CITY COUNCIL MINUTES
NOVEMBER 15, 2022
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Cadenhead called the meeting to order at 7. 00 pm.
PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Dale Dorschner,
Jeff Holtz and Lisa McGinn.
Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Public Works
Director Powers, Planning Director Just and City Clerk Johnson
APPROVAL OF AGENDA
Councilmember Holtz, seconded by Mayor Cadenhead, moved TO AMEND THEAGENDA TO
MOVE ITEM S, "APPROVE CODE TEXT AMENDMENTS TO REMOVE QUORUM
REQUIREMENTS FOR COMMISSIONS" TO THE BEGINNING OF THE REGULAR
AGENDA. Motion passed 5 — 0.
Mayor Cadenhead, seconded by Councilmember Dorschner, moved TO APPROVE THE
AGENDA AS AMENDED. Motion passed 5-0.
ACCEPT MINUTES
Councilmember McGinn, seconded by Councilmember Holtz, moved TO ACCEPT THE
MINUTES OF THE NOVEMBER 1, 2022 CITY COUNCIL MEETING AS PRESENTED.
Motion passed 5 — 0.

Councilmember Holtz, seconded by Councilmember Dorschner, moved TO APPROVE THE
CONSENT AGENDA AS PRESENTED. Motion passed 5- 0.
ITEM 5: Approve Code Text Amendments to Remove Quorum Requirements for
Commissions
Brief discussion held regarding the proposed update to remove quorum requirements and allow
case law to govern this issue.
Councilmember Dorschner, seconded by Councilmember McGinn, moved TO ADOPT
ORDINANCE N0.2022-15 AND TO ADOPT RESOL UTION NO. 2022-104 A UTHORIZING
PUBLICA TIONBY TITLE AND SUMMARY. Motion passed 5 — 0.
ITEM 18: Public Improvement Hearing: Order Improvements and Preparation of Plans and
Specifications for the 2023 Street Improvements
City Engineer Griffin presented the current condition of the streets in the project area and the
proposed improvements, including parking standards. Anticipated project costs, findings and
recommendations were also presented. Discussion was held concerning parking.
Emily Nesse, 11609 44th Street North, commented on maintaining the aesthetics of the
neighborhood and balancing that with public safety.
Michael Waldspurger, 4335 Lily Avenue North, expressed concern over the legality of an
assessment that does not increase the cost of his home.
Jim Bauer, 11730 44th Street North, stated he prefers rolled curbs that are friendly to the wildlife
in the area and commented on no parking signs.

Kristin Berger, 4703 Lily Avenue North, commented on curbs and no parking signs.
Councilmember Dorschner, seconded by Councilmember Holtz, moved TO CLOSE THE
PUBLIC HEARING. Motion passed 5 — 0.
Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO ADOPT
RESOLUTION NO. 2022-105 ORDERING THE 2023 STREET IMPROVEMENTS AND
THE PREPARA TION OF PLANS AND SPECIFICA TIONS FOR THE RECOMMENDED
STREET AND DRAINAGE IMPROVEMENTS AS OUTLINED IN THE FEASIBILITY
REPORT ACCEPTED ON OCTOBER 18, 2022. Motion passed 5-0.
Councilmember McGinn, seconded by Councilmember Holtz, moved TO APPROVE A
PROFESSIONAL ENGINEERING DESIGN AND CONSTR UCTION SUPPORT
SER VICES CONTRACT TO BOLTON & MENK, INC IN THE NOT TO EXCEED
AMOUNT OF $181,856, AND APPROVE A GEOTECHNICAL SERVICES DESIGN
BUDGET INA NOT TO EXCEED AMOUNT OF $30,000 FOR THE 2023 STREET
IMPROVEMENTS Motion passed 5 — 0.
ITEM 19: Halcyon Cemetery Stormwater Auueal
City Administrator Handt presented a brief overview of the request from Halcyon Cemetery for a
75% reduction in its stormwater utility billing rate.
Lee Rossow, Halcyon Cemetery, stated that the stormwater fees would cripple the organization
over time if not reduced as he requested and that water does not leave the property.
Councilmember McGinn, seconded by Councilmember Beckstrom, MOVED TO APPROVE A
25 % RED UCTION IN THE STORMWA TER FEE FOR HAL YCON CEMETER Y,11050
50TH ST, FOR 2022 AND CONDITION THE 25 % REDUCTION FOR FUTURE YEARS
UPON MEETING THE REQUIREMENTS AS NOTED IN THE CITY ENGINEER'S
MEMO DATED NOVEMBER 8, 2022. Motion passed 4 —1. (Holtz— nay)
Councilmember Holtz stated he did not support the reduction because the fees exist for a purpose
and he doesn't want to set a precedence.
ITEM 20: Canvass November 8, 2022 Election Results
City Clerk Johnson presented the results of the 2022 General Election as received from
Washington County.
Mayor Cadenhead, seconded by Councilmember Holtz, moved TO ADOPT RESOL UTION
2022-106 CANVASSING THE RESULTS OF THE 2022 GENERAL ELECTION. Motion
passed 5 — 0.

ITEM 21: November 1, 2022 Closed Session Summary
Mayor Cadenhead read a statement summarizing the closed session held for the City
Administrator's performance review.
COUNCIL REPORTS
Councilmember Holtz: Reported on the 3M settlement group upcoming meeting.
STAFF REPORTS AND ANNOUNCEMENTS
Administrator Handt: Noted that preparations have begun at Tablyn Park for the SAFF
equipment.
Closed Session
Councilmember Dorschner, seconded by Councilmember McGinn, moved TO ENTER
CLOSED SESSION PURSUANT TO MINNESOTA STATUTES SECTION 13D.05,
SUBDIVISION 3 (B), ATTORNEY -CLIENT PRIVILEGE TO REVIEW LITIGATION
WITH CEF LAKE ELMO COMMUNITY SOLAR LLC. Motion passed 5 - 0.
Closed session held.
Councilmember McGinn, seconded by Councilmember Holtz, moved TO RETURN TO OPEN
SESSION. Motion passed 5 — 0.
