PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beekstrom, Dale Dorschner, Jeff Holtz and Lisa McGinn. PUBLIC COMMENTS/JNOUIRIES Dave Moore, 8680 Stillwater Blvd., expressed concern over the appearance. of the new city center construction site, the integrity of the footings and condition of fill on the site. ITEM 12: Public Hearing — Final Assessment Tapestry Sewer Proiect & Adopt Final Assessment Roll City Engineer Griffin presented an overview of the project, reviewed post bid estimated project costs and assessment amounts. Councilmember Holtz, seconded by Councilmember Dorschner, moved TO OPEN THE PUBLIC HEARING. Motion passed 5 — 0. No comments were received. ITEM 13: 4622 Lilac Lane Variance City Planner Hetzel presented the request for an impervious surface variance at 4622 Lilac Lane in conjunction with an addition to the existing single family home on the property. Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE RESOLUTION 2022-056, APPROVING THE REQUEST WITH CONDITIONS FROM KYLE AND MORGAN IRA YNOR FOR A VARIANCE TO ALLO WAN IMPER VIOUS SURFACE COVERAGE OF 19% AT 4622 LILAC LANE NORTH. Motion passed 5 —0. ITEM 14: Conditional Use Permit for a Pool & Fitness Center at Royal Golf Club Planning Director Just presented the request for a conditional use permit to allow construction of a swimming pool and fitness center at the Royal Golf Club for use by its residents. Jim Felten, representative for the applicant, thanked the Council for considering the request and reported on the status of the project. Page 2 of 5 LAKE ELMO CITY COUNCIL MINUTES June 7, 2022 Councilmember McGinn, seconded by Councilmember Holtz, moved TO ADOPT RESOLUTION 2022-057, APPROVING A CONDITIONAL USE PERMIT (CUP) FOR THE CONSTRUCTION OFA SWIMMING POOL AND FITNESS CENTER WITH THE LISTED CONDITIONS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT. Motion passed 5 - 0 ITEM 15: Resolution Callim for Public Hearing Relating to the Tax Abatement Projects for 2022 Bonding Finance Director Magureanu presented an overview of tax abatement projects to be financed by the issuance of 2022A Bonds. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO APPROVE RESOL UTION NO. 2022-058. A RESOLUTION CALLING PUBLIC HEARING ON THE TAXABATEMENT. Motion passed 5 — 0. ITEM 16: Comprehensive Plan Amendment for 110 Acres of City Owned Property at 34th Street & Ideal Avenue Planning Director Just presented proposed amendments to the City's comprehensive plan to expand the MUSA Boundary and other relevant sections to allow for development of the property at 34' Street and Ideal Avenue. Councilmemberporschner, seconded by Councilmember Beckstrom, moved TOADOPTA RESOL UTIONAPPRO VING THE SUBJECT AMENDMENTS TO THE FUTURE LAND USE PLAN RE- GUIDING APPROXIMA TEL Y I10 ACRES OF CITY -OWNED LAND LOCATED NORTH OF34TH STREET AND EAST OF IDEAL AVENUE TO THE LAND USE DESIGNATIONS LISTED IN THE LISTED FINDINGS, BASED ON THE RECOMMENDED FINDINGS AND CONDITION OFAPPROVAL. Motion passed 5-0. Councilmember McGinn, seconded by Councilmember Dorschner, moved TO ADOPT A RESOL UTION APPRO VING THE NECESSARYAMENDMENTS TO THE 2040 LAKE ELMO COMPREHENSIVE PLAN (INCLUDING THOSE TO THE LAND USE PLAN, MUSA BO UNDARIES AND WASTEWATER SERVICES PLAN) TO ADD THE APPROXIMATELY 110 ACRES OF CITY OWNED LAND LOCATED NORTH OF 34TH STREET AND EAST OF IDEAL AVENUE TO THE CITY'S SANITARY SEWER AREA AND AUTHORIZE CITY STAFF TO SUBMIT THE PROPOSED COMPREHENSIVE PLANAMENDMENTS TO THE METROPOLITAN COUNCIL. ITEM 17: Zoning Code Text Amendments: Fencing, Swimming Pools and Screening Page 3 of 5 LAKE ELMO CITY COUNCIL MINUTES June 7, 2022 Planning Director Just presented proposed zoning code text amendments that would provide transparency and clarity in the areas of fencing, impervious surface and required screening. Discussion was held regarding fencing and the need for the City to be able to access infrastructure for maintenance and repairs. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO APPROVE THE AMENDMENTS TO ZONING CODE SECTION 400 FENCING REGULATIONS AS PROPOSED BY CITY STAFF WITHAN UPDATE TO THE LANGUAGE STATING "ANY CITY OWNED PHYSICAL INFRASTRUCTURE" Motion passed 5 — 0. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO RECOMMEND APPROVAL OF THEAMENDMENTS TO THE BUILDING REGULATIONS CODE SECTION 160 SWIMMING POOLS GENERALLYAS PROPOSED BY CITYSTAFF. Motion passed 5 — 0. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO RECOMMEND APPROVAL OF THE AMENDMENTS TO ZONING CODE SECTION 040 REQUIRED SCREENING AS PROPOSED BY CITY STAFF. Motion passed 4-1 (Dorschner— nay). Mayor Cadenhead, seconded by Councilmember Holtz, moved TO APPROVE SUMMARY PUBLICATION OF ORDINANCE 2202-05 (THE ZONING ORDINANCE AMENDMENTS) WITHAPPROVAL OFRESOLUTION2022-061. Motion passed 5 — 0. COUNCIL REPORTS Councilmember Beckstrom: Thanked Administrator Handt for her work with the Legislature on water issues. Councilmember Dorschner: Would like Council to discuss ordinances that refer to impervious surfaces at a worksession. Councilmember Holtz: Reported on new hangars and runway improvements at the Lake Elmo Airport. Councilmember McGinn: Thanked Washington County for considering resident concerns regarding the timing of the traffic lights at 50' Street/Inwood. STAFF REPORTS AND ANNOUNCEMENTS City Clerk Johnson: Reported on upcoming election judge training. Public Works Director Powers: Reported on crack filling in progress.
