M/S/P Johnson/DeLapp, To adopt Ordinance No. 97-146, an ordinance amending Section 1355.07 Public Park Hours of the Lake Elmo Municipal Code. Administrator Rafferty said having the provision in the code does not mean a permit is granted. Safety and other considerations will be considered. (Motion passed 4:0:1 Abstain: Conlin) 8. CITY ENGINEER'S REPORT: A. Prouosed Public Works Garage: Terri Olsen, TKDA Administrator Rafferty said the city has been planning municipal.fac lities over many months. Terri Olsen said they have separated Public Works from City Hallall`:wing for an agrarian setting to blend with a rural location. If bids are low enoughthere are ad:on amenities. Administrator Rafferty said this facility is programmed within budget constraints, with input of Public Works Committee and MAC. The cost of $2. hMillion isyell within target for this facility meeting all interests identified. Mayor Johnston;!. vas su prised they call it rural character. Councilmember Smith asked how much of the cost is in tl e<ppearance. Ms. Olsen will find out. They began with a base building with a flat ro f stick built and;changed to a pre-engineered building and different roof. The council decidedto'r the next agenda item and this one collectively. B. Change to Water Tower::. The City Engineer said the wate ' ystem p <is to connect the Old Village with Lake Jane moving the water tower to the new<Public Works wilding site. Higher elevation of 20-30 feet saves some money. A second:ater' main will be needed between Highway 5 and Tapestry. It will cost $200,000 more; bymovi g it. T`.here are practicalities to having it on the same site. Administrator Rafferty said we would spend that $200,000 later anyway. The Finance Director said the WAC charges:; should support this project. Councilmember DeLapp said he thought we would have an image of 'arm anda silo. The City Engineer said it will take one year to build and will not be operationaluritil_2006. Administrator Rafferty said there is a June construction date. Eagle Point Business Park: Resolution No. 2005-012 Approving the Preliminary Plat and Final Plat of Eagle Point 4th Addition, Resolution No. 2005-013:Denying the PUD Plan Amendment, Resolution No. 2005-014; Approving the Section 520 Site Plan for City and County Credit Union The Planner said the application from United Properties was unanimously recommended by the Planning Commission. The PUD item of issue was the request to substitute asphalt shingles for the code requirement for roofing. The Planning Commission voted 5-2-1 to deny the PUD amendment to allow asphalt shingles.. Item 9A includes a communication from a tenant in Eagle Point with reference to glare from the standing seam metal roofs. Councilmember Smith said the site plan asks us to approve 10,000 square feet, and only six thousand square feet of building are to be constructed, per the applicant. The Planner responded that the site plan presented is for the entire 10,000 square feet, with site area, parking and all site features sized for the 10,000 square feet. The site plan also shows the entire 10,000 square foot building footprint. On that basis the staff and Planning Commission has determined that the 10,000 square foot standard is complied with. The Planner asked the City Attorney if it is okay to put and take uses__when it is in the PUD. The City Attorney said the council has latitude with PUD's because they: are designed to give more than what you get from normal zoning. He also said that if there is` variation from 10,000 square feet building requirements, Council has the right to reject a 6,000 square feet building. Dale Glowa of United Properties introduced Pat Pierce,i president of City and,County Credit Union, Steve Dowdy the architect, and George Burkat`ct_ :;Mr;lowa said Eagle Point Business Park was a thoughtful PUD they spent months developing with the City Council in 1999 The Credit Union building site plan is sized to accommodate 100.00; square feet. He noted that specifications regarding roof materials were silent when_:this PUD was approved, now they are requesting the PUD to be amended for additional roofing material, to include a timberline asphalt roof. He advised the Council that metal a .d cedar _ re'loud in a rainstorm, with ice concern sliding off as well. The glare is another concern. Asphalt won't do that. The Planner said we have until March 7 to decide. Steve Dowdy with Pope Associates sacl.,his company has been asked to redesign drive -up canopies with metal roof 'seveM;t mes, because of sound and ice problems. George Burkards said`<noted Properties has spent $4,000,000 in the park. Signs, monuments, and bridges were create = or appearance. He said the quality of all of the buildings are good. Councilmember DeLapp saidpereptions of architecture in this part of Lake Elmo are not good. M/S/P Johnson/Conlin to table the United Properties applications until the next meeting. Pat Pierce of City and County Credit Union said part of the plan includes a conference room to use by the community at no cost. They are trying to be a good neighbor. (Motion passed 4-1 Johnston- Thinks they should have approved it.) B. Trails Plan Open House The Planner said an Open House was not anticipated in the contract. Councilmember DeLapp said he believes it is important to involve the public, and he therefore supports the Letter of Agreement to cover the added costs for the Open House. M/S/P DeLapp/ Johnson to direct staff to sign the Letter of Agreement and to approve the additional expenditure of $1,448 to cover the additional cost associated with the City's contractual agreement for a Trails System Plan ($240) and the cost for support and materials for the Trails Plan Open House ($1,208). (Motion passed 5-0). 