RESOLUTION NO.2021-049
A RESOLUTION APPROVING A PURCHASE AGREEMENT FOR THE PURCHASE
OF RIGHT-OF-WAY DESCRIBED AS TRACT B OF 10920 32ND LANE N.
WHEREAS, Joseph Wallace ("Mr. Wallace") is the owner of property located at 10920 32nd
Lane N., in the City of Lake Elmo, as shown as Tracts A and B on the Registered Land Survey
that is attached as Exhibit A; and
WHEREAS, Tract B contains improved right-of-way for 33`d Street Lane N.; and
WHEREAS, the City of Lake Elmo desires to make improvements to the 33`d Street Lane
N. right-of-way and desires to purchase said property from Mr. Wallace; and
WHEREAS, the City and Mr. Wallace desire to enter into a purchase agreement, pursuant
to which Mr. Wallace will convey Tract B to the City; and
NOW, THEREFORE, BE IT RESOLVED,
1. That the City Council hereby approves the Purchase Agreement in substantially the
form presented to the City Council, subject to modifications that do not alter the
substance of the transaction and that are approved by the Mayor and City Clerk,
provided that execution of the Purchase Agreement by those officials shall be
conclusive evidence of their approval.
2. City officials, staff, and consultants are authorized to take all actions necessary to
perform the City's obligations under the Purchase Agreement as a whole, including
without limitation, execution of any documents to which the City is a party referenced
in or attached to the Purchase Agreement, and of any deed or other documents
necessary for Tract B to be conveyed by Mr. Wallace to the City, all as described in
the Purchase Agreement;
ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE FOURTH DAY OF MAY,
2021.
