HomeMy WebLinkAbout#09 - Hamlet on Sunfish Lake Street and Utilities STAFF REPORT DATE: March 16, 2021 CONSENT AGENDA ITEM: Accept Bids and Award Contract for the Hamlet on Sunfish Lake Street and Utility Improvements SUBMITTED BY: Jack Griffin, City Engineer REVIEWED BY: Kristina Handt, City Administrator Marty Powers, Public Works Director Chad Isakson, Assistant City Engineer ISSUE BEFORE COUNCIL: Should the City Council accept bids and award a contract for the Hamlet on Sunfish Lake Street and Utility Improvements? BACKGROUND: On January 19, 2021, the City Council approved the plans and specifications for the Hamlet on Sunfish Lake Street and Utility Improvements and authorized staff to advertise the project for bids. The Project was advertised on QuestCDN.com and in the Stillwater Gazette in accordance with the Minnesota Competitive Bidding requirements. The City of Lake Elmo was approved to receive grant funding from the Minnesota Pollution Control Agency (MPCA) under the 2018 3M Settlement Agreement as an expedited project to extend municipal water and connect each of the 41 homes. The grant is in the not to exceed amount of $2,712,200 and includes the public and private water system improvements, and the street and drainage improvements. The terms of the grant are outlined in the Grant Agreement between the City of Lake Elmo and the MPCA dated February 4, 2020. The neighborhood is located in a Special Well Construction Area (SWCA) as designated by the Minnesota Department of Health (MDH) after the discovery of PFAS groundwater contamination and many of the properties have received well advisories from the MDH and are currently having their water supply treated using GAC filters supplied by the State. The project will extend the public watermain from the existing trunk main at the neighborhood entrance at Kimbro Avenue and 43rd Street, extend into the subdivision along the Kindred Way and Kindred Court right-of-way, and provide a watermain stub for future connection to the adjacent Legacy of North Star development to make a looped watermain connection. Individual water service stubs will be installed to the edge of right-of-way at each of the 41 residential properties. The project will include grant funding and administrative processes for ensuring each property completes the private service connection from the right-of-way to each home, including water meter installation, removal of granular activated carbon treatment systems (if applicable), sealing of any private well, and all permitting and connection fees. The private water connection and well sealing improvements will be contracted separately by each property owner. Sanitary sewer repair and replacement work has also been incorporated into the project prior to reconstructing the public streets. Sewer repair and replacement work was identified to be completed after cleaning and televising the full length of the existing HOA owned and operated sanitary sewer system in anticipation of the city assuming ownership and maintenance. Following the watermain installation and sanitary sewer work, the public streets will be reconstructed together with the installation of drain tile and concrete curb and gutter. PROPOSAL DETAILS/ANALYSIS: Bids were received, publicly opened, and read aloud on Wednesday, February 24, 2021. The City received 5 bids for this project, with A-1 Excavating, Inc. providing the lowest bid in the amount of $2,876,408.00. Contractor references for A-1 Excavating, Inc. were reviewed and verified. The City Engineer and his consultant are therefore recommending that the Council award the contract to the lowest responsible bidder, A-1 Excavating, Inc. as outlined in the attached letter. As a part of this award staff is requesting Council to provide the City Administrator authorization to enter into a material testing contract for the construction geotechnical work in the not-to-exceed amount of $40,000. This amount has been budgeted in the total cost figures presented below and is necessary to complete the project. Staff has requested proposals from Braun Intertec and AET, Inc. FISCAL IMPACT: Approval of this resolution commits the council to enter into a construction contract for the project. The total estimated Post-bid project cost is $4,057,100. This includes $908,500 for the public watermain improvements, $800,000 for the sanitary sewer repair and replacement, $1,814,000 for the street and drainage improvements, and $534,600 for the private water service connections/well sealing improvements. All improvements, except for the sanitary sewer repair and replacement work, will be funded through a grant from the MPCA under the 2018 3M Settlement Agreement as an expedited project. The sanitary sewer repair and replacement work is being funded through assessments to the 41 properties in the Hamlet on Sunfish Lake subdivision consistent with the City’s Special Assessment Policy, with oversizing costs to extend 10-inch trunk sewer being paid through the Sewer Enterprise Fund. The City has on hand signed waiver of assessment agreements from all 41 properties in an amount sufficient to cover the assessable sanitary sewer costs. RECOMMENDATION: Staff is recommending that the City Council approve, as part of the consent agenda, a resolution accepting bids and awarding a contract to A-1 Excavating, Inc. in the amount of $2,876,408.00 for the Hamlet on Sunfish Lake Street and Utility Improvements. If removed from the consent agenda, the recommended motion for this action is as follows: “Move to approve Resolution No. 2021–028, accepting bids and awarding a contract to A-1 Excavating, Inc. in the amount of $2,876,408.00 for the Hamlet on Sunfish Lake Street and Utility Improvements.” Staff is also recommending that the City Council authorize, as part of the consent agenda, the City Administrator to enter into a material testing contract for the project construction services, in the not-to-exceed amount of $40,000. If removed from the consent agenda, the recommended motion for this action is as follows: “Move to authorize the City Administrator to enter into a material testing contract for project construction services in the not-to-exceed amount of $40,000 for the Hamlet on Sunfish Lake Street and Utility Improvements.” ATTACHMENTS: 1.