10. CITY ATTORNEY'S REPORT: 13. CITY ADMINISTRATOR'S REPORT: A. Ordinance 97-147: Planning Commission Composition. Appointments Administrator Rafferty said terms for both commission should be the same so they should be considered together. B. Ordinance 97-148: Parks Commission Composition Mayor Johnston said it was not his intention to have term limits. His idea was only to review commissions after two terms. Councilmember DeLapp agreed -if a commissioner is here for nine years, we almost have to change the rules to keep them. M/S/P, Smith/DeLapp to send composition for both Planning and- P r s: Commissions back to council committee for further discussion. (Motion passed 5.-0)' Todd Ptacek said two commissioners were appointed fnr>sixty days. Mayor`Johnston said the time limit will not expire. He said it is a process issuetst, and then they will address appointments. C. CIC Appointment Administrator Rafferty said an application was received_ frorBrenda Anderson. M/S/P DeLapp /Smith To appoint.Brenda`1 . derson__as a member of the Community Improvement Commission. (Moion passe D. Met Counci_l:Proposed> greement Administrator Rafferty introduced the agreement's achievement versus the Met Council Resolution 2002-30..:The Planner `explained where we stand today before we affirm the agreement with the 1VIeCouncil. A'lst of modifications for our Comp Plan was attached to Res. 2002-30. The most impaant element of this agreement is a credit for existing Cimarron and Old Village housing and for`he:p1nned Old Village expansion. Old Village streets and water mains can be upgraded simultaneously with sanitary sewer construction. A second key element is that the city can continue with clustering north of 10th Street. The majority of the city will be allowed to maintain its rural character. 3' key element is that the Lake Elmo Interceptor has been dropped. Instead there will be two sanitary one from the west and one from Cottage Grove in the south. The City will have the optionto use the additional units for redevelopment, environmental issues, or other uses after 2030. Population planned was about 13,000 people at buildout. This plan is 24,000 capped. These are the issues and numbers we have to show in our Comprehensive Plan. Former Mayor Lee Hunt said he is convinced this is the best the city can do. It is consistent with the first meeting with the governor, and he urged approval. Administrator Rafferty introduced the ten point agreement and the process for approval. Mayor Johnston said this is a better plan than what was originally proposed. It is not negotiable, and he urged approval. Councilmember DeLapp said transfer of density might help to facilitate development below 10th Street. M/S/P, Johnson/DeLapp, To approve Resolution 2005-015. Ben Roth asked for clarification because he does not think the agreement requires that much density below 10th Street. Mayor Johnston said the average of 3 units per acre is in the agreement. Todd Ptacek asked if it is the council's intention to average those units and lower density to buffer existing neighborhoods. Mayor Johnston said that is his intention. The Planner said units per acre or open space can be used to achieve that end. Councilmember Conlin said this has been an open process, and it is _probably the best settlement we are going to get. She will support it. Councilmember DeLapp"supports it as he interprets it, though it was not an open process. He said he will not vote. for it unless''the language is changed to protect existing residents. Councilmember Johnson said:both negotiating teams got us the best we can expect. Former Mayor Hunt said this agreement has all of the corn within the ranges the city council came up with. It is not great but it is reasonable. The City Attorney said amending a Comprehensive Plan ,Ott the first phase of legislative effort to adopt official controls. Substantial changes will have to be made to those controls and regulations. Direct the planning cpnitnission as yot will. DeLapp if we agree it will hae the>`dleastinpactaast comp plan it does not have to be inserted. Smith agrees. Conlin saidnow_,is no time. (Motion passed 4-1eLapp — A ementcan be modified, there is ambiguity among the council.) 12. CITY COUNCIL'I.FOItTS: Administrator Rafferty askedTht a joint workshop on 2/7/05 with the Planning Commission. Mayor Johnston said the council might need a workshop first. The council decided to meet from 6 to 8 and then join the Planning Commission at 8:00 p.m. Councilmember Johnson congratulated John Schiltz of Lake Elmo Inn for being named one of the top ten chefs in the metropolitan area. Councilmembers Smith and Councilmember Johnson attended the basic conference for newly elected officials, it was a good orientation, and they would like to avail themselves of all opportunities to get up to speed. An Employee Owned Company Promoting Affirmative Action and Equal Opportunity Lake Elmo City Council 02-15-2005 Agenda Section: FINANCE Agenda Item: Monthly Operating Report Background Information for February 15, 2005: No . 