BACKGROUND: The City of Lake Elmo is extending sanitary sewer to serve the existing properties in the Old Village MUSA area to replace the use of private on-site sewage treatment systems. The Old Village Capital Improvement projects also include drainage improvements to continue addressing historic flooding issues in the Downtown area, the replacement of aged watermain pipes and reconstructing the public streets that are disturbed during the work. The Improvements are being constructed in phases and through separate projects. The first six phases were constructed in 2015, 2016, 2017, 2018, 2021 and 2022. The final phase of the Old Village Capital Improvement Plan, Phase 7, is programmed for construction in 2023. PROPOSAL DETAILS/ANALYSIS: The Old Village Phase 7 Street and Utility Improvements includes the extension of public sanitary sewer to serve the existing 24 platted properties located along Legion Avenue, south of 30th Street (see attached location map). The extension of sanitary sewer service will likely require a sanitary lift station as part of the project. The sewer service is intended to replace the use of private individual on‐site sewage treatment systems and the Old Village Remote A 201 Community Wastewater Treatment System. The city owned 201 system currently serves 9 of the existing 24 properties. The project work scope includes the replacement of the aged existing 6‐inch watermain along Legion Avenue, from 30th Street to the south end, and potentially the 6‐inch watermain connection to the adjacent Heritage Farms subdivision. The project work scope also includes street and drainage improvements necessary to reconstruct the public streets and to restore the disturbed corridor, and in accordance with watershed permitting requirements. The street segment of Legion Avenue was last paved in 2009 and is in relatively good condition. On June 21, 2022 the council authorized engineering services for the preliminary design of the project, including detailed topographic survey and determination of building low floor elevations. The preliminary design work will be fully utilized in the preparation for the feasibility report, including the improvement recommendations and preliminary cost estimates. In order to assess all or a portion of the improvements, the council must authorize the preparation of a feasibility report as required by the statutory process for public improvements that are specially assessed. The feasibility report will advise on the scope of recommended improvements; provide estimated project costs; identify easement and right-of-way, permits and other requirements of other local agencies needed to implement the improvements; recommend whether the improvements should be best made as proposed or in connection with some other improvement; and advise if the improvements are necessary, cost effective, and feasible. The report will also provide a proposed preliminary assessment roll for each of the benefitting properties based upon the City’s Special Assessment Policy for Local Improvements. A project schedule for the Old Village Phase 7 Street and Utility Improvements is attached and outlines the implementation timeframe necessary to ready the improvements for construction in 2023. FISCAL IMPACT: $8,600. If authorized, FOCUS Engineering Inc., will prepare a feasibility report in the not to exceed amount of $8,600 for the Old Village Phase 7 Street and Utility Improvements. If the improvements are ordered, the report costs will be charged against the project fund and become assessable to the benefitting properties. Should the project not be constructed, the report and survey costs cannot be assessed. RECOMMENDATION: Staff is recommending that the City Council approve a Resolution Ordering Preparation of a Feasibility Report for the Old Village Phase 7 Street and Utility Improvements. If removed from the consent agenda, the recommended motion for this action is as follows: “Move to approve Resolution No. 2022-081, Ordering preparation of a Feasibility Report to be completed by FOCUS Engineering in the not to exceed amount of $8,600 for the Old Village Phase 7 Street and Utility Improvements.” ATTACHMENTS: 1. CITY OF LAKE ELMO WASHINGTON COUNTY STATE OF MINNESOTA RESOLUTION NO. 2022-081 A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT FOR THE OLD VILLAGE PHASE 7 STREET AND UTILITY IMPROVEMENTS WHEREAS, the City is extending sanitary sewer to serve the existing properties in the Old Village Municipal Urban Service Area to replace the use of private on-site sewage treatment systems; and WHEREAS, the City approved the Old Village Capital Improvement Program in September 2016 to address the phasing plan for these improvements with the first six phases being constructed in 2015, 2016, 2017, 2018, 2021 and 2022; and WHEREAS, the final phase of the Old Village Capital Improvement Plan, Phase 7, including the extension of sanitary sewer along Legion Avenue, south of 30th Street, is programmed for construction in 2023; and WHEREAS, the Old Village Capital Improvement projects also include drainage improvements to continue addressing historic flooding issues in the Downtown area, the replacement of aged watermain pipes and reconstructing the public streets that are disturbed during the work; and WHEREAS, it is proposed to assess the benefiting properties for all or a portion of the cost of the improvement, pursuant to the City’s Special Assessment Policy and Minnesota Statues, Chapter 429. NOW, THEREFORE, BE IT RESOLVED, That the proposed improvement, called the Old Village Phase 7 Street and Utility Improvements, be referred to the City Engineer and FOCUS Engineering, to complete a feasibility report in accordance with Minnesota Statues, Chapter 429 for the proposed improvements, and to report to the council with all convenient speed advising the council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible; whether it should be best made as proposed or in connection with some other improvement; the estimated cost of the improvement as recommended; and a description of the methodology used to calculate individual assessments for affected parcels.
