INTRODUCTION:
Greg Johnson of Hearth Development, LLC recently submitted a final plat application for Outlot A of the Inwood Sixth Addition subdivision. Outlot A is also known as 8607 5th Street N (PIDs 3302921130027). The application also requires a preliminary plat extension. The proposed final plat would facilitate the conversion of 1.9 acres of commercially zoned land from a outlot to a
buildable lot to allow the construction of a multi-use commercial building that would house a
nail salon and a restaurant. Lake Elmo requires outlots to be replatted before they can be developed and built upon. The proposed nail salon and restaurant are permitted by right in the Commercial zoning district. No change of property lines are part of this proposal.

History
o The preliminary plat/PUD plans were approved on December 2, 2014. o The final plat/PUD plans and zoning map amendments for the development of Inwood was approved on May 19, 2015. The subject property was initially platted as part of a larger 9.9
acre Outlot, known as Outlot O, Plat of Inwood.
o Outlot O remained untouched until October 15, 2019 when a minor subdivision (Inwood Sixth Addition) was approved to subdivide Outlot O into the following three lots – Lot 1, Block 1 – 2.27 acres; Outlot A – 1.90 acres (subject property) and Outlot B- 5.72 acres. The minor subdivision was required to facilitate the transfer of 2.27 acres of land to Kwik Trip
for the construction of the fuel station/convenience store on Lot 1.
o The Development Agreement of Inwood Sixth Addition established a preliminary plat expiration date of December 2, 2019; therefore, a preliminary plat extension is also part of this application.

Consistency with Preliminary Plat The proposed final plat is generally consistent with the preliminary plat that was approved on December 2, 2014. The approved preliminary plat shows the subject property as part of Outlot H for future commercial development. Outlot H has been platted as two commercial lots with the
minor subdivision of Inwood Sixth Addition. Although separate, the two separate commercial
lots combined maintain the same land use and size intended by the preliminary plat.
Inwood PUD Flexibility
The flexibility requested through the Inwood PUD was directly related to the Low Density residential phases north of 5th Street N. The flexibility from code standards was not requested for the Commercial and High Density Residential properties.

which is the subject of the proposed final plat.

Park Dedication The preliminary plat and PUD approval requires the developer to reach an agreement with the City to determine the appropriate park dedication calculations for a final plat submission for any portion of the Inwood development. The park dedication requirement for this property has not
been satisfied by any of the other Inwood additions.
For nonresidential developments, the City requires a payment in lieu of land dedication as established by resolution of the City Council. The current fee for development within a commercial zoning district is $6,000 per acre. The total fee to the applicant would be $11,400 to satisfy the City’s park land dedication requirements. The charge was calculated as follows:
$6,000 x 1.90 acres = $11,400.
Applicable Preliminary Plat Conditions The following explains how preliminary plat conditions have been met. Some conditions in the preliminary plat and PUD approval are applicable to this final plat application.
1. The applicant shall work with Community Development Director to name all streets in
the subdivision in a manner acceptable to the City prior to the submission of final plat.
No new streets are being proposed or shown on the final plat.
2. Prior to the submission of a final plat for any portion of the Inwood PUD, the developer shall reach an agreement with the City to determine the appropriate park dedication calculations for the entire development. The total fee to the applicant is $11,400 to
satisfy the park dedication requirements.
3. Prior to recording the final plat for any portion of the area shown in the preliminary plat, the developer shall enter into a Developers Agreement acceptable to the City Attorney that delineates who is responsible for the design, construction, and payment of public improvements. City staff have already begun working on a Site Improvement
Agreement with the City Attorney.
REVIEW COMMENTS City Engineer The City Engineer’s review memo dated October 14, 2022 is attached to this report for review.
Fire Department The Fire Chief’s review memo dated October 7, 2022 is attached to this report for review.
Landscape Architect The City’s Landscape Architect’s review memo dated October 14, 2022 is attached to this report for review.
RECCOMMENDED FINDINGS 1. That all the requirements of City Code Section 103.00.100 have been met by the
applicant. 2. That the Final Plat for Inwood Seventh Addition consists of replatting Outlot A of Inwood Sixth Addition to construct a multi-use commercial building.