5A Attached please find the Monthly Operating Report for February. This report covers revenues & expenditures to date for Fiscal Year 2005. There are no account expenditures of major concern however please note that the annual premium for the Workers Compensation has been paid and therefore the expenditure reflected in the report should be the final figure for the entire year. The Engineering Services expenditures in the water enterprise funds are for the water expansion project which will be transferred to a new capital account designed to segregate and identify cost related to that undertaking. An adjustment is pending in the Assessor account to credit $ 14,066 which belong in last year's expenses. One account of concern is the Sand/Salt account under Public Works. We have already spent approximately 1/3 of the entire annual budget. Due to the fact that we have had a relatively light winter season, I wi continue to monitor this account for a possible adjustment. The most significant improvement (but not the only) incomplete is the City Park that lies between Fields II and Tana Ridge. That park was to have been constructed by the developer per plans approved by the Park Commission as satisfaction of the Park Dedication requirements for Fields II, Little Bluestem and Tana Ridge (not developed by Engstrom, but a part of the same OP project approval). Work was started on the park 2-3 years ago, but never completed. Much of the grading and seeding work that was completed has now deteriorated to a point where it needs to be done again (the seeding part, at least. Work to install the ball field backstop and other required equipment was started late last fall. The City has retained a Letter of Credit from Robert Engstrom Companies in the amount of $77,500 to secure completion of the project improvements. That letter has been required by staff to be reissued several times in the past to avoid expiration. The Letter of Credit is due to again expire on February 27, 2005. While we are reasonably certain Mr. Engstrom would again renew the Letter of Credit if requested to do so by staff, that may not be the appropriate given the time that has already elapsed since the 2001 completion dates specified by the Development Agreement. The staff could also cash the Letter of Credit, and use the proceeds to complete the work as a City project next spring — which we have done in the past with other tardy developments of a more limited scale, and with LC's of a smaller amount. Given the scale of work to be completed and the amount of the Letter of Credit involved, staff requests direction from the City Council as to whether the Letter of Credit should again be renewed, or whether the LC should be cashed by the City, and the improvements then completed as a City project. The Draft Plan covers Regional Policy regarding Waste Water (sewers), Storm/Surface Water and Water Supply. Of the three topical areas covered by the Plan only Waste Water is a Regional System. The Metropolitan Council can only legally compel local compliance with Policy Plan provisions regarding Regional Systems. At this point METC can plan all they wish regarding surface water and water supply, but they can not mandate local compliance with those policies and plans. In this regard, a rumor had surfaced some time ago that METC would be advocating that Water Supply become a fifth Regional System. On February 8 the Council Public Works Committee reviewed proposed City comments on the draft plan that had been prepared by staff and directed that those comments be incorporated into a Resolution for City Council consideration. A draft Resolution is attached as directed by the Committee. Action items: 0/8 Motion to adopt Resolution #2005 - , City Council comments on the Metropolitan Council Draft Water Resources Plan. Attachments: 019 1. Draft Resolution #2005 - , Water Resources Plan Comments Persn rsionsib1e: Ci Time Allocated: CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 2005-018 A RESOLUTION RELATING TO LAKE ELMO CITY COUNCIL COMMENTS ON THE METROPOLITAN COUNCIL DRAFT WATER RESOURCES PLAN WHEREAS, the Metropolitan Council is considering a draft update of their Water Resource Policy Plan, which covers Regional Policy regarding Waste Water (sewers), Storn-i/Surface Water and Water Supply, as is required every 10 years by State Statute. WHEREAS, at its February 8, 2005 meeting, the Public Works Council Committee reviewed the proposed City comments on the final draft plan that had been prepared by staff and directed that those comments be incorporated into a Resolution for City Council consideration. NOW, THEREFORE, BE IT RESOLVED THAT the Lake Elmo City Council has reviewed the Metropolitan Council Draft Water Resources Plan and offers the following comments: 1. The City requests the Met Council to be specific with respect to the draft Plan concept of "promoting" water conservation efforts by cities. What does "promoting" mean? 2. The draft Plan (Page 24) refers to the Council "...maintaining storm water runoff rates and volumes at or below predevelopment conditions." Since most storm water crosses political boundaries, and since municipalities have historically addressed storm water with differing policy, does this mean that a downstream municipality could be required to retain less than predevelopment rates and volume of inter -community stolin water to accommodate excess rates and volumes from an upstream municipality? The draft Plan appears to link municipal nonpoint source surface water management with the Wastewater System Plan in an effort to establish a basis for an "inconsistency" with Regional Systems finding should a conu-nunity not address such nonpoint surface water management in a manner demanded by the Council. Is that linkage intended; and, if so, does such a linkage overreach the Council's System Plan authority? There is no Stoini/Surface Water System Plan by legislative design. 