CITY COUNCIL MINUTES
APRIL 7, 2020
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Pearson called the meeting to order at 7.00 pm.
PRESENT: Mayor Mike Pearson and Councilmember Justin Bloyer. Participating via
teleconference: Councilmembers Dale Dorschner, Lisa McGinn and Christine Nelson
Staff present: City Attorney Sonsalla, Assistant Administrator Dickson and City Clerk Johnson.
Participating via teleconference: City Administrator Handt and Planning Director Roberts.
APPROVAL OF AGENDA
Mayor Pearson, seconded by Councilmember Nelson, moved TO APPROVE THE AGENDA
AS PRESENTED. Motion passed 3 — 0. (Councilmembers Dorschner and McGinn were not
connected to the meeting at this time)
ACCEPT MINUTES
Minutes of the March 17, 2020 Regular Meeting were accepted as presented.

ITEM 9: DECLARING AND EXTENDING A PERIOD OF A LOCAL EMERGENCY
City Attorney Sonsalla reviewed options for declaring a location emergency and the authority it
give the City to conduct business without time consuming procedures normally required.
Councilmember Bloyer, seconded by Councilmember Nelson, moved TO ADOPT
RESOLUTION 2020-033 DECLARING A LOCAL EMERGENCY WITHA SUNSELT
CLAUSE TO END THE DECLARATIONAFTER THE FIRST MEETING INMAY.
Motion failed 3 — 2. (Dorschner, Pearson — nay)
ITEM 10: APPLEWOOD POINTE OF LAKE ELMO
Planning Director Roberts presented the request for a Comprehensive Plan amendment, Zoning
Map amendment and Preliminary Plat and PUD for the construction of a multi -story senior living
building in the Eagle Point Business Park. Alex Hall, United Properties, spoke on behalf of the
applicant and reviewed their position that this is the best use of the property.
Mayor Pearson, seconded by Councilmember McGinn, moved TO ADOPT RESOLUTION
2020 —013 APPR 0 VING AN AMENDMENT TO THE LAND USE PLAN IN THE
COMPREHENSIVE PLAN FOR THE SITE OF THE APPLEWOOD POINTE OF LAKE
ELMO ON THE CORNER OF HUDSON BOULEVARD AND EAGLE POINT
BOULEVARD. THIS LAND USE PLAN CHANGE WOULD BE FROMBP (BUSINESS
PARK) TO MU -BP (MIXED USE BUSINESS PARK), IS BASED ON THE FINDINGS
LISTED IN THE STAFF REPORT AND IS SUBJECT TO THE CONDITIONLISTED IN
THE STAFF REPORT. Motion passed 4 —1. (Dorschner — nay)
Mayor Pearson, seconded by Councilmember McGinn, moved TO ADOPT ORDINANCE
NUMBER 08-08-234 APPROVING THE REZONING OF SITE OF THE APPLEWOOD
POINTE OF LAKE ELMO ON THE CORNER OF HUDSONBOULEVARD AND EAGLE
POINT BOULEVARD FROMBP (BUSINESS PARK) TO MU -BP (MIXED USE
BUSINESS PARK). THIS APPROVAL IS SUBJECT TO THE CITYAMENDING THE
COMPREHENSIVE PLANLAND USE DESIGNATION FOR THIS SITE TO MU-BPAND
IS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT. Motion passed 3 - 2.

2 02 0 — 014 APPROVING THE PRELIMINAR Y PUD PLANAND PRELIMINAR Y PLA T AS
REQUESTED BY JENNIFER MASON (OF UNITED PROPERTIES) FOR PID#
33.029.21.44.0009 FOR THE PROJECT TO BE KNOWN AS APPLEWOOD POINTE
SENIOR LIVING TO BE LOCATED ON THE CORNER OF EAGLE POINT BOULEVARD
AND HUDSON BOULEVARD. THIS APPROVAL ALSO AMENDS THE EAGLE POINTE
BUSINESS PARK PUD TO ALLOW THIS RESIDENTIAL USE AND IS SUBJECT TO
RECOMMENDED CONDITIONS OFAPPROVAL AS OUTLINED IN THE STAFF
REPORT. Motion passed 3 — 2. (Bloyer, Dorschner - nay)

ITEM 11: LEGACY AT NORTH STAR THIRD ADDITION
Planning Director Roberts reviewed the request for approval of easement vacations and the final
PUD plans for 64 single family detached home lots.
Councilmember Bloyer, seconded by Mayor Pearson, moved TO ADOPT RESOLUTION
2020-034 APPROVING THE LEGACYAT NORTH STAR THIRD ADDITION FINAL
PLAT AND FINAL PUD PLANS AS RECOMMENDED BY THE PLANNING
COMMISSION WITH THE RECOMMENDED FINDINGS AND CONDITIONS OF
APPROVAL AS LISTED IN THE STAFFREPORT. Motion passed 5-0.
Councilmember Bloyer, seconded by Mayor Pearson, MOVED TO ADOPT RESOLUTION
2020 — 035 APPROVING THE REQUESTED VACATION OF THE DRAINAGE AND
UTILITYEASEMENTS ON OUTLOT B OF LEGACYNORTHSTAR FIRST ADDITION
FOR THE PURPOSES OF FINAL PLATTING THE LEGACYAT NORTH STAR THIRD
ADDITION WITH THE FINDINGSAND CONDITIONS OFAPPROVAL AS LISTED IN
THE STAFF REPORT. Motion passed 5-0.
ITEM 12: LEGACY AT NORTH STAR THIRD ADDITION DEVELOPMENT
AGREEMENT
Planning Director Roberts noted that execution of a Development Agreement is a condition of
final plat approval.
Mayor Pearson, seconded by Councilmember Bloyer, moved TO ADOPT RESOLUTION 2020
- 036 APPROVING THE DEVELOPMENT AGREEMENT FOR LEGACYAT NORTH
STAR THIRD ADDITION FINAL PLAT. Motion passed 5 — 0.
ITEM 13: DEPARTMENT HEAD RECRUITMENTS
Assistant Administrator Dickson presented proposals for hiring a recruitment firm to fill
vacancies in the Fire Chief, Finance Director and Building Official positions.
Mayor Pearson, seconded by Councilmember Dorschner, moved TO HIRE BAKER TILL
FOR THE EXECUTIVE RECRUITMENT OF THREE DEPARTMENT HEAD
POSITIONS. Motion passed 5 — 0.
COUNCIL REPORTS
Mayor Pearson: Commended the Lake Elmo Fire Department for their efforts during the current
pandemic.
Councilmember Bloyer: Thanked City staff, Fire Department and the Sheriffs Deputies.
Councilmember Dorschner: Thanked staff and emergency personnel.
Councilmember McGinn: Thanked public safety staff.

Councilmember Nelson: Thanked staff for their extra work during the pandemic and
congratulated Lake Elmo resident Rachel Steil for being a top ten finalist for Minnesota Teacher
for the Year.