3. That the Inwood Seventh Addition Final Plat is generally consistent with the Preliminary Plat as approved by City Council of Lake Elmo on December 2, 2014. 4. That the Inwood Seventh Addition Final Plat is consistent with the intent of the Lake Elmo Comprehensive Plan.
5. That the Inwood Seventh Addition Final Plat generally complies with the City’s
Commercial zoning district.
RECOMMENDED CONDITIONS OF APPROVAL:
1. No construction may begin until the applicant has received City Engineer approval for the final construction plans; the applicant has obtained from the City all applicable
permits, easements and permissions needed for the project; and a preconstruction meeting
has been held by the City’s engineering department. 2. Before the execution and recording of a final plat for the development, the developers shall enter into a Site Improvement Agreement with the City. Such an agreement must be approved by the City Attorney.
3. That prior to the City releasing the final plat for recording, the plans shall be revised to
address the comments in the City Engineer’s memo dated October 14, 2022. 4. That prior to the City releasing the final plat for recording, the plans shall be revised to address the comments in the Landscape Architect’s memo dated October 14, 2022. 5. That prior to the City releasing the final plat for recording, the plat shall be revised to
address the issues identified in the Plat Opinion letter dated November 9, 2022.
6. That the applicant satisfy the $11,400 commercial park dedication fee before the City releases the final plat for recording. 7. All storm water facilities internal to the site shall be privately owned and maintained. A storm water maintenance and easement agreement in a form acceptable to the City shall
be executed and recorded with the final plat.
8. That Outlot B of Inwood Sixth Addition shall be granted full access to the existing commercial driveway off of 5th Street North. 9. If necessary, the applicant shall provide the City with a copy of written permission for any off-site grading work and storm sewer to adjacent properties before starting any site
work.
10. Before the installation or construction of any identification signs, the developer shall submit sign plans to the City for review and obtain a sign permit from the City. 11. That the City does not allow any parking or construction staging, including to loading and unloading of materials and equipment at any time on 5th Street North during the
construction of the site improvements.
12. That the developer records the approved Final Plat with Washington County within 180 days after City Council approval. Failure to record the Final Plat within 180 days of approval will cause the approval to become void.
OPTIONS: The City Council may:
• Approve the requests
• Approve the requests with conditions.
• Deny of the requests, citing findings of fact for denial.

RECOMMENDATION: Staff recommends that City Council approve the final plat of Inwood Seventh Addition and the agreement to extend the preliminary plat status of Inwood.

