RESOLUTION NO.2022-033
A RESOLUTION TO APPROVE THE FINAL ALTERNATIVE URBAN AREAWIDE
REVIEW (AUAR) FOR THE CYPHERS LOGISTIC PARK
WHEREAS, The City of Lake Elmo is the Responsible Governmental Unit for
the environmental review of the Cyphers Logistic Park pursuant to Minnesota Rules Part
4410.3610 Subp. 1; and
WHEREAS, Minnesota Rules Chapter 4410.3610 provides for a substitute form
of environmental review known as an Alternative Urban Areawide Review (AUAR)
process; and
WHEREAS, the City undertook an environmental review process to determine if
future redevelopment of the Cyphers Logistic Park area has the potential for significant
environmental effects and prepared an AUAR pursuant to state requirements; and
WHEREAS, the availability of the AUAR was officially noticed on February 1,
2022, in the EQB Monitor; and
and
WHEREAS, the City posted the contents of the AUAR on the City's website;
WHEREAS, comments on the AUAR were received through March 3, 2022; and
WHEREAS, staff has reviewed all comments received during the comment
period and incorporated applicable changes into the Final AUAR.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lake
Elmo hereby approves the March 2022 Final Alternative Urban Areawide Review for the
Cyphers Logistics Park.
ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE 5TH DAY OF APRIL, 2022.
