CITY COUNCIL MINUTES
DULY 7, 2020
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Pearson called the meeting to order at 7:00 pm.
PRESENT: Mayor Mike Pearson and Councilmembers Justin Bloyer (arrived at 8:02 p. m.), Dale
Dorschner, Lisa McGinn and Christine Nelson
Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Planning
Director Roberts, Acting Fire Chief Cornell and City Clerk Johnson
APPROVAL OF AGENDA
Councilmember Dorschner, seconded by Councilmember McGinn, moved TO ADD "NO
WAKE ONLAKE ELMO" TO THE END OF THE AGENDA. Motion passed 3 —1. (Pearson
— nay)
Item 7, "Approve Property Maintenance Code Update" was moved to the end of the Regular
Agenda.
Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE THE
AGENDA AS AMENDED. Motion passed 4 — 0.
ACCEPT MINUTES
Minutes of the June 16, 2020 Regular Meeting were accepted as presented.

Councilmember Nelson, seconded by Councilmember Dorschner, moved TO APPROVE THE
CONSENTAGENDAASPRESENTED. Motion passed 4 - 0.
ITEM 12: Zonine Code Text Amendment — Farm Schools as an Accessory Use in the Rural
Districts
Planning Director Roberts provided an overview of the request and suggested that the Council
consider a nine acre minimum due to the scarcity of lots over ten acres.
Councilmember Nelson, seconded by Councilmember McGinn, moved TO APPROVE
ORDINANCE 08-238 AMENDING THE CITY ZONING CODE TO ALLOW THE
INCORPORA TION OF SCHOOLS AS AN ALLO WED USE IN THE RURAL ZONING
DISTRICTS.
Councilmember McGinn, seconded by Mayor Pearson, moved TO AMEND THE PRIMARY
MOTION TO ADD % MILE SEPA RA TION BETWEEN FARM SCHOOLS AND ARM
SCHOOL LANGUAGE IN THE ORDINANCE. Motion passed 4- 0.

2020-058 AUTHORIZING SUMMARYPUBLICAITON OF ORDINANCE 08-238. Motion
passed 4 — 0.
ITEM 13: Accept Bids & Award Contract for Hamlet on Sunfish Lake Sanitary Sewer
Extension
City Engineer Griffin reviewed bids received and estimated assessment amounts.

Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE
RESOLUTIONNO. 2020-070, ACCEPTING BIDSAND AWARDINGA CONTRACT TO A-
I EXCAVATING, INC. IN THE BASE BID AMOUNT OF $167,247.00 FOR THE HAMLET
ON SUNFISHLAKE SANITARYSEWER EXTENSION. Motion passed 4 — 0.
ITEM 14: Bruggeman Open Space PUD Concept Plan Review (2500 Manning Avenue
North
Planning Director Roberts reviewed the proposal for an open space development of 14 single
family home lots. Tim Freeman of Folz Freeman Surveying spoke on behalf of the applicant and
requested several changes to the proposed conditions of approval.
Council directed staff to revise the proposed resolution and bring the item back for consideration
at the next Council meeting.
ITEM 15: No Wake on Lake Elmo
Councilmember Dorschner explained the current conditions on Lake Elmo due to high water
levels and property damage done boat wakes during high water conditions. Councilmember
Dorschner proposed a resolution imposing a no wake rule on Lake Elmo.
Councilmember Bloyer, seconded by Councilmember Nelson, moved TO DENY THE
PROPOSED NO WAKE RESOLUTION. Motion passed 3 — 2. (Dorschner, McGinn —nay)
ITEM 7: Approve Property Maintenance Code Update
Discussion held regarding the proposed update. Councilmembers requested further staff review
to ensure the language is clear and enforceable.
COUNCIL REPORTS
Mayor Pearson: Received many calls regarding water issues.
Councilmember Bloyer: Thanked sheriff and fire department staff for participating in a recent
community event.
Councilmember Dorschner: Reported on the 41h of July parade and calls received regarding
flooding.
Councilmember McGinn: Reported on progress of the Kwik Trip under construction at Inwood
Avenue & 10"' Street.

STAFF REPORTS AND ANNOUNCEMENTS
Administrator Handt: reported on status of COVIDI9 funds from the state, ground breaking at
Arbor Glen Independent Living.
City Clerk Johnson: reported on preparation for the upcoming Primary Election.
Meeting adjourned at 10:37 pm.