The contractor shall install temporary earth dikes, sedimenttraps or basins, additional siltation fencing, and/or disk the soil parallel to the contours as deemed necessary to further control erosion. All changesshall be recorded in the SWPPP.4.All construction site entrances shall be surfaced with crushed rock across the entire width of the entrance and from the entrance to a point 50' into theconstruction zone.5.The toe of the silt fence shall be trenched in a minimum of 6”. The trench backfill shall be compacted with a vibratory plate compactor.6.All grading operations shall be conducted in a manner to minimize the potential for site erosion. Sediment control practices must be established on alldown gradient perimeters before any up gradient land disturbing activities begin.7.All exposed soil areas must be stabilized as soon as possible to limit soil erosion but in no case later than 14 days after the construction activity in thatportion of the site has temporarily or permanently ceased. Temporary stockpiles without significant silt, clay or organic components (e.g., cleanaggregate stockpiles, demolition concrete stockpiles, sand stockpiles) and the constructed base components of roads, parking lots and similarsurfaces are exempt from this requirement.8.The normal wetted perimeter of any temporary or permanent drainage ditch or swale that drains water from any portion of the construction site, ordiverts water around the site, must be stabilized within 200 lineal feet from the property edge, or from the point of discharge into any surface water.Stabilization of the last 200 lineal feet must be completed within 24 hours after connecting to a surface water. Stabilization of the remaining portions ofany temporary or permanent ditches or swales must be complete within 14 days after connecting to a surface water and construction in that portion ofthe ditch has temporarily or permanently ceased.9.Pipe outlets must be provided with energy dissipation within 24 hours of connection to surface water.10.All riprap shall be installed with a filter material or soil separation fabric and comply with the Minnesota Department of Transportation StandardSpecifications.11.All storm sewers discharging into wetlands or water bodies shall outlet at or below the normal water level of the respective wetland or water body at anelevation where the downstream slope is 1 percent or flatter. The normal water level shall be the invert elevation of the outlet of the wetland or waterbody.12.All storm sewer catch basins not needed for site drainage during construction shall be covered to prevent runoff from entering the storm sewer system.Catch basins necessary for site drainage during construction shall be provided with inlet protection.13.In areas where concentrated flows occur (such as swales and areas in front of storm catch basins and intakes) the erosion control facilities shall bebacked by stabilization structure to protect those facilities from the concentrated flows.14.Inspect the construction site once every seven days during active construction and within 24 hours after a rainfall event greater than 0.5 inches in 24hours. All inspections shall be recorded in the SWPPP.15.All silt fences must be repaired, replaced, or supplemented when they become nonfunctional or the sediment reaches 1/3 of the height of the fence.These repairs must be made within 24 hours of discovery, or as soon as field conditions allow access. All repairs shall be recorded in the SWPPP.16.If sediment escapes the construction site, off-site accumulations of sediment must be removed in a manner and at a frequency sufficient to minimizeoff-site impacts.17.All soils tracked onto pavement shall be removed daily.18.All infiltration areas must be inspected to ensure that no sediment from ongoing construction activity is reaching the infiltration area and these areasare protected from compaction due to construction equipment driving across the infiltration area.19.Temporary soil stockpiles must have silt fence or other effective sediment controls, and cannot be placed in surface waters, including stormwaterconveyances such as curb and gutter systems, or conduits and ditches unless there is a bypass in place for the stormwater.20.Collected sediment, asphalt and concrete millings, floating debris, paper, plastic, fabric, construction and demolition debris and other wastes must bedisposed of properly and must comply with MPCA disposal requirements.21.Oil, gasoline, paint and any hazardous substances must be properly stored, including secondary containment, to prevent spills, leaks or otherdischarge. Restricted access to storage areas must be provided to prevent vandalism. Storage and disposal of hazardous waste must be incompliance with MPCA regulations.22.External washing of trucks and other construction vehicles must be limited to a defined area of the site. Runoff must be contained and waste properlydisposed of. No engine degreasing is allowed onsite.23.All liquid and solid wastes generated by concrete washout operations must be contained in a leak-proof containment facility or impermeable liner. Acompacted clay liner that does not allow washout liquids to enter ground water is considered an impermeable liner. The liquid and solid wastes mustnot contact the ground, and there must not be runoff from the concrete washout operations or areas. Liquid and solid wastes must be disposed ofproperly and in compliance with MPCA regulations. An engineering review has been completed for the Inwood Salon and Restaurant. A Final Plan submittal was
received on September 30, 2022. The submittal consisted of the following documentation:
Project Narrative dated September 20, 2022.
Inwood 7th Addition Preliminary Plat dated September 12, 2022
Civil Site Plans dated September 23, 2022.
Storm Water Management Plan dated September 23, 2002.
STATUS/FINDINGS: Engineering has prepared the following review comments for the Final Plat/Civil Site Plans.
Final Plat/Plan approval should be contingent upon the applicant addressing all review comments to the
satisfaction of City staff.
FINAL PLAT/EASEMENTS/SITE PLANS
1. No Final Plat document was provided as part of the application. Approval of the Final Plat must be
conditioned on the submittal of a Final Plat consistent with all city requirements and approved by the city.
2. The Project proposes to Plat Outlot A in the Inwood 6th Addition as Lot 1, Block 1. There are no Outlots
being created by this Plat.
3. Outlot A includes existing drainage and utility easements along the north (10‐ft), south (30‐ft), west (30‐ft)
and easterly (30‐37 ft) property lines. All existing easements must be preserved with no easement being
vacated. The north property line 10‐foot drainage and utility easement must be reserved for the purpose
of small/dry utilities along 5th Street North with no encroachments. The side and rear property line
easements must be reserved for the intended utility purpose with no structure or tree encroachments.
4. Access to the site is proposed though a shared private commercial driveway with the Kwik Trip Store, that
provides right‐in only access from 5th Street North to the west side of the development, and provides a
full access to/from 5th Street North on the east side of the development. The private commercial
driveway has been constructed with previous developments including the required turn lanes along 5th
Street North.
Final Plat/Plan approval must be contingent upon the Inwood Salon and Restaurant development
(proposed Lo1, Block 1 Inwood 7 Addition) being granted full access rights to the existing private
commercial driveway.
Final Plat/Plan approval must also be contingent upon Inwood 6th Addition Oullot B being granted full
access rights to the existing private commercial driveway, such that Outlot B may have primary and
secondary access locations; one to 5th Street North at the existing full access intersection, and one at
Island Trail North.

