BACKGROUND: A-1 Excavating, Inc. was awarded a construction contract on May 5, 2020 to complete the Stonegate Addition Street & Utility Improvements. The watermain installation is complete and property owners are in the 1-year period for making connection to the public drinking water system. The street reclaim has also been completed including both the base and wear course pavements, however, restoration work remains incomplete. The work was discontinued for the winter months and has resumed this spring. The contractor did not meet the substantial completion date of October 3, 2020, which includes all restoration work and punch list items, or meet the final completion date of November 13, 2020, which includes final payment and all close out documentation. By not completing the work within the required contract times for the project, the contractor is subject to liquidated damages per the contract. PROPOSAL DETAILS/ANALYSIS: A-1 Excavating, Inc. has submitted Partial Pay Request No. 6 in the amount of $24,821.60. The request has been reviewed and payment is recommended in the amount requested. In accordance with the contract documents, the City has retained 5% of the total work completed. The amount retained is $126,312.45. FISCAL IMPACT: None. Partial payment is proposed in accordance with the Contract for the project. Payment remains within the authorized scope and budget. RECOMMENDATION: Staff is recommending that the City Council approve, as part of the Consent Agenda, Pay Request No. 6 for the Stonegate Addition Street and Utility Improvements. If removed from the consent agenda, the recommended motion for the action is as follows: “Move to approve Pay Request No. 6 to A-1 Excavating, Inc. in the amount of $24,821.60 for the Stonegate Addition Street and Utility Improvements”.