4. The stated policy of 2030 Regional Blueprint is to encourage/mandate more efficient utilization of in -place regional infrastructure in the Central Cities and First/Second Ring suburbs by increases in land use intensity. The provision of the draft Plan that places a 500,000 gallon per day minimum threshold for Council funded wastewater improvements where redevelopment to support that stated 2030 Framework Policy is proposed by a municipality appears to suggest either an "unfunded mandate" by the Council, or a contradiction between the framework and the draft wastewater plan. ADOPTED by the Lake Elmo City Council on the 15th day of February, 2005. Dean Johnston, Mayor ATTEST: Martin J. Rafferty, City Administrator Lake Elmo CIty Council February 15, 2005 Agenda Section: Planning, Land Use & Zoning N . 9C Agenda Item: Street Naming Ordinance Background Information for February 15, 2005: On February 8 the Council's Public Health and Safety Committee considered the present City policy for the naming/numbering of streets. The City Planner explained that the City continues to use the street/address numbering system that was developed for Washington County in 1967, and adopted by the City in an Agreement with the County in 1971. He explained that the City canceled the street naming portion of the Agreement by Resolution #2000-071 in 2000 in response to the County's refusal to record the Fields of St. Croix II plat because the street names did not correspond to the agreed -to system. The Committee directed staff to draft City Council action that would reintroduce a uniform street naming system within the City that follows the general pattern (alphabetical west -to -east) of the 1971 Agreement, but which also allows some street naming latitude as long as the alphabetical range is adhered to. The City has never had an ordinance establishing street naming — only the 1971 Agreement. If street naming is to have the force of law for future plats, it must be addressed by ordinance. Staff has prepared a draft ordinance that would, by reference, adopt the County -wide street naming/numbering system — but with a slight modification to provide the street naming latitude noted above. Cainmission PREFACE This manual of procedures and application is intended for use in reassigning street names and numbers throughout the County. It is also intended for use in assigning new street names and numbers as new developments take place. This manual is the culmination of many years of work by many persons and governmental agencies. Major contributions were made by the following: The Cottage Grove Town Board Cottage Grove Planning Commission South Washington County Planning Commission Metropolitan Planning Commission Midwest Planning and Research, Inc. Dakota County Officials Washington County Officials U.S. Post Office Washington County Planning Advisory Commission Over five years of work has gone into the preparation of the uniform street naming and numbering system. The system is designated such that it can be utilized by all communities in Washington County This uniform street naming and numbering system is similar to that recently adopted by Dakota County. The system for Washington County is not mandatory. Each City, Township, and Village may or may not utilize the system depending upon local desires. It is strongly urged, however, that each community use the system in order to attain the desired goal of uniformity throughout the County. TABLE OF CONTENTS Page PREFACE INTRODUCTION PART I: STREET NAMING SYSTEM 2 PART II: PROPERTY NUMBERING SYSTEM 7 PART III: PUTTING THE PLAN INTO OPERATION • 9 a INTRODUCTION Throughout the Twin Cities Metropolitan Area, communities are growing and adding to their street systems. One irritation of urban life is the waste of time - and patience resulting from unsystematic and haphazard housing numbering and street naming. Street names which give no clue to the section of the community and property numbers which are ,seemingly not related to blocks, cross streets, or other features slow down the governmentcil„ social, and business life of a community. In many parts of the metropoi itan area', duplicated or confusing street names lessen the efficiency of everyday life. For example, mail intended for delivery to a person in Cottage Grove may be sent to an identical address in.Saint Paul by mistake, due to duplication of addresses. Delivery trucks, home visitors, emergency vehicles, and others may have difficulty in finding addresses when there is lack of a uniform street naming and numbering system. The problems arising from inadequate street naming and house numbering grow more complicated as time passes