5. Final Construction Plans and Specifications must be prepared in accordance with the latest version of the
City Engineering Design Standards Manual (dated January 2022), using City details, plan notes and
specifications and meeting City Engineering Design Guidelines. The Civil Site Plans must be approved by
the City Engineer prior to recording of the Final Plat and prior to the start of any construction.
6. The Final Construction Plans must include detailed existing condition information surrounding the plat
boundaries to demonstrate that the proposed improvements match at the construction limits. Additional
existing condition information is required along 5th Street North including existing small utilities, lane
widths, turn lane widths, shoulder widths, pavement markings, existing street signs, and other features
that may be impacted by the improvements. Existing condition information is required for a minimum
distance of 150 feet from the parcel boundaries and project construction limits.
7. Drainage and utility easements must be provided as required by the City Engineer and Public Works
Director, as identified during detailed construction plan reviews.
8. The Site Plans show sidewalk and outdoor patio/plaza encroachments up to the back of curb of the
private drive. The Site Plans must be revised to provide greater patio/sidewalk separation from the full
access private commercial driveway.
9. Written landowner permission must be submitted as part of the final plat applications for any off‐site
grading/construction for the proposed Project. The proposed off‐site easements must be shown on the
site plans, grading plans, and utility plans.
MUNICIPAL WATER SUPPLY
1. Connection to the city water is readily available to serve this property. The applicant will be required to
connect, at its sole cost, to the existing 8‐inch DIP stub that was installed to serve this property.
2. Water availability charges and connection charges will apply to the service connections. A Met Council SAC
determination will be required to determine the WAC/Connection charges for each building.
3. The water services interior to the site will be private services and must meet state plumbing code
requirements. Separate water service pipes may be required for each proposed building.
4. The civil site plans must be revised to accurately reflect the existing site and service stub conditions and to
further detail the proposed improvements. The plans must fully label all existing and proposed pipe sizes,
pipe materials, pipe/structure inverts, and connection details. The plans must also clearly label public
watermain vs. private service pipe.
5. Fire Hydrant locations. No new fire hydrants have been proposed. There are three existing fire hydrants
located along 5th Street North and toward to the south side of the Kwik Trip Store, all approximately 175
to 265 feet from the proposed buildings. Only two of the hydrants have been shown on the existing
conditions and site plans. The applicant will be responsible to place hydrants throughout the property at
the direction of the Fire Department. All fire hydrants and connecting watermains shall be owned and
maintained by the City.
6. If fire hydrants are required to be placed interior to the site, or closer to the proposed buildings, the
hydrants and connecting watermain will be city owned and maintained. If required, the site and utility
plans, and project specifications must be revised and resubmitted for city review, showing the proposed
hydrants and connecting watermain using city design standards, details and specifications. Utility
easements must be dedicated to the city on the final plat, minimum width of 30‐feet centered over the
pipe and hydrants, and all easements must be shown on the Site Plan, Utility Plan and Grading Plan.
MUNICIPAL SANITARY SEWER
1. Connection to the municipal sanitary sewer system is readily available to serve this property. The applicant
will be required to connect, at its sole cost, to the existing 8‐inch PVC stub that was installed to serve this
property.
2. Sewer availability charges and connection charges will apply to the service connections. A Met Council SAC
determination will be required to determine the SAC/Connection charges for each building.
3. The sanitary sewer services interior to the site will be private services and must meet state plumbing code
requirements. Separate sewer service pipes may be required for each proposed building.

