PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Dale Dorschner, Jeff Holtz and Lisa McGinn. Motion passed 5 - 0. ITEM 25: Tapestry Sanitary Sewer Extension Public Improvement Hearing City Engineer Griffin presented the project scope and proposed costs. Councilmember Dorschner, seconded by Councilmember Holtz, moved TO OPEN THE PUBLIC HEARING. Motion passed 5 – 0. Pam Hartley, 10010 Tapestry Rd., stated that volunteers have put in a lot of time to keep the current system up and running and requested Council approval of this project. Brian Coady, 10325 Tapestry Bend, spoke as HOA President for the Tapestry neighborhood and requested Council approval of the project. David Osten, 9901 Tapestry Grove, stated that the existing septic system is in trouble and connecting to the City’s sewer system is the best solution. Councilmember Dorschner, seconded by Councilmember Holtz, moved TO CLOSE THE PUBLIC HEARING. Motion passed 5 – 0. LAKE ELMO CITY COUNCIL MINUTES November 16, 2021 Page 3 of 5 Councilmember Dorschner, seconded by Councilmember Holtz, moved TO ADOPT RESOLUTION NO. 2021-123 ORDERING THE IMPROVEMENTS AND TO CONTINUE WITH THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE TAPESTRY SANITARY SEWER EXTENSION AS OUTLINED IN THE FEASIBILITY REPORT ACCEPTED ON OCTOBER 19, 2021. Motion passed 5 – 0. Councilmember Dorschner, seconded by Councilmember Holtz, moved TO APPROVE SANITARY SEWER CLEANING AND INSPECTION SERVICES BY HYDROVAC, INC. IN THE NOT TO EXCEED AMOUNT OF $23,526.01 AND TO APPROVE A GEOTECHNICAL SERVICES CONTRACT TO AET, INC. IN THE NOT TO EXCEED AMOUNT OF $10,500.00. Motion passed 5 – 0. ITEM 26: City Comments on Washington County Draft 2022-2026 CIP City Engineer Griffin reviewed proposed comments on the county’s draft capital improvement plan. Councilmember Dorschner, seconded by Councilmember Holtz, moved TO APPROVE CITY COMMENTS TO BE SUBMITTED TO WASHINGTON COUNTY REGARDING THE COUNTY’S 2022-2026 CAPITAL IMPROVEMENT PLAN WITH COMMENTS TO BE SUBMITTED ON OR BEFORE NOVEMBER 19, 2021. Motion passed 5 – 0. ITEM 27: No Parking Signage Plans in Hamlet on Sunfish Lake, Whistling Valley and Torre Pines Neighborhoods City Engineer Griffin presented plans for parking restrictions based on input from residents and staff review. Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE RESOLUTION NO. 2021-130, APPROVING THE PARKING RESTRICTION PLANS FOR THE PUBLIC STREETS WITHIN THE HAMLET ON SUNFISH LAKE, WHISTLING VALLEY AND TORRE PINES NEIGHBORHOODS. Motion passed 5 – 0. ITEM 28: Krueger Tree Farm IUP Planning Director Just presented the application for an amendment to the Krueger Christmas Tree Farm interim use permit to add a new barn for Christmas tree sales and to allow a photography business on the to operate on the property. LAKE ELMO CITY COUNCIL MINUTES November 16, 2021 Page 4 of 5 Steve Pott, 4212 Lake Elmo Avenue, commented on the parking at the site and expressed concern about the size of the operation and traffic. Mr. Pott requested that the Council delay a decision until after the current sale season. Applicants John & Neil Krueger addressed concerns regarding traffic and parking at the site and hours of operation for the photography business. Councilmember Holtz, seconded by Mayor Cadenhead, moved TO APPROVE RESOLUTION 2021-128 APPROVING THE AMENDMENT TO THE IUP FOR AGRICULTURAL SALES WITH ELEVEN CONDITIONS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT. Councilmember Beckstrom, seconded by Councilmember McGinn, moved TO POSTPONE FURTHER CONSIDERATION UNTIL THE JANUARY 4, 2022 CITY COUNCIL MEETING. Motion approved 3 – 2. (Cadenhead, Holtz – nay) Councilmember McGinn, seconded by Mayor Cadenhead, moved TO APPROVE RESOLUTION 2021-129 APPROVING THE IUP FOR THE AGRICULTURAL ENTERTAINMENT BUSINESS TO ALLOW PROFESSIONAL PHOTOGRAPHY SESSIONS ON THE SITE WITH FOURTEEN CONDITIONS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT WITH A CHANGE TO CONDITION 3 LIMITING PHOTOGRAPH TO JANUARY – NOVEMBER 15TH; AMDING CONDITION 14 TO STATE THAT THE IUP WILL EXPIRE IN 2042; AND STRIKING CONDITION 4 LIMITING THE NUMBER OF PHOTOGRAPHY SESSIONS AND PARTICIPANTS. Motion passed 5 – 0. ITEM 29: Order for AUAR for 180 Acres on Ideal Avenue City Administrator Handt reviewed the order for an AUAR for the city owned property on Ideal Avenue necessary for the proposed warehouse development. Councilmember Dorschner, seconded by Councilmember McGinn, moved TO APPROVE RESOLUTION NO 2021-125, A RESOLUTION ORDERING THE PREPARATION OF AN ALTERNATIVE URBAN AREAWIDE REVIEW (AUAR) FOR THE STUDY AREA TO BE KNOWN AS CYPHERS LOGISTICS PARK. Motion passed 5 – 0. ITEM 30: Closed Session Summary Mayor Cadenhead read a summary of the closed session held at the November 13, 2021 City Council meeting. COUNCIL REPORTS Mayor Cadenhead: Attended Veterans Day Prayer Breakfast LAKE ELMO CITY COUNCIL MINUTES November 16, 2021 Page 5 of 5 Councilmember McGinn: Attended neighborhood watch meeting, thanked Deputy Ostertag for his help and presentation at the meeting. STAFF REPORTS AND ANNOUNCEMENTS Administrator Handt: Announced commission and committee openings, attended the Lake Elmo Avenue/TH36 open house, attended meetings with other communities affected by White Bear Lake water issues. City Clerk Johnson: Reported new city code is now available on the website. Planning Director Just: Anticipates Applewood Pointe preliminary plat extension at the December 7th meeting. City Engineer Griffin: 2022 construction projects are out for bid and will have Torre Pines and Whistling Valley public hearings at the next meeting. Fire Chief Kalis: Asked residents to be mindful of cooking to prevent cooking related fires. Meeting adjourned at 10:00 pm.