and the County grows. Finally a complete reorganization is necessary; the more built-up the community, the more difficult the reorganization. While there are some difficulties in changing the street naming and numbering system of a community, the long-range benefits far out- weigh the temporary inconvenience. Some communities, such as North Saint Paul, for example, have found that the difficulties and temporary inconvenience during the change -over are notes severe as might be imagined, The primary reasons for implementing a uniform street naming and numbering system in Washington County are: 1. Make the change now while it is relatively easy; such a change will be much more difficult in the future; 2. Reduce difficulty in emergency vehicle access to property; 3. PART I: ' STREET NAMING: SYSTEM The basic street naming system is as shown on map, Street Naming and Property Numbering Washington County, The main features are: - 1. The point of origin is the State Capitol Building (same point utilized by Dakota County) and Highway No. 12. This permits easy adaptation to additional areas in Washington County and relationship to Dakota and Ramsey Counties. 2. A basic grid pattern has been established with one -mile intervals for easier identification. North -south streets are labelled as avenues with Avenue A at the State Capitol; then eastward, Avenues B,C, D, and so on at one - mile intervals with Avenue T being about two miles east of the Saint Croix River. Main east -west streets are indicated as follows: One --Mile Street South is one mile south of Highway No, 12; Six -Mile Street South is the northern boundary of Cottage Grove with Twelve -Mile Street South being , at the southern boundary. Most persons will know where they are in relation 10 the State Capitol with relative ease; for example, the intersecHon of Avenue M and Six -Mile Street South is 12 miles east of the Capitol and 6 miles south of Highway No. 12 (Hudson Road); this location would be the extreme northeast corner of Cottage Grove. 3. Streets between "Mile" streets are assigned a number for each mile; avenues between One -Mile Avenues are assigned alphabet categories for each mile. It is thus possible to determine your approximate location within each mile grid bounded by main streets and avenues. 4. Streets .not running east -west or north -south have been assigned special names as follows: a. Streets running NE to SW are called Boulevards. b. Streets running NW to SE are called Roads. c. Meandering streets, cul-de-sacs, and other miscellaneous streets are named in accordance with the enclosed chart (Miscellaneous Street Name Designations). 5. Existing Street Names In some instances, it will be possible and even desirable to retain the existing street names, especially if they have some historic signi- ficance. For example, Military Road could still be called by that name as it runs from northwest to southeast. 2 3 South 'iG" Ave, Gist Street South 63id Street South 65th Street South 67th Street South 69th Street South a) . 0 V) -4- 6 Mile St. So • (60th St So.) Passage of an ordinance by city, village or t wnship adopting the new system and date of changeover to new system. 2. Street name changes should be placed into effect as soon as a new sign can be erected, Property numbers should be changed on all properties within six months following passage of the ordinance. In addition to publicity concern- ing the change, each property owner should be notified in writing of his new address and/or be invited to secure same from 3. A Master Street Naming and Property Numbering Map (large scale) should be maintained showing both existing (crossed out) and new names and numbers. 4. In the rural area,, properties should be given a new street number under the following conditions. a. The home or other principal building is near to a street (not back with access via a long private drive); b. The rural route number is not adequate for delivery or some other complication necessitates the assignment of an "urban" number; c. The new number is required in addition t'o the fire number for fire runs or other emergency vehicle convenience. If rural properties must be assigned a number, they should be given that number associated with that street which is the nearest and most logical. If possible, the address should be such that future development in the area will„not require reassignment of an address. 5. Street name signs should not be changed until most people are aware of the new system and all new addresses have been assigned and given to the persons involved. 6. Postal authorities, the fire department, utility companies, and all others affected should be given at least six weeks advance notice before the changeover is made. 7. House numbers attached to homes or other buildings should be at least four inches in height. 8. Street signs shall be reflectorized.. 