PRESENT: Mayor Mike Pearson and Councilmembers Justin Bloyer, Dale Dorschner, Lisa McGinn and Christine Nelson Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Planning Director Roberts, Planner Prchal, Public Works Director Powers and City Clerk Johnson APPROVAL OF AGENDA Item 8, "Approve Appointment of Interim Fire Chief' and item 11, "Approve RFP for Achitectural/Engineering Services for Public Facilities" were moved to the Regular Agenda. Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE THE AGENDA AS AMENDED. Motion passed 5 — 0. ACCEPT MINUTES Minutes of the January 7, 2020 Regular Meeting were accepted as presented. PUBLIC COMMENTS/INQUIRIES Susan Dunn, 11018 Upper 33`d Street, thanked Sergeant Osterman for his work in the City and welcomed new Sergeant Harris; expressed concern regarding Sunfish Lake Park and suggested updates to cities on impaired water. Accept Contractor Bids and Award Contract for Production Well #5 — Resolution 2020-011 Councilmember Dorschner, seconded by Councilmember Bloyer, moved TO APPROVE THE CONSENTAGENDAASPRESENTED. Motion passed 5 - 0. ITEM 14: Four Corners Development Administrator Handt provided a status update, noting that the City has not received needed items from the developer. Discussion was held regarding easements and options for moving forward. ITEM 15: Conditional Use Permit Amendment — Stillwater School Bus Facility Mayor Pearson, seconded by Councilmember Dorschner, moved TO ADOPT RESOL UTION 2020-004 DENYING THE STILL WATER SCHOOL DISTRICT'S REQUEST TO AMEND CONDITION 9 OF THEIR EXISTING CONDITIONAL USE PERMIT FOR THE PROPERTYAT 11530 HUDSONBOULEVARD. Motion passed 5 — 0. ITEM 16: Four Corners 2"d Addition Final Plat Time Extension Councilmember Nelson, seconded by Mayor Pearson, moved TO DENY THE TIME EXTENSIONREQUEST FOR THE FOUR CORNERS 2N'D ADDITION FINAL PLAT. Motion passed 5 — 0. ITEM 17: Variances to Build a Single Family Home on Vacant Lot (8340 Stillwater Blvd.) City Planner Prchal reviewed the request for variance and zoning amendment to allow construction of a new single family home. Councilmember Bloyer, seconded by Councilmember McGinn, moved TO ADOPT RESOLUTION 2020-007APPROVING A VARIANCE TO ALLOW THE PROPERTY IDENTIFIED AS 8340 STILLWATER BOULEVARD TO BE CONSIDERED A BUILDABLE LOTAND TOALLOWA SINGLE FAMILYHOME TO BE BUILT. Motion passed 5 — 0. Councilmember Bloyer, seconded by Mayor Pearson, moved TO APPROVE ORDINANCE 08-233 WHICHREZONES PARCEL 16.029.21.34.0015 FROMRE TO RS. Motion passed 5 —0. ITEM 18: Variance for Location of Pole Building (10092 Stillwater Lane) City Planner Prchal presented the request for a variance to allow construction of a pole building that would be closer to the front lot line than the home. Page 2 of 4 LAKE ELMO CITY COUNCIL MINUTES JANUARY 21, 2020 Councilmember Dorschner, seconded by Councilmember Nelson, moved TO APPROVE A VARIANCE REQUEST FOR THE LOCATION OFANACCESSORYBUILDING FOR THE PROPERTYAT 10092 STILL WATER LANE. Motion passed 5 — 0. ITEM 19: Comprehensive Plan Amendments — Heritage Farms Sanitary Sewer System Planning Director Roberts reviewed proposed amendments to the City's Comprehensive Plan to add the area planned for extension of city sewer to the MUSA. Councilmember Nelson, seconded by Councilmember Dorschner, moved TO ADOPT RESOL UTION 2020 — 009 APPROVING ALL NECESSARYAMENDMENTS TO THE 2040 LAKE ELMO COMPREHENSIVE PLAN (INCLUDING THOSE TO THE LAND USE PLANAND TO WASTEWATER SERVICES PLAN) TO ADD THE EXISTING 44 SINGLE- FAMILY PROPERTIES IN THE HERITAGE FARMS SUBDIVISION TO THE CITY'S SANITARY SEWER AREA. Motion passed 5 — 0. Councilmember Nelson, seconded by Councilmember Dorschner, moved TO ADOPT RESOLUTION 2020 — 010 APPROVING A COMPREHENSIVE PLANAMENDMENT RE - GUIDING ON THE CITY'S LAND USE PLAN THE EXISTING SINGLE-FAMILY HOMES IN THE HERITAGE FARMS SUBDIVISION FROM RAD (RURAL AREA DEVELOPMENT) TO RSFS (RURAL SINGLE FAMILY SEWERED) AND AUTHORIZE CITYSTAFF TO SUBMIT THE PROPOSED AMENDMENTS TO THE METROPOLITAN COUNCIL FOR REVIEW. Motion passed 5 — 0. ITEM 20: Authorize Sewer Inspection Services for the Hamlet on Sunfish Lake Sanitary Sewer System. City Engineer Griffin reviewed the proposed cleaning and inspection services to evaluate the system prior to the City taking over ownership of the system. Tim Narum, 3960 Kindred Way, questioned the timing of this project and requested a project plan. Councilmember Moyer, seconded by Councilmember McGinn, MOVED TO APPROVE SANITARY SEWER CLEANING AND INSPECTION SERVICES BYEMPIRE PIPE SERVICESAND HYPERION CONSULTING FOR THE HAMLET ONSUNFISHLAKE HOA SEWER IN THE NOT TO EXCEED AMOUNT OF $20, 000. Motion passed 5 — 0. ITEM 11: Approve RFP for Architectural/Enaineering Services for Public Facilities Administrator Handt provided an overview of the proposed RFP. Discussion was held regarding location of future City facilities and the Fire Department audit. Motion passed 5 — 0. ITEM 8: Approve Appointment of Interim Fire Chief Administrator Handt reported on a potential timeline for hiring a Fire Chief and noted that MNSPECT is on call to assist with inspections as needed. Mayor Pearson, seconded by Councilmember McGinn, moved TO APPOINT MIKE CORNELL AS INTERIM FIRE CHIEF. Motion passed 4 —1. STAFF REPORTS AND ANNOUNCEMENTS Administrator Handt: Announced a special meeting of the City Council on February 4"' at 6:00 p.m. for Planning Commission applicant interviews. Planning Director Roberts: Announced a meeting of the Joint Airport Commission on January 23`d at Oak Land Jr. High. City Engineer Griffin: Announced an upcoming meeting with the Heritage Farms neighborhood. Meeting adjourned at 8:25 pm.
