Klaers, do hereby certify that I am custodian of the minutes of all proceedings had and held by the City Council of said city, that I have compared the attached resolution with the original passed and adopted by the City Coun.cil., of said city at a regular meeting thereof held on the 5th day of July, 1983, at 7:OO p.m., that the attached constitutes a true and correct copy thereof, that the same has not been amended or rescinded and is in full force and effect. Signed : c'1°rW Patrick D. K aers City Administrator . W. 3 RESOLUTION CITY OF LAKE ELMO WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING THE FINAL PLAT OF PACKARD PARK. WHEREAS, the City Council of the City of Lake Elmo has pre�7iously considered and approved the preliminary plat of Paciard�Park; and WHEREAS, the applicant has now presented to the City a final plat which conforms to the approved preliminary plat and meets with the requirements of the City's Subdivision Ordinance: NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve and accept the final plat of Packard Park as the same is now on file with the City Administrator subject to the following conditions: 1. Gene Peltier, the owner, together with his heirs and assigns, agrees to maintain Legion Avenue along the front lot line at his expense for emergency vehicles in exchange for a variance from the City requirement that this lot be on an improved public street. Gene Peltier, together with his heirs and assigns, agrees to provide any necessary surface water drainage and ponding facilities determined in the sole discretion of the City of Lake Elmo at the time the balance of the property is platted. This condition is based upon the fact that the owners received a variance from the City from the City's drainageandponding requirements. 3. Gene Peltier, together with his heirs and assigns, shall pay $175.00 to the City for park donation fees together with all Pass through costs before the final plat is signed.
