AGENDA ITEM: Accept Resignation of Brenda Anderson from the Planning Commission
SUBMITTED BY: Sharon Lumby, City Clerk
THROUGH: Bruce Messelt, City Administra o
REVIEWED BY: Dave Snyder, City Attorney
SUMMARY AND ACTION REOUESTED: The City has received the resignation of Brenda
Anderson from the Planning Commission, which creates a vacancy on the Commission. Ms.
Anderson's first 3-year term as a Full Voting Member will expire on December 31, 2010.
Past practice has been, when such vacancy occurs, to appoint the First Alternate (currently Mr.
Steve Britz) to complete the remaining portion of this term as a Full Voting Member and appoint
the Second Alternate (currently Mr. Todd Williams) to First Alternate. To do this, the
recommended motion is as follows:
"Move to accept Ms Anderson's resignation from the Planning Commission, to appoint
the current First Alternate to complete the remaining portion of this term, to appoint
the current Second Alternate to First Alternate, and to advertize the new vacancy."
BACKGROUND INFORMATION: City Code states that a Planning Commissioner's term
shall last for three years and a voting member can serve two consecutive terms, All
appointments will expire on December 31st of a given year. Attached is a chart identifying the
expiration of terms for each commissioner and if a commissioner is eligible to reapply for a three
year term,
STAFF REPORT: Past practice has been, when a mid-term vacancy occurs, the First Alternate
is appointed to complete the remaining portion of the vacant term and the Second Alternate is
appointed to First Alternate. The City then advertizes to fill the vacancy of Second Alternate on
the Planning Commission. City staff can identify no reason to deviate from past practice.

MOTION Resolution 2010-002
Resolution of Suppon for 2010 Capital Bonding Request
Bruce A. Messelt, City Manager-i
(--
December 15th, 2009 Direction of City Couucil
Tom Bouthilet. Finance Director
Dave Snyder, City Attorney
SUMMARY AND ACTION REQUESTED: The City Council is respectfully requested to
affirmatively consider a formal resolution of support for the City's 2010 State Bonding
Application. This Application is for $2.00 million in State funding to assist the City of Lake
Elmo in construction of regional water and wastewater infrastructure, necessitated hy recent
identification of area -wide groundwater contamination and mandated accommodation of
regional economic development objectives, including population growth and wastewater
utilizations, regional transportation and transit improvements, and regional housing needs. The
recommended motion included in passage of the Consent Agenda is as follow:
"Move to approve Resolution 2010-002 requesting S2 million in 2010 State Bonding Funds
.for construction of water and wastewater infrastructure of regional benefit.
BACKGROUND INFORMATION: On December 1.5th, 2009. the City Council unanimously
directed City Staff to prepare and submit an application for 2010 State Bonding Funs to support
construction of water and wastewater infrastructure improvements of regional economic benefit
and necessitated by mandated sanitary sewer services (i.e. population and employment increases)
and identified groundwater contamination. An initial application was completed on Dec -ember
16th and submitted to the City's state House and Senate representatives. Tonight's action
completes a required element of this application.
The premise of the application is that a regional/statewide public purpose is advanced by
assisting Lake Elmo in accepting and servicing increases in population and employment with
clean. safe water and sanitary sewer services. made more difficult by having to construct such
services around the approximately 4 square mile Regional Park Preserve located in the center of
the City. With planned concentrations of development within the City's Village area and along
the 1-94. Lake Elmo will be providing key regional assistance with projected metropolitan