4. The civil site plans must be revised to accurately reflect the existing site and service connection conditions
and to further detail the proposed improvements. The plans must fully label all existing and proposed pipe
sizes, pipe materials and pipe/structure inverts. The plans must also clearly label public sanitary sewer vs.
private service pipe.
STORMWATER MANAGEMENT
1. The site plan is subject to a storm water management plan meeting State, South Washington Watershed
District (SWWD) and City rules. Permits will be required from the MPCA and SWWD.
2. The site is located within and is part of the Inwood Development, which included the construction of a
regional stormwater pond and regional infiltration basin to provide rate control, water quality treatment,
and volume reduction for the proposed site. The regional stormwater management facilities were
designed to accommodate a maximum impervious surface area of 75% for each commercial lot. The
applicant has indicated that the proposed site design shows a maximum impervious surface of 73%.
Therefore, no additional storm water BMPs are proposed. Final Plat/Plan approval should be contingent
upon verification of these assumptions by the SWWD and City.
3. The applicant is proposing a private storm sewer system internal to the commercial site to collect and
convey storm water runoff. The private storm sewer system will connect to a city storm sewer collection
system and discharge to the city owned storm water pond and infiltration basin located to the south of the
proposed site. The storm sewer system constructed for this development should remain privately owned
and maintained. The applicant will be required to execute and record a Stormwater Maintenance and
Easement Agreement in the City’s standard form of agreement. The storm sewer minimum pipe size
should be 15‐inch diameter pipe.
4. The storm water management report is incomplete and must be revised and resubmitted for further city
review and approval. The report must be certified by a registered professional engineer.
Revise SWMP to provide written description of the existing site and drainage conditions, including an
Existing Conditions Drainage Map.
Revise SWMP to provide written description of the proposed site and drainage conditions, including a
Proposed Conditions Drainage Map.
Provide a summary table with Peak 100‐year flood elevations for all adjacent storm water basins.

The Lake Elmo Fire Department has completed a final plat review of Inwood Nails and Restaurant based on
submittals dated 9/20/22 with the following comments:
1) All roads and drive lanes shall meet the Lake Elmo Fire Department requirements for widths and
turning radiuses.
2) An approved signage and marking plan shall be determined for all No Parking and Fire Lane access
roads.
3) Fire hydrants shall be provided in approved locations following review by Engineering and Public
Works.
4) Building address numbers shall be plainly visible from the street fronting the property and shall
contrasting color from the background. Size and placement of address numbers shall be approved by
the fire and planning departments.
5) A Fire Department lock box is required for emergency access to building at an approved location.
Provide keys for emergency access into and throughout the occupancy as required.
6) The fire sprinkler system shall be installed compliant with provisions of 2016 NFPA Standard 13,
Installation of Sprinkler Systems. City permit required prior to initiation of work.
7) Fire Department sprinkler connection locations to be approved prior to installation.
8) Commercial kitchens will require a review of fire suppression, ventilation and fuel source systems. Type
I hood and duct systems shall be in compliance with code.
9) The hood and duct wet chemical extinguishing system(s) shall be installed compliant with provisions of
2016 NFPA Standard 17A, Installation of Standard for Wet Chemical Extinguishing Systems. City permit
required prior to initiation of work.
10) The fire alarm system shall be installed compliant with provisions of 2016 NFPA Standard 72, National

11) The sprinkler system shall be properly monitored by a qualified monitoring company.
12) Install emergency egress illumination in the means of egress including exit discharge compliant with
2020 MSFC.

risers and valves, or other fire detection, suppression or control elements shall be identified for the use
of the fire department. Approved signs required to identify fire protection equipment and equipment
location, shall be constructed of durable materials, permanently installed and readily visible.