9.. Assistance can be obtained from the County. Surveyor's office. New base maps can also be obtained from the County for each community; these can be used to note the new system as related to any existing system, 9 (SAMPLE) Ordinance No, AN ORDINANCE TO PROVIDE A UNIFORM SYSTEM FOR NAMING STREETS AND NUMBERING PROPERTIES AND PRINCIPAL BUILDINGS IN THE OF THE PUBLIC WELFARE REQUIRING IT, BE it ordained by of as follows' Section 1. However, the applicant has stated that 6,000 square feet would be constructed initially, with the balance to follow at a later time. Following review, discussion and comments from the applicant, the Committee directed that these applications be placed back on the City Council Agenda. The original agenda documentation is attached. As before, should the Council decide to reverse the Planning Commission recommendation regarding denial of asphalt shingle substitution, the second Resolution will need to be altered to that effect. By a vote of 5-2-1 (Roth and Deziel opposed, Helwig abstain) the Commission recommends that the applicant's proposed PUD Plan Amendment to allow asphalt shingles on the "visible" roof be denied. This means that the building must be roofed in accordance with Business Park Architectural Standards, which specify "...standing seam metal, fire -treated cedar shakes, ceramic tile, clay tile, concrete, or slate." Should the Council not concur with the Planning Corrunission recommendation regarding the roofing materials, the second Resolution should be instead for approval of the PUD Plan Amendment. Dean Johnston, Mayor ATTEST: Martin Rafferty, City Administrator Excerpt Draft Lake Elmo Planning Commission Meeting Minutes of Jan. 24, 2005 EAGLE POINT 4TH ADDITION, Preliminary Plat, PUD Plan Amendment, & Site Plan Public Hearing - EAGLE POINT BUSINESS PARK 4TH ADDITION, Preliminary Plat, PUD Amendment, and Credit Union Site Plan The Planner introduced an application to subdivide an existing outlot in Eagle Point 2nd Addition into one lot and one outlot. He reported that the Site Plan proposes a building of potentially 10,000 square feet on the newly created lot. A credit union is planned with capacity for 8 drive-thru lanes. The plat, site plan, and the PUD Plan amendment were reviewed by staff and affected outside agencies. The Planner said the staff report highlights some areas for consideration: 1. Applicant proposes Timberline -style shingle and requests an amendment to the Eagle Point PUD plan to allow substitution of roofing to accommodate this specification. 2. The applicant should specify fixtures with full cut-off with no exposed bulbs or lenses for both parking area lighting and drive up teller stalls. 3. Access onto Hudson Boulevard has been extensively reviewed because of future traffic issues that are forecasted. A traffic study was provided by the developer. The City Engineer asked for a painted left turn lane on Hudson. 4. Evidence of an easement for full use of the driveway should be provided to the City. The Planner suggested the following Findings: 1. The Preliminary and Final Plats generally comply with code standards of Section 400, and the approved PUD Plan of Eagle Point Business Park 2. The 520 Site Plan generally complies with the zoning ordinance standards, other applicable standards of the city code, and the approved PUD Plan of Eagle Point Business Park . The Planner reported that Staff recommends approval of the Preliminary Plat, PUD Plan Amendment, and Site Plan subject to conditions and observations in the staff report and concurrence by the City Engineer. Dale Glowa, United Properties Mr. Glowa said that City and County Credit Union is one of the largest in the Twin Cities. He introduced Pat Pierce, President of City and County along with Steve Dowdy pf Pope Associates. Commissioner Ptacek asked the applicant if they can comply with the lighting ordinance. 1 Excerpt Draft Lake Elmo Planning Commission Meeting Minutes of Jan. 24, 2005 . EAGLE POINT 4TH ADDITION, Preliminary Plat, PUD Plan Amendment, & Site Plan Mr. Glowa said they can. He said the lighting is consistent with other properties in the business park, with the same lighting fixtures and for the teller lanes they will use canned recessed lighting. He said an easement agreement for shared access for the driveway will be drafted. Commissioner Roth questioned the trash facility location adjacent to the frontage road. Mr. Glowa said the location is for ease of use without interfering with ingress and egress. He said an earth berm and a brick enclosure will essentially make it disappear from view on Hudson Blvd. THE CHAIR OPENED THE PUBLIC HEARING AT 7:20 P.M. Nobody offered testimony. THE CHAIR CLOSED THE PUBLIC HEARING AT 7:21 P.M. M/S/P, Ptacek/Armstrong, To recommend the Preliminary Plat and Final Plan of EAGLE POINT 4TH ADDITION, conditional upon payment of Park Dedication Fees as specified by the existing Eagle Point Development Agreement; and approval of the Section 520 Site Plan for City County Credit Union on the condition that asphalt shingles will not be used. Deziel questioned the appearance and standard of standing seam metal roofing. He suggested that quality asphalt shingles are American and rural looking. He said the applicant made a statement of a problem with metal roofing on the other buildings causing glare. The Planner noted that the metal roofing on the other buildings in Eagle Point Business Park appears to be copper colored. Dark green standing seam metal might not glare. Chairman Helwig agreed with Commissioner Deziel, and suggested the Commission take another look at the code regarding roofing materials. VOTE: 5:2:1 Schneider, Sedro, Armstrong, Ptacek, Sessing (Yea)/ Deziel, Roth (Nay)/ Helwig (Abstain). 