 5; and, two new lots (0.70 and 0.80 acres, respectively) would be added to the south end of Lily Avenue (and include the fractional portions of current Outlot N; and, the portion of Fields Outlot H that functions as the driveway) — accessing directly to Lily Avenue. One water and sewer service stub was installed at the end of Lily Avenue with the other Fields II public infrastructure work in 2000 in anticipation of the future inclusion of the Dupuis parcel into the OP neighborhood. The process by which the proposed actions have been applied for is somewhat unusual — as are the circumstances leading to the applications. Staff does not recall an similar action in the past — expansion of an OP neighborhood. We have decided to process this request as both an Amendment to the Fields II OP Final Plan (but not to the Final Plat); and, as a Minor Subdivision. The Minor Subdivision strategy is far less complex that amending a Final Plat; and, is allowable by the City Code where no Public streets are required to be dedicated and no more than 4 new parcels created. Legally (per Code) the Planning Commission is not involved in the review of OP Final Plans, but we have expanded that review in this case due to the coordination required to accomplish the Minor Subdivision — which the Planning Commission does review, and provide a recommendation regarding. In addition to the unusual aspects of the application processing strategy staff has reviewed the technical compliance issues of the proposal vis-a-vis the OP lot standards. We observe as follows: I. The addition of new lots to the Fields II OP alters the mandatory Preserved Open Space calculations for the overall OP, Preserved Open space for Fields II was previously calculated in concert with the Fields I and Bluestem neighborhoods — all part of the original Concept Plan. Staff has requested the applicants' surveyor to recalculate the Preserved Open Space for the overall Fields project to determine the additional requirement that results from adding 3.5 gross acres (Dupuis Parcel). That calculation has been provided, and staff is satisfied that sufficient excess Preserved Open Space had been created previously to accommodate 3.5 acres additional gross project area. 2. The westerly of the two new lots proposed to be created is 0.70 acres in area. While the OP minimum lot area standard was 0.50 acres when the Fields OP was originally approved, that standard is 0.75 acres today. The applicants should either alter the proposed property line between the new lots so as to create .75 acres area for each (enough gross area exists to do so); or, seek a 4/5 OP variance from the City Council. Note that the present OP standards do not specify a minimum lot width or minimum public street frontage. The purpose of the proposal is to realize the approximate 30% gain in the number of available parking spaces along any given length of street frontage. Due to the narrow cross section and location of the paved portion of Upper 33, the Bush firm proposes that about 40% of the parking stall depth encroach on its private property, with the balance within the City street right-of-way. Bush has also requested a similar arrangement along its Lake Elmo Avenue frontage. That request is now being considered by Washington County in that Lake Elmo Avenue is CSAH -#1 7. I am writing to seek approval to convert the south border of this property into an angle in parking zone. I have attached a copy of the proposed arrangement. Today we completed removal of the existing bus shelter, removal of 6" of topsoil, and installation of 6" of class 5 aggregate along the proposed parking area. It is our intention to designate three of the five slots for tenant use at this property. The remaining two slots will be available for general use. As originally proposed, the parking area will begin 30 feet from the comer of Lake Elmo Avenue and Upper 33rd Street and continue east to the property driveway. We request City of Lake Elmo approval to designate this as a legal parking area along Upper 33"t Street. This will help ease some of the parking congestion that is prevalent in this area of the city. Agenda Item: Met Council Discussion/Negotiations Background Information: Over the last several months the city has been negotiating with the leadership of Met Council subsequent to the Supreme Court ruling and supportive meetings with the Governor, Up until about a week and a half ago progress toward concluding the negotiation process was progressing. It is my belief that further negotiations will not proceed without a new affirmation of the "official negotiating team for Lake Elmo" as the recent election may have influenced their (Met's) participation in concluding negotiations with the current team at this time. Action Items: A motion establishing the official negotiation team to continue and conclude the negotiations with Met Council and officially notify Chair Bell and Administrator Weaver of Council action.