economic development, including population increases, regional transit and transportation
objectives, and business and housing opportunities.
However, as our application points out, despite Lake Elmo's relatively high per capita income
and per unit property tax values, the City's current low density development pattern, rural
character and open space preservation ethic, results in a gross tax base which cannot support
alone such regionally -significant capital investment without exponential increases in taxation
rates and undue competition with other equally -legitimate local capital projects, such as roadway
infrastructure, parks improvements and public works.
Moreover, City efforts to secure PFA loans or federal stimulus monies have not proven
successful; nor has such project proved readily eligible for existing State grant programs or
Metropolitan Council funding.
STAFF REPORT: The City recently approved a 5-year CIP which includes projected
undertaking of several major regional infrastructure projects, though many have yet -to -bet -
determined funding sources. The City has also been in discussion with the Metropolitan Council
regarding approval of the City's 2010 Comprehensive Plan update, implementation of 2030
growth mandates and execution of our Memorandum of Understanding. Of note:
• Only recently has the City been able to near finalization with the Metropolitan Council of
the City's Comprehensive Plan Update and a coordinated approach to implementation of
mandated sanitary sewer services projections for Lake Elmo;
Similarly, recent efforts to devise and address a long-term solution to Lake Elmo's
potable water needs, necessitated by significant contamination of area groundwater by
PFC's, has resulted in critical prioritization of capital investment, particularly to address
system integrity and expansion needs, including within the existing service area and
along the planned 1-94 corridor to accommodate the regional objectives of the State and
the Metropolitan Council;
• Due to the extended economic slowdown, timing of and funding for construction of these
critical infrastructure needs has been revised and, accordingly, become of greater priority
in a desire (indeed, mandate) for Lake Elmo to be fully prepared for the region's
emergence from the current recession;
• Equally vexing is that complete reliance upon private development to fund, up front, such
major infrastructure projects is proving unrealistic. However, the City's long-term
objective remains that new growth and development will fully {re -]pay for such
infrastructure projects while existing residents will continue to contribute their fair share
for existing infrastructure operations, maintenance and replacement needs.
Finally, the City of Lake Elmo intends to use cost effective engineering and innovative
construction techniques to minimize both property disruption and promote environrnentally-
appropriate development. To the greatest extent practicable, existing right-of-way will be

utilized, jack -and -bore techniques employed where feasible, and incorporation of best practices
in the areas of reparation techniques, use of rain gardens and appropriate xeroscaping.
RECOMMENDATION: Based upon the above information and staff report, it is recommended
that the City Council approve the attached Resolution as part of its Consent Agenda:
Move to approve Resolution 2010-002 requesting $2 million in 2010 State Bonding Funds
for construction of water and wastewater infrastructure of regional benefit.
Alternatively, the City Council may elect to remove this item from the Consent Agenda, discuss
this issue in greater detail, and take alternative action, as appropriate.

AGENDA ITEM: Preparation of 2010 City Workplan
SUBMITTED BY: Bruce Messelt, City Administrato
THROUGH:
REVIEWED BY:
SUMMARY AND ACTION REQUESTED: The City Council is asked to spend a few minutes
at tonight's meeting identifying for City staff those items of interest to the Council that will
require special attention during 2010.
BACKGROUND INFORMATION: The City Council has already approved its 2010 Annual
and CIP Budget and its Staff is now in the process of defining specific projects and activities that
are budgeted and/or authorized above normal day-to-day operations and business that will
require special attention or are of particular interest to the City Council,
Examples of such would be: Review and "next steps" on the 2009 survey of waste collection
alternatives; completion of review of City special assessments; review of the Agricultural Sales
and Wayside Stand ordinances; exploration and potential implementation of "Code Red" and
CRM systems, and the like.
The City Council is asked to help identify these key Workplan objectives during tonight's
meeting. These will be codified in a formal Workplan, with project leaders and proposed
timelines identified, and presented to the Council for formal adoption at a later date.
STAFF REPORT: The City staff would like to establish with the City Council a Citywide
delineation of official budgeted and/or authorized Workplan projects for 2010. While
modifications and changes will always occur, such exercise fosters both discipline and
accountability for the activities and functions of the City and its employees.
Such annual Workplan is already in use by the City's Planning Commission and has proved of
high value to other cities and organizations.
