ITEM: Sunfish Lake Park Land Trust Update

SUMMARY: Commissioner Blackford presented the Sunfish Lake Park Land Trust “Proposed Rights and Restrictions for a Conservation Easement” document to the city council July 15 on behalf
of the Park Commission. The document was accepted by the council on a unanimous vote. The council did however, express concern over the ambiguity and lack of a definition associated
with the detail concerning “low impact recreational improvements according to a park plan approved by the Land Trust” in the section pertaining to allowable structures and improvements
in Area 2. Concern was expressed that there is the potential for varying opinions as to what might constitute a low impact recreational improvement. Speciificlly, there was concern
that a future proposed ice skating rink and warming shelter might be not be considered a low impact recreational improvement and therefore not allowed.
The council requested that the Park Commission address this issue and ensure that the conservation easement be structured in a way that allows for city defined acceptable low impact
future improvements while yet and providing reasonable and appropriate protections that are consistent with the overall goal of conserving and protecting the park.
REQUESTED ACTION: Create and approve a definition for low impact recreational improvements that can be forwarded to the Land Trust as a resource in drafting the Conservation Easement.