2 LAICE ELMO O PLANNING COMMISSION STAFF REPORT Date: January 14, 2005 for the Meeting of January 24, 2005 Applicant: United Properties Location: Northeast Comer of Inwood Avenue and Hudson Blvd. Requested Action: Preliminary Plat, Site Plan and PUD Plan Amendment Land Use Plan Guiding: Business Park (BP) Existing Zoning: Business Park (BP), Subject to an Approved PUD Plan Site History and Existing Conditions: The Final Plat of Eagle Point Business Park 2nd Addition, creating Outlot A was approved by the City Council on September 4, 2001. The site of this application is the southwesterly 2.06 acres of Outlot A. The City had previously approved a PUD Plan encompassing the entire 120 acres of the Eagle Point Business Park, including this site. Exhibits to the PUD Plan documentation provide for allowable uses, lot specifications, master signage and related development standards. Where the PUD does not address a particular development standard, the Business Park and other related City Code standards are applicable. A proposed departure from those standards not already addressed by the PUD Plan should be processed as a PUD Plan Amendment. The site is vacant today, except for one of the Eagle Point Business Park monument signs — located at the extreme southwest corner of the site. City water and sewer services are both available to the site. Discussion and Analysis: The applicant proposes to replat Outlot A to create the 2.09 acre site at the Southwest corner. The original design of Eagle Point Business Park was as several large outlots and the public street right-of-way. The intent (owner and City) was to replat the outlots into lots/blocks as the land area requirements for individual development projects became known. Several outlots have seen replats to this end since 1999. The applicant also proposes construction of a 10,000 square foot office building on the newly created lot, requiring review by the City of a Section 520 Site Plan. The structure and site are designed for a 10,000 square gross structure, but the applicant proposes to construct only 6,000 square feet initially. We note that the minimum building area specified by the Eagle Point Business Park PUD Plan is 10,000 square feet. The building will be occupied by a credit union, so the site plan includes space for 8 drive through teller lanes, of which we understand 6 will be installed initially. Staff has reviewed the proposed Plat and Site Plan for compliance with the design standards of the Business Park District and/or the Eagle Point Business Park PUD Plan, where the PUD Plan standards differ from the Zoning standards. — and they do so in some cases. Staff has found the Plat and Site Plan documents to generally comply with all Business Park and PUD standards for Eagle Point, except as follows: 1.. The applicant proposes Timberline shingles (asphalt) on the pitched roof. The Business Park architectural standards specify that all "visible" roofing materials be limited to shakes, slate, concrete or standing seam metal. An amendment to the Eagle Point PUD Plan (applicable to this site only) will be required to waive the Business Park roofing standard. 2. The applicant has provided a luminaries plan and a series of manufacturer light fixture specifications. The luminaries plan appears to retain exterior light within the site boundaries within the prescribed foot candle maximums from the light source. We note, however, that no lighting appears proposed under the drive in teller canopies (at least, the luminaries plan does not note foot candle values of consequence. Unlit teller canopies would be unusual. We suspect an oversight. 3. The light fixture specifications provided with the application are extensive, but the applicant has not noted which specification light fixture will be used. The fixtures must be full cut-off (flat panel lenses with no lense extensions below the fixture) in all cases (including any teller canopy lighting). 4. While not an ordinance exception, the issue of the access to Hudson Blvd. by the private drive serving this and future uses to the north has been addressed previously by the City Engineer. The applicant was required to complete a traffic analysis that demonstrates how the access will interface with Hudson Blvd. traffic - particularly eastbound left turns into the site. The City Engineer has reviewed that work and has found that , with the left turn lane modifications proposed, the access to Hudson Blvd. will function satisfactorily. 5. We note that the access drive serving the site is private, and straddles the property line to the east with proposed Outlot A. Evidence of the easement for use of all of that drive by the owner of Lot 1 should be provided. The concurrent Preliminary and Final Plats appear to comply with Chapter 400 platting requirements, and the standards of the approved Eagle Point PUD Plan. Findings and Recommendations: 1. The proposed Section 520 Site Plan generally complies with Zoning Ordinance standards and such standards found elsewhere in the City Code that apply, subject to conditions noted above - including City Council approval of a PUD Plan amendment to permit asphalt shingles on the structure to be located on Lot 1, Block 1, Eagle Point Business Park 4th Addition. 