CITY COUNCIL MINUTES
OCTOBER 4, 2022
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Cadenhead called the meeting to order at 7:00 pm.
PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Dale Dorschner,
Jeff Holtz and Lisa McGinn.
Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Public Works
Director Powers, Planning Director Just, City Planner Hetzel and City Clerk Johnson
APPROVAL OF AGENDA
Mayor Cadenhead, seconded by Councilmember Dorschner, moved TO AMEND THE
AGENDA TO MOVE ITEM 11, "LOADER PURCHASE" TO THE SECOND ITEM ON THE
REGULAR AGENDA AND MOVE ITEM 8, "SCHILTGEN FARMSTEAD PRELIMINARY
PLATPUD & ZONINGMAPAMENDMENT" TO THEEND OF THE REGULAR AGENDA.
Motion passed 5 — 0.
Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE THE
AGENDA AS AMENDED. Motion passed 5 — 0.
ACCEPT MINUTES
Councilmember Dorschner, seconded by Councilmember Holtz, moved TO ACCEPT THE
MINUTES OF THE SEPTEMBER 20, 2022 CITY COUNCIL MEETING AS PRESENTED.
Motion passed 5 — 0.
PUBLIC COMMENTS/INQUIRIES
Tony Manzara, 5050 Kirkwood Ave. N. invited the Council to the Buckthorn Removal Festival
in Sunfish Lake Park on Saturday, October 22"d
Susan Dunn, 11018 Upper 33'd St. N., thanked the Mayor for participating in the Veterans Day
Prayer Breakfast, commented on trees that have died on Lake Elmo Avenue, commented on the
recent passing of three longtime residents and suggested that the planning staff review the
development tracking spreadsheet for development that has been approved but not yet built.

Councilmember Holtz, seconded by Councilmember Dorschner, moved TO APPROVE THE
CONSENT AGENDA AS PRESENTED. Motion passed 5 - 0.
ITEM 7: 10212 Stillwater Lane N. Variance Request
City Planner Hetzel presented a request for a variance to allow installation of a replacement septic
system less than 75 feet from a wetland due to lot limitations. Planner Hetzel noted that the Valley
Branch Watershed District approved the application and the Planning Commission also
recommended approval.
Councilmember Dorschner, seconded by Councilmember Holtz, moved Motion to approve
Resolution No. 2022-087, approving a variance with conditions to install a sewage treatment
system and septic tanks within 75 feet of a delineated wetland boundary at 10212 Stillwater
Lane N.. Motion passed 5 — 0.
ITEM 11: Loader Purchase
Public Works Director Powers reviewed the bids received and staff recommendation for
purchase of a loader and retention of the old loader. Councihnember Dorschner stated that the
old loader should be sold.
Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO APPROVE
THE PURCHASE OF THE JOHNDEERE 524P WHEEL LOADER AND PLOWS FOR AN
AMOUNT NOT TO EXCEED $235,000. Motion passed 3 —1-1. (Dorschner — nay,
Cadenhead — abstain)
ITEM 9: Kororo Volleyball CUP and Variance
City Planner Hetzel reviewed the application for construction of an indoor volleyball facility at
the intersection of 391h Street N. and Lake Elmo Avenue N. and the request for a variance to
allow one access onto a public street versus two as required by city code. Applicant Raymond
Luczak provided information on the operations of the proposed facility and addressed concerns
regarding parking and the number of events held each year.

Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE
RESOL UTION NO. 2022-089, APPR0VINGA CONDITIONAL USE PERMIT WITH
CONDITIONS FOR AN INDOOR ATHLETIC FACILITY AT THE PROPERTY
DESCRIBED AS BROOKMAN 3RD ADDITION, LOT 1, BLOCK L Motion passed 5 — 0.
Councilmember Dorschner, seconded by Councilmember Holtz, moved TO APPROVE
RESOLUTIONNO. 2022-090, APPROVING A VARIANCE TO ALLOW ONE ACCESS
ONTO A PUBLIC STREET WHERE A MINIMUM OF TWO ARE REQUIRED AT THE
PROPERTY DESCRIBED AS BROOKMAN 3" ADDITION, LOT 1, BLOCK 1.
ITEM 10: 2023 LMCIT Renewal
City Administrator Handt provided an overview of the League of Minnesota Cities insurance
renewal.
Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO APPROVE
MAINTAINING THE CURRENT $1,000 DEDUCTIBLE FOR THE CITY'S PROPERTY
AND LIABILITYINSURANCE, AND AUTHORIZE ELECTION TO NOT WAIVE THE
STATUTORY TORT LIMITS. Motion passed 5 — 0.
ITEM 8: Shiltgen Farmstead Preliminary Plat PUD & Zoning Map Amendment
Planning Director Just presented an overview of the proposed development, noting setbacks on
individual lots, density and proximity to shoreland. Director Just also noted amenities included
in the proposal.
Craig Allen, Chase Development, commented on proposed setbacks, density and the style of the
proposed development on the south side of Stillwater Boulevard.
Susan Dunn, 11018 Upper 33`d St. N., stated that the plan does not match the character of the
surrounding homes south of Stillwater Boulevard and added that the elementary school is
overcrowded and expressed safety concerns.
Councilmember McGinn, seconded by Councilmember Beckstrom, MOVED TO APPROVE
THE REZONING OF THE SUBJECT PROPERTYAS REQUESTED BY GWSA LAND
DEVELOPMENT, LLC FROMRT (RURAL TRANSITIONAL) TO V-LDR (VILLAGE LOW
DENSITYRESIDENT)4L) BASED ON THE FINDINGS LISTED IN THE STAFF
REPORT. Motion passed 5 — 0.
Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO APPROVE
THE PUD PLAN AND PRELIMINARYPLATAS REQUESTED BY GWSA LAND
DEVELOPMENT, LLC FOR THE SUBJECT PROPERTY BASED ON THE FINDINGS OF

FACT AND RECOMMENDED CONDITIONS OF APPROVAL LISTED IN THE STAFF
REPORT.
Councilmember Holtz, seconded by Councilmember Dorschner, moved TO AMEND THE
PRIMARY MOTION TO REMOVE THE SECOND CHART IN THE RESOLUTION OF
APPROVAL.
Mayor Cadenhead, seconded by Councilmember Holtz, moved TO TABLE ITEM 8,
SHILTGEN FARMSTEAD PRELIMINARY PLAT PUD & ZONING MAP AMENDMENT.
Motion passed 5 — 0.
STAFF REPORTS AND ANNOUNCEMENTS
Administrator Handt: Reported that interviews will begin next week for the Administrative
Services Director position and asked for an additional Councilmember to assist with next round
interviews at the end of October.
City Planner Hetzel: Reported on action taken at the Parks Commission on the Ivywood Circle
parking issue.
CLOSED SESSION
Councilmember Dorschner, seconded by Councilmember Holtz, moved TO ADJOURN TO
CLOSED SESSION PURSUANT TO MINNESOTA STATUTES SECTION 13D. 05,
SUBDIVISION 3 (B), ATTORNEY -CLIENT PRIVILEGE TO REVIEW THREATENED
LITIGATIONBYNORTHPOINT DEVELOPMENT, LLC. Motion passed 5-0.
Closed session held.
Councilmember McGinn, seconded by Councilmember Holtz, moved to return to open session.
Motion passed 5 — 0.