At your request, I have reviewed the title commitment issued by Land Title, Inc., as agent for First
American Title Insurance Company, with an effective date of October 11, 2022 (the “Title
Commitment”). I have also reviewed a plat prepared by P J Land Surveying, LLC, which is titled
INWOOD SEVENTH ADDITION (the “Plat”).
The Title Commitment purports to cover the following legal description:

RPSLegacyDeSoto LLC, dated January 21, 2020, filed January 30, 2020, as
Document Number 4228900. This private easement for ingress/egress is depicted
on the Plat, and appears to intersect with easements dedicated to the public by the
Plat. The City should review to determine if this private access easement interferes
with any easements dedicated to the public by the Plat.
e. Restrictions running with the land, disclosed by Deed Restriction from
RPSLegacyDeSoto LLC to Kwik Trip Inc., a Wisconsin corporation, dated January
16, 2020, filed January 30, 2002, as Document No. 4228901. Outlot A of the
Property, among other land, is restricted from operations associated with gas
station facilities and adult entertainment. No further action is required.
4. Property taxes and assessments. All real estate taxes must be paid prior to recording.
Taxes payable in 2022 are in the amount of $5,188.00 and are fully paid, according to
County tax records (PID No.: 33.029.21.13.0027). Base taxes in the amount of $5,136.00
have been paid.
There are no levied or pending special assessments.
This letter does not purport to set forth every matter relevant to a determination of whether title to
the Property is marketable, and no one should rely upon it for that purpose. The sole purpose of
this letter is to identify required signatories to the Plat and related issues of interest to the City in
connection with platting, as evidenced by the Title Commitment.
This opinion is conditioned upon the issuance of a title policy in the amount of $100,000 in favor
of the City of Lake Elmo, insuring the City’s interests as they appear on the Plat.

AGREEMENT TO EXTEND PRELIMINARY PLAT STATUS
This Agreement to Extend Preliminary Plat Status (this “Agreement”) is made and entered
into this _____ day of ___________, 2022, by and between the City of Lake Elmo, a municipal
corporation under the laws of Minnesota (the “City”) and Hearth Development, LLC, a Minnesota
limited liability company (the “Developer”) and RPSLegacyDesoto, LLC, a Minnesota limited
liability company (the “Owner”).
RECITALS:
A. The Owner is the owner of the Property legally described on the attached Exhibit
A (the “Property”).
B. The Property was originally part of the preliminary plat of Inwood which was
approved by the City in 2014. The Property was replatted in 2020 as “Outlot A, Inwood Sixth
Addition;”
C. The City requires outlots to be replatted before they can be developed and built
upon;
D. The Property is being replatted by the Developer and the Owner as Lot 1, Block 1,
Inwood 7th Addition so that it may be developed and built upon;
E. The Developer and the Owner have requested that the City extend the preliminary
plat status for Inwood with respect to the Property in order to allow the Property to be replatted;
and
F. Because the Property is being changed from an outlot to a lot and no other changes
are being made, the final plat of the Property is the same as the preliminary plat and the plat of
Inwood 6th Addition. Due to the conformance of the Property to the preliminary plat and the plat
of Inwood 6th Addition, the City is willing to extend the preliminary plat status for Inwood with
respect to the Property; and

incorporated herein, and for other good and valuable consideration, the receipt and sufficiency
which is hereby acknowledged, the City and the Developer agree as follows:

The replat of the Property shall be recorded with Washington County by the Developer or the
Owner within 180 days after approval of the final plat by the City Council. Should the replat not
be recorded within this timeframe, the replat and the preliminary plat of Inwood shall expire with
respect to the Property.

