CITY COUNCIL MINUTES
FEBRUARY 7, 2023
CALL TO ORDER/PLEDGE OF ALLEGIANCE
Mayor Cadenhead called the meeting to order at 7:00 pm.
PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Matt Him, Jeff
Holtz and Lisa McGinn.
Staff present: Administrator Handt, City Attorney Sonsalla, Public Works Director Powers,
Assistant Public Works Director Swanepoel, Building Official Taylor, Fire Chief Kalis and City
Clerk Johnson
APPROVAL OF AGENDA
Item 5, "Approve Job Description and Authorize Advertising for Community Development
Director" was moved to the Regular Agenda. Presentation by the Lake Elmo Jaycees was removed
from the Agenda. "Lobbyist Discussion" was added to the Regular Agenda.
Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO APPROVE THE
AGENDA AS AMENDED. Motion passed 5 — 0.
ACCEPT MINUTES
Councilmember Holtz, seconded by Councilmember Him, moved TO ACCEPT THE
MINUTES OF THE JANUARY 17, 2023 CITY COUNCIL MEETING AS PRESENTED.
Motion passed 5 — 0.
PUBLIC COMMENTSANQUIRIES
RT Luzak, Kokoro Volleyball, 11055 39t' Street N., commented on the permit application process
and current status of the project. Mr. Luzak asked for the City's assistance with submitting an
appeal to the Met Council to obtain a reduction in the sewer availability charge.

Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO APPROVE THE
CONSENT AGENDA AS PRESENTED. Motion passed 5 - 0.
ITEM 18: 9450 Hudson Blvd Easement Vacation
City Planner Jensen reviewed the request for easement vacations to accommodate development of
the property. Planner Jensen noted that the vacated easements would be replaced with new
easements in a different area on the property.
Councilmember Holtz, seconded by Councilmember McGinn, moved TO OPEN THE
PUBLIC HEARING. Motion passed 5 — 0.
No comments were received.
Councilmember Holtz, seconded by Councilmember Hirn, moved TO CLOSE THE PUBLIC
HEARING. Motion passed 5 — 0.
Councilmember Holtz, seconded by Councilmember Hirn, moved TO ADOPT RESOLUTION
2023-009 APPROVING THE VACATION OFA RIGHