RESOLUTION
CITY OF LAKE ELMO
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION VACATING THE ROAD EASEMENT IN
TEAL PASS ESTATES
WHEREAS, H. Kenneth Neudahl and Cheryl J. Neudahl,
developers of the plat known as TEAL PASS ESTATES, have
submitted to the City of Lake Elmo.a Petition praying for
the vacation of a road easement in said TEAL PASS ESTATES
legally described as follows, to -wit:
All that part of Government Lot 2, Section 10,
Township 29 North, Range 21 West, Washington
County, Minnesota described as follows: Com-
mencing at the North 8 ast corner of said Government
Lot; thence South 88 57',05'1�West, assumed
bearing, along the North line of said Government
Lot, a distance of 558.73 feet to the point of
beginning of the land to be described; thence
South 10 11109" East, a distance of 379.61 feet;
thence South 23 0 23143" West, a distance of
522.95 feet to a point in the Northeasterly line
of "DAWCIN ACRES"; thence North 36 54153" West,
on an assumed bearing -,-along said Northeasterly
line of "DAWCIN ACRES"'a distance of 37.00
feet; thence North 59041119" West, a distance
of 135.28 feet along the Northerly line of
"DAWCIN ACRES" to the mogt Northerly corner
thereof; thence South 41 05'03" West, along
the Northwesterly line of "DAWCIN ACRES", a
distance of.374.57 feet to its intersection with
the Northeasterly line of that certain public road
kn8wn as "LAKE JANE ROAD NORTH": thence North
67 15'37" West, along said public road, a distance

West line of said Government Lot; thence North

Government Lot, a distance of 1006.47 feet to
the Northwest corner of said Government Lot;

WHEREAS, said Petition came on for hearing before the
City Council at a regular meeting thereof held on Tuesday,
November 15, 1983, pursuant to Notice thereof published and
posted as required by law, and
WHEREAS, the City Council has reviewed this Petition
with concern for the interest of the public; and
WHEREAS, the road easement proposed for vacation: is
no longer needed as a public street; moreover, by 'vacating
the same, the property will be returned to the tax rolls
and will enhance the taxable value ofall land abutting
thereon and effected thereby; and
WHEREAS, for the foregoing reasons, it appears to be in
the public interest to vacate the road easement described
above;
NOW, THEREFORE, BE IT RESOLVED, the above -described
road easement be, and the same hereby is, vacated.
BE IT FURTHER RESOLVED, that the Clerk shall prepare
a Notice of Completion of these proceedings which shall -
contain the name of the City, and the identification of the
vacation, a statement of the time of completion thereof and
a description of the real estate and land effected thereby.
Such Notice shall be presented to the Washington County
Auditor, who shall enter the same in his transfer records
and note upon the instrument over his official signature the
words "Entered in the Transfer Records". This Notice shall
then be filed with the Washington County Recorder, all as
required by Section 412.851 of the Minnesota Statutes.