Legal Description of the Property
Outlot A, Inwood Sixth Addition, Washington County, Minnesota.
CITY OF LAKE ELMO WASHINGTON COUNTY
STATE OF MINNESOTA
RESOLUTION 2022-113 A RESOLUTION APPROVING THE FINAL PLAT OF INWOOD 7TH
ADDITION.
WHEREAS, the City of Lake Elmo is a municipal corporation organized and
existing under the laws of the State of Minnesota; and
WHEREAS, Hearth Development, LLC, 3300 Rice Street, Suite 100, St. Paul,
MN 55126 (the "Applicant") has submitted an application to the City of Lake Elmo (the
"City") for a final plat to replat the commercially zoned property known as Outlot A,
Inwood 6th Addition (PID# 3302921130027) (the "Property"); and
WHEREAS, The Lake Elmo Planning Department has reviewed the Minor
Subdivision request for consistency with the City of Lake Elmo Zoning and Subdivision
Ordinances; and
WHEREAS, the City approved the Inwood Preliminary Plat on December 2, 2014;
and
WHEREAS, the City approved an Agreement to Extend Preliminary Plat Status on
December 6, 2022.
WHEREAS, the City Council reviewed the Inwood 7th Addition Final Plat at its meeting held on December 6, 2022; and
NOW, THEREFORE, based on the testimony elicited and information received,
the City Council makes the following findings:
FINDINGS
1) That all the requirements of City Code Section 103.00.100 have been met by the
applicant.
2) That the Final Plat for Inwood 7th Addition consists of replatting Outlot A of Inwood
Sixth Addition to construct a multi-use commercial building.
3) That the Inwood 7th Addition Final Plat is generally consistent with the Preliminary Plat as approved by City Council of Lake Elmo on December 2, 2014.
4) That the Inwood Seventh Addition Final Plat is consistent with the intent of the Lake
Elmo Comprehensive Plan.
5) That the Inwood Seventh Addition Final Plat generally complies with the City’s
Commercial zoning district.
DECISION NOW, THEREFORE, BE IT FURTHER RESOLVED, and based upon the
information received and the above Findings, that the City Council of the City of Lake
Elmo hereby approve the Inwood 7th Addition Final Plat subject to the following
conditions:
1. No construction may begin until the applicant has received City Engineer approval for the
final construction plans; the applicant has obtained from the City all applicable permits,
easements and permissions needed for the project; and a preconstruction meeting has been held by the City’s engineering department. 2. Before the execution and recording of a final plat for the development, the developers shall enter into a Site Improvement Agreement with the City. Such an agreement must be
approved by the City Attorney.
3. That prior to the City releasing the final plat for recording, the plans shall be revised to address the comments in the City Engineer’s memo dated October 14, 2022. 4. That prior to the City releasing the final plat for recording, the plans shall be revised to address the comments in the Landscape Architect’s memo dated October 14, 2022.
5. That prior to the City releasing the final plat for recording, the plat shall be revised to
address the issues identified in the Plat Opinion letter dated November 9, 2022. 6. That the applicant satisfy the $11,400 commercial park dedication fee before the City releases the final plat for recording. 7. All storm water facilities internal to the site shall be privately owned and maintained. A
storm water maintenance and easement agreement in a form acceptable to the City shall be executed and recorded with the final plat. 8. That Outlot B of Inwood Sixth Addition shall be granted full access to the existing commercial driveway off of 5th Street North. 9. If necessary, the applicant shall provide the City with a copy of written permission for
any off-site grading work and storm sewer to adjacent properties before starting any site work. 10. Before the installation or construction of any identification signs, the developer shall submit sign plans to the City for review and obtain a sign permit from the City. 11. That the City does not allow any parking or construction staging, including to loading and
unloading of materials and equipment at any time on 5th Street North during the construction of the site improvements. 12. That the developer records the approved Final Plat with Washington County within 180 days after City Council approval. Failure to record the Final Plat within 180 days of approval will cause the approval to become void.

A RESOLUTION APPROVING THE AGREEMENT TO EXTEND THE
PRELIMINARY PLAT STATUS OF INWOOD
WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, Hearth Development, LLC, 3300 Rice Street, Suite 100, St. Paul, MN 55126 (the "Applicant") has submitted an application to the City of Lake Elmo (the "City") for a final plat
to replat the commercially zoned property known as Outlot A, Inwood 6th Addition (PID#
3302921130027) (the "Property"); and
WHEREAS, the City approved the Inwood Preliminary Plat on December 2, 2014; and
WHEREAS, the Development Agreement for Inwood 6th Addition states that the preliminary plat approval shall lapse and be void unless final platted into lots and blocks within
five years after preliminary approval.
WHEREAS, the City Council reviewed the Agreement to Extend Preliminary Plat Status at the meeting held on December 6, 2022; and
DECISION NOW, THEREFORE, BE IT FURTHER RESOLVED, by the City Council of the City
of Lake Elmo hereby approves the Agreement to Extend Preliminary Plat Status of Inwood.
