CITY COUNCIL MINUTES
JANUARY 17, 2023
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Cadenhead called the meeting to order at 7. 00 pm.
PRESENT: Mayor Charles Cadenhead and Councilmembers Matt Him, Jeff Holtz and Lisa
McGinn. ABSENT: Councilmember Katrina Beckstrom.
Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Public Works
Director Powers, Fire Chief Kalis, Building Official Taylor and City Clerk Johnson
APPROVAL OF AGENDA
Councilmember Holtz, seconded by Councilmember Him, moved TO APPROVE THE
AGENDA AS PRESENTED. Motion passed 4 - 0.
ACCEPT MINUTES
Councilmember Holtz, seconded by Councilmember McGinn, moved TO ACCEPT THE
MINUTES OF THE JANUARY 3, 2023 CITY COUNCIL MEETING AS PRESENTED.
Motion passed 3 —1— 0 (McGinn — abstain).
PUBLIC COMMENTS/INQUIRIES
Susan Dunn, 11013 Upper 33rd St. N., commented on growth in the city, thanked public works
for their work on snow removal and reported a sight line issue on Lake Elmo Avenue and Upper
33rd. Ms. Dunn also thanked voters that voted for her in the November 2022 election.
PRESENTATIONS
Washington County Sheriff Deputies Hailee Newman and Meng Yang introduced themselves as
new Deputies serving Lake Elmo.

Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE THE
CONSENT AGENDA AS PRESENTED. Motion passed 4 - 0.
ITEM 13: Impervious Surface Text Amendment
City Planner Jensen presented proposed amendments to the impervious surface definitions in the
city's zoning code to state that decks, pervious landscape fabric, surface water of pools and
retaining walls are not impervious surface.
Councilmember McGinn, seconded by Councilmember Holtz, moved TO ADOPT
ORDINANCE 2023-01 AMENDING THE IMPERVIOUS SURFACE DEFINITION IN
SECTION 1.08.010. Motion passed 4 — 0.
Councilmember McGinn, seconded by Councilmember Holtz, moved TO ADOPT
RESOL UTION 2023-07 A UTHORIZING SUMMARY PUBLICATION OF ORDINANCE
2023-01. Motion passed 4 — 0.
ITEM 14: Upper 33rd Conditional Use Permit
City Planner Jensen reviewed the conditional use permit application to construct a four unit
townhome building on Upper 33rd Street, west of Lake Elmo Avenue.
Susan Dunn, 11013 Upper 33rd Street, expressed concern over stormwater ponding, prospective
tenant screening, building compatibility with neighborhood character, HOA management of
property, traffic concerns and potential loss of trees.
Elizabeth Niehaus, 2945 Lake Elmo Avenue, expressed concern over parking limitations and
additional demand for on street parking generated by the townhome building.
Brief discussion held regarding parking. Councilmember Holtz stated he would abstain from a
vote due to his relationship with a neighbor of this project.
Councilmember Holtz, seconded by Mayor Cadenhead, moved TO APPROVE A
CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF FOUR UNIT
TOWNHOME B ULIDING AT THE PROPERTIES DESCRIBED AS LOTS 10 AND 11,

abstain)
COUNCIL REPORTS
Mayor Cadenhead: Reminded residents to clear snow around hydrants.
Councilmember McGinn: Reminded residents to prepare for plowing due to upcoming snow
storm.
STAFF REPORTS AND ANNOUNCEMENTS
Administrator Handt: Noted that utility bills are in the mail, reported on meeting with Senator
Seeberger and water conservation issues.
City Engineer Griffin: Reported on supply chain issues with the Tapestry lift station
transformer.
Fire Chief Kalis: Thanked residents for clearing around hydrants and asked for continued
cooperation.
Meeting adjourned at 7:57 pm.