2. The Eagle Point Business Park 4th Addition preliminary and Final Plats comply with the standards of Section 400, and the Zoning Ordinance — as modified by the PUD Plan for Eagle Point Business Park. Staff recommends approval of all for applications subject to the conditions listed. Planning Commission Actions Requested: Motion to recommend approval of Preliminary and Final Plats of Eagle Point Business Park 4th Addition conditioned on the payment of Park Dedication Fees as specified by the existing Eagle Point Business Park Development Agreement. Motion to recommend approval of the PUD Amendment for the Eagle Point Business Park PUD Plan, to permit asphalt shingles for thestructure located on Lot 1, Block 1, Eagle Point Business Park 4th Addition. Motion to recommend approval of the Section 520 Site Plan on Lot 1, Block 1, Eagle Point Business Park per plans staff dated January 14, 2005, subject to the following conditions: 1. The exterior fixtures must be full cut-off (flat panel lenses with no Tense extensions below the fixture) in all cases (including any teller canopy lighting). 2. Evidence of the easement from the owners of Outlot A for use of all of designated drive by the owner of Lot 1 should be provided. 3. Compliance with the comments and recommendations of the City Engineer 4. Asphalt shingles are permitted only upon approval of a PUD amendment to substitute for the Business Park District roofing standards for visible roofs. 5. Compliance with the recommendations of the South Washington Watershed District (if any) that are concurred in by the City Engineer. Charles E. Dillerud, City Planner Attachments: 1. Location Map 2. No. 13267.000 From: Thomas Prew, P. E. Routing: Date: January 11, 2005 I have reviewed the preliminary plat information dated January 6, 2005, and have the following comments: Sanitary Sewer The site is served with sanitary sewer. The service should enter the sewer system at the nearby manhole. An inside drop is permitted. Water 8-inch watermain should be extended from the watermain along Hudson Boulevard to the north property line of this lot. It will be used for fire protection for future buildings to the north.. Surface Water Ponding for this building will be built when the office buildings along the creek are constructed. Until then site run-off will be directed to our ditch along 4th Street. Street Access The traffic study conducted for this building shows that there will be some delay in the future leaving the site and getting onto Hudson Boulevard. Since this traffic is backing up on the site, it will not have an effect on traffic in the street. Hudson Boulevard will need to be re -striped in order to accommodate a new left turn lane. The City could include that work as part of its annual striping program. The City utilized the services of TKDA planners and engineers to assist with certain technical portions of the 2000 Plan preparation (primarily, transportation , wastewater, water supply and surface water elements of the Plan). The City will again require such technical assistance with infrastructure plans modifications for the work we now are facing. In addition, given the extreme time constraints we must contend with, additional assistance (such as mapping and fiscal forecasting) will also be required. As suggested by staff, the Finance, Legal et al Committee of the Council recommends the City retain TKDA for such planning and engineering assistance as is required to complete the 2005 Comp Plan modifications. Given the time element, this strategy would be expedient and in the best interests of the City rather than the alternative of going through a lengthy RFP process to secure such assistance. The City Council's concurrence in this consultant strategy is respectfully requested. Action items: Motion to approve the use of the planning and engineering contract services of TKDA for the 2005 modifications to the Comprehensive Plan. City Council February 15, 2004 Agenda Item: City Council input to Planning Commission on Comp Plan On February 7th City Council and the Planning Commission had a workshop on preparing changes to the Lake Elmo Comprehensive Plan as the negotiated settlement with Met has been completed. At the meeting discussion occurred as to how the City Council could have input to the Plan Commission as they move forward to review and redraft policy for the revised comprehensive plan. It was suggested by the Mayor and other members of Council that each Council member identify key inputs/suggestions that could be discussed as an entire Council. To facilitate this exercise, it is requested, that during individual Council reports that each Councilperson would identify the key elements/ideas/concepts they would want the planning Commission to consider as they review comprehensive plan policy revisions. It is intended, that following the Council mee in at the scheduled work session. ach of the Councilpersons ideas would be discussed It is anticipated that council input, to the plan commission, would be developed and be submitted as a result of this process. It is felt that on -going input to the Plan Commission, from individual Council members, would be distractive and not additive to the Comprehensive Plan revision process. It should be noted that the final document to be completed by the Plan Commission must come to the Council for a vote when it is completed. Person responsible: Action Items: Please be prepared with your ideas and to discuss the ideas at Martin Rafferty, City Administrator the work session. Attachments:
