PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Dale Dorschner, Jeff Holtz and Lisa McGinn. Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Public Works Director Powers, Fire Chief Kalis and City Clerk Johnson APPROVAL OF AGENDA Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE THE AGENDA AS PRESENTED. Motion passed 5 — 0. ACCEPT MINUTES Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO ACCEPT THE MINUTES OF THE OCTOBER 11, 2022 CITY COUNCIL WORKSESSION AND THE OCTOBER 18, 2022 CITY COUNCIL MEETINGAS PRESENTED. Motion passed 5 — 0. PUBLIC COMMENTS/INQUIRIES Mairlynn Kennedy, 9051 Jane Road North, stated that poles in her front yard that were installed to protect her drain field were removed by the city and requested a resolution to the issue. Kelsey Delaney, 4853 Lilac Place North, commented in opposition of no parking signs being installed in Fields of St. Croix neighborhood. Laurel Gunderson, 4835 Lilac Place North, commented in opposition of no parking signs being installed in Fields of St. Croix neighborhood. David Hanson, 4955 Lilac Way North,, commented in opposition of no parking signs being installed in Fields of St. Croix neighborhood, stating there are too many signs for the area. Monique Giordano, 4979 Lilac Way North, commented in opposition of no parking signs being installed in Fields of St. Croix neighborhood. LAKE ELMO CITY COUNCIL MINUTES November 1, 2022 PRESENTATIONS Mayor Cadenhead congratulated Lake Elmo Firefighter Chris Supan on his retirement from the Fire Department and presented him with an award recognizing his years of service on the department. ITEM 17: Accept Feasibility Report, Call for Hearing on Improvements, and Authorize Preparation of Plans and Specifications for the Old Village Phase 7 Street and Utility Improvements City Engineer Griffin presented an overview of the proposed work to be done in the Old Village Phase 7 Street and Utility Improvements project. Discussion was held regarding prior assessments in the project area and properties to be included. Councilmember McGinn, seconded by Councilmember Holtz, moved TO APPROVE RESOLUTIONNO. 2022-100, RECEIVING THE FEASIBILITYREPORT, CALLINGA PUBLIC HEARING, AND AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE OLD VILLAGE PHASE 7 STREETAND UTILITY IMPROVEMENTS. Motion passed 5 — 0. ITEM 18: Preliminary Plat/PUD, Comprehensive Plan & Zoning Map Amendment — United Properties — Amira Lake Elmo Page 2 of 4 LAKE ELMO CITY COUNCIL MINUTES November 1, 2022 Planning Director Just presented the request for a PUD and plat amendment, Comprehensive Plan amendment and a zoning map amendment to allow for construction of a 103 unit senior housing rental building at the intersection of Hudson Road and Eagle Point Boulevard. Alex Hall, United Properties, presented a project overview of the proposed facility and amenities and also discussed similar properties owned by United Properties in other Twin Cities locations. Discussion was held; Councilmember Dorschner expressed concern regarding the density of the project. Councilmember McGinn, seconded by Councilmember Holtz, moved TO APPROVE RESOLUTIONNO. 2022-102, APPROVING A COMPREHENSIVE PLANAMENDMENT FROMMU-BP (MIXED USE BUSINESS PARK) TO HDR (HIGHDENSITY RESIDENTIAL, A PRELIMINARYPUD PLANAMENDMENT, AND A PRELIMINARY PLATAMENOMENT FOR THE SITE OF THEAMIRA OFLAKE ELMO ON THE CORNER OF HUDSONBOULEVARD AND EAGLE POINTE BOULEVARD. THIS AMENDMENT IS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT AND SUBJECT TO THE CONDITIONLISTED IN THE STAFFREPORT. Motion passed 4 —1. (Dorschner — nay) Councilmember Holtz, seconded by Councilmember McGinn, moved TO ADOPT ORDINANCE NO. 2022-14, APPROVING A ZONING MAP AMENDMENT FROM MU -BP (MIXED USE BUSINESS PARK) TO HDR (HIG11DENSITYRESIDENT)4L) FOR THE AMIRA OF LAKE ELMO DEVELOPMENT ON THE CORNER OF HUDSON BOULEVARD AND EAGLE POINTE BOULEVARD. THISAPPROVAL WILL BE SUBJECT TO THE CITYAMENDING THE COMPREHENSIVE PLAN FOR THIS SITE AND IS BASED ON THE FINDINGS LISTED IN THE STAFFREPORT. Motion passed 4 —1. (Dorschner — nay) ITEM 19: Final Plat & Final PUD — DPS Lake Elmo 3r1 Addition - 9450 Hudson Boulevard — SRD 2.0 LLC Planning Director Just provided an overview of the request and noted that the request to approve the PUD has been removed and will be presented at a later time with the development agreement. Discussion held regarding the language in the proposed resolution. Councilmember Dorschner stated opposition to high density development and splitting the lot. Councilmember Holtz, seconded by Councilmember McGinn, moved TO ADOPT RESOLUTION 2022-103 APPROVING THE DPS LAKE ELMO 3RD ADDITION FINAL PLAT & PUD BASED ON THE FINDINGS OF FACT AND CONDITIONS OUTLINED IN THE STAFFREPORT WITHAMENDMENT TO FINDINGS 3, S, 6 AND 7 REPLACING "GENERALLY COMPLIES" WITH "CONSISTENT". STAFF REPORTS AND ANNOUNCEMENTS City Clerk Johnson: Provided absentee/early voting reminders. Fire Chief Kalis: Thanked Arbor Glen for their fundraiser donation to the fire department and reported on paid on call firefighter recruitment. City Engineer Griffin: Reported on neighborhood meetings scheduled for the 2023 Streets project and Old Village Phase 7.
