PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Dale Dorschner, Jeff Holtz and Lisa McGinn. Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Planning Director Just, Fire Chief Kalis, Finance Director Magureanu and City Clerk Johnson APPROVAL OF AGENDA Item 11, "2022 Street and Utilities" was moved to the beginning of the Regular Agenda. Councilmember Holtz, seconded by Councilmember Dorschner, moved TO APPROVE THE AGENDA AS AMENDED. Motion passed 5-0. ACCEPT MINUTES Councilmember Dorschner, seconded by Councilmember McGinn, moved TO ACCEPT TILE MINUTES OF THE OCTOBER 19, 2021 CITY COUNCIL MEETING AS PRESENTED. Motion passed 5 — 0. Approve Step Increase for Fire Inspector LAKE ELMO CITY COUNCIL MINUTES November 3, 2021 Councilmember Holtz, seconded by Councilmember Dorschner, moved TO APPROVE THE CONSENTAGENDAASPRESENTED. Motion passed 5 - 0. ITEM 11: 2022 Street and Utility Improvements City Engineer Griffin presented the proposed project for the Fields of St. Croix and Beaut Crest neighborhoods, noting option to remove the water portion of the project in the Fields of St. Croix neighborhood. Councilmember Holtz, seconded by Councilmember Dorschner, moved TO OPEN THE PUBLIC HEARING. Motion passed 5 — 0. John Ludwigson, 8870 35th St. N., presented a list of neighbors with 6 opposed, 2 in favor and 4 neutral regarding the proposed improvements. Bill Mohr, 4748 Larkspur Ln, stated opposition to the watermain portion of the project due to the cost. Kjersti Moline, 4698 Larkspur Ln, stated the watermain portion of the project is unnecessary. Diane Erickson, 3432 Isle Ct. N., spoke in favor of the road reconstruction due to poor pavement conditions in her neighborhood. Mary Christensen, 4943 Lilac Way N., stated that the streets do need improvement but the wells are not contaminated and the water portion of the project is too financially burdensome. Gerald Scherbel, 3443 Isle Ct. N., stated the roads are in terrible condition and need to be redone. William Dustin, 4654 Linden Tr. N., stated opposition to the cost of the water portion of the project. Sheryl Niebuhr, 4644 Linden Tr. N., stated opposition to the water portion of the project due to the cost and lack of benefit. Councilmember Dorschner, seconded by Councilmember McGinn, moved TO CLOSE THE PUBLIC HEARING. Motion passed 5 — 0. Councilmember Dorschner, seconded by Councilmember McGinn, moved TOADOPT RESOLUTIONNO. 2021-121 ORDERING THE 2022 STREETAND UTILITY IMPROVEMENTS AND THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE RECOMMENDED STREET IMPROVEMENTS AS OUTLINED IN THE FEASIBILITYREPORT ACCEPTED ON OCTOBER 5, 2021. Councilmember Dorschner, seconded by Councilmember Holtz, moved TOAPPROVEA PROFESSIONAL ENGINEERING DESIGNAND CONSTRUCTIONSUPPORT Page 2 of 5 LAKE ELMO CITY COUNCIL MINUTES November 3, 2021 SERVICES CONTRACT TO BOLTON & MENK, INC INTHE NOT TO EXCEED AMOUNT OF $114,061, AND APPROVE A GEOTE,CHNICAL SERVICES CONTRACT TO BRA UNINT'ERTEC, INC. INA NOT TO EXCEED AMOUNT OF $17,804.00 FOR THE 2022 STREETAND UTILITYIMPROVEMENTS. Motion passed 4 — 0 —1 (Cadenhead — abstain due to conflict of interest). ITEM 10: Crossroads East Final Plat and Final PUD Planning Director Just provided an overview of the proposed project and reviewed the list of permitted uses. Dan Regan, Launch Properties, commented on permitted uses and anticipated types of tenants expected. Councilmember Holtz, seconded by Councilmember Dorschner, moved TO ADOPT RESOLUTION 2021-115 APPROVING THE FINAL PLAT AND PUD DEVELOPMENT PLANS FOR THE CROSSROADS EAST ADDITION WITH 13 CONDITIONS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT. Councilmember Holtz, seconded by Councilmember McGinn, moved TO AMEND THE PRIMARYMOTIONTOADD RESEARCHAND TESTINGASA CONDITIONAL USE. Motion passed 5 — 0. Primary motion passed 5 — 0. ITEM 12: Award Bids for New City Center and Public Works Addition City Administrator Handt provided an overview of the bidding process for the new city center and public works addition projects. Andy Hoffman, H & U Construction, commented on building supply costs and challenges. Councilmember Holtz, seconded by Councilmember Beekstrom, moved TO APPROVE RESOLUTIONNO 2021-120, A RESOL UTIONA CCEPTING BIDS AND AWARDING CONTRACTS FOR THE NEW CITY CENTER AND PUBLIC WORKS ADDITION. Motion passed 5 — 0. ITEM 13: Amendment #1 to Leo A Daly Contract for New City Center and Public Works Addition Page 3 of 5 LAKE ELMO CITY COUNCIL MINUTES November 3, 2021 City Administrator Ilandt reviewed the proposed contract amending allowing for payment of additional fees incurred in connection with the new city center project and public works addition. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TOAPPROVE CONTRACT MODIFICATIONNO 001 WITH LEO A DALY. Motion passed 5 — 0. ITEM 14: 2021A Bond Issuance Authorization Tammy Omdahl, Northland Securities, presented the results of the bids at the 2021A bond sale. Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE RESOL UTION NO. 2021-122: A RESOL UTION A UTHORIZING ISSUANCE, AWARDING SALE, PRESCRIBING THE FORMAND DETAILS AND PROVIDING FOR PAYMENT OF $22,555,000 GENERAL OBLIGATIONBONDS, SERIES 2021A. Motion passed 5 — 0. COUNCIL REPORTS Mayor Cadenhead: Met with residents at Arbor Glen Councilmember Beckstrom: Attended regional public safety meeting Councilmember Dorschner: Received numerous calls from residents concerned about tax increases Councilmember Holtz: Upcoming Airport Commission meeting. Attended EDA meeting with work on revised work plan and business subsidy program. Councilmember McGinn: Met with Lake Elmo deputies to discuss current public safety concerns. STAFF REPORTS AND ANNOUNCEMENTS Administrator Handt: Attended city administrators meeting with Sheriff Starry, attended Metro Cities regional meeting, noted open house on November 9th for the TH36/Manning Ave. project. City Clerk Johnson: Provided an update on the November 3`d school district elections. Finance Director Magureanu: Reported on bonding. Fire Chief Kalis: Thanked fire staff for increased efforts on training. City Engineer Griffin: Reported on construction project winter preparations and neighborhood meetings coming up.
