RESOLUTION NO.2022-103
RESOL UTION APPR 0 VING TFIE DPS LAKE ELMO 3RD ADDITION FINAL PLAT
WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, SRD 2.0 LLC, 900 North Third Street, Minneapolis, MN 55401 submitted
application to the City of Lake Elmo ("City") for a Final Plat and Final PUD Plan for the DPS
Lake Elmo Yd Addition, a copy of which is on file in the City of Lake Elmo Community
Development Department; and
WHEREAS, the Lake Elmo Planning Commission held a public hearing on May 23,
2022 to review and consider a Preliminary Plat and Preliminary PUD approval request; and
WHEREAS, the consensus of the Lake Elmo Planning Commission was to recommend
to the City Council approval of the Preliminary Plat and Preliminary PUD subject to conditions
of approval; and
WHEREAS, the City Council reviewed and approved the Preliminary Plat and PUD
Plan at its August 16, 2022 meeting subject to conditions of approval.
WHEREAS, the proposed DPS Lake Elmo Yd Addition Final Plat includes two lots for a
190 unit rental multifamily building and a day care center on a 14.15 acre site at 9450 Hudson
Boulevard (P1D 34.029.21.34.0012), and
WHEREAS, the City Council reviewed the DPS Lake Elmo 3'd Addition Final Plat at its
meeting held on November 1, 2022 and made the following findings of fact:
1) That all the requirements of City Code Section 103.00.100 —related to the Final Plat have
been met by the Applicant.
2) That the proposed Final Plat will create 2 lots for a multi family building and a child care
facility.
3) That the DPS Lake Elmo P Addition Final Plat is consistent with the Preliminary Plat as
approved by the City of Lake Elmo on August 16, 2022 by resolution 2022-079.
4) That the Final Plat is consistent with the intent of the 2040 Lake Elmo Comprehensive Plan
and the 2040 Land Use Map for this area.
5) That the Final Plat complies with the intent of the Mixed Use Commercial zoning district.
6) That the Final Plat is consistent with the City's design standards.
7) That the Final Plat is consistent with the City's Zoning Code.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council does hereby
approve the DPS Lake Elmo 3'a Addition Final Plat subject to the following conditions:
1. That Final Plat approval is subject to City Council approval of the Final PUD Plans.
2. That the Final Plat would be for the parcel with the PID 34.029.21.34.0012.
3. No construction may begin until the applicant has received City Engineer approval for the
Final Construction Plans; the applicant has obtained from the City all applicable permits,
easements and permissions needed for the project; and a preconstruction meeting has been
held by the City's engineering department.
4. That prior to the City releasing the Final Plat for recording the plans shall be revised to
address the comments in the City Engineer's memo dated October 20, 2022 and any
carryover comments from the preliminary plans.
5. That prior to the City releasing the Final Plat for recording the plans shall be revised to
address the comments in the Landscape Architect's memo dated October 24, 2022.
6. That prior to the City releasing the Final Plat for recording the plat shall be revised to address
the issues identified in the Plat Opinion letter dated October 26, 2022.
7. That the applicant satisfy the park dedication requirement before the City releases the Final
Plat for recording. The park dedication requirement shall be a fee equivalent to the market
value of 1.415 acres and the amount shall be included in the Development Agreement.
8. That the applicant's Storm Water Management Plan shall meet both City and South
Washington Watershed District requirements.
10. The applicant/developer is responsible, at their own expense, for installing all required
improvements in and adjacent to Julia Avenue and Hudson Boulevard.
11. All storm water facilities internal to the site shall be privately owned and maintained. A
storm water maintenance and easement agreement in a form acceptable to the City shall be
executed and recorded with the final plat.
12. That the development shall incorporate stormwater reuse for irrigation as approved by the
City Engineer.
13. If necessary, the applicant shall provide the City with a copy of written permission for any
off -site grading work and storm sewer discharges to adjacent properties before starting any
site work.
14. Before the installation or construction of any subdivision identification signs or
neighborhood markers within the development, the developer shall submit sign plans to the
City for review and obtain a sign permit from the City.
15. Before the execution and recording of a final plat for the development, the developers shall
enter into a Developer's Agreement with the City. Such an Agreement must be approved by
the City Attorney and by the City Council. The Agreement shall delineate who is responsible
for the design, construction and payment for the required improvements with financial
guarantees therefore. The Agreement shall outline any approved phasing plan.
16. That the City does not allow any parking or construction staging, including the loading and
unloading of materials and equipment at any time on Hudson Boulevard or Julia Avenue
during the construction of the site improvements and building.
17. That the developer records the approved Final Plat with Washington County within 180 days
after City Council approval. Failure to record the Final Plat within 180 days of approval will
cause the approval to become void.
Passed and duly adopted this 1" day of November, 2022 by the City Council of the City of Lake
Elmo, Minnesota.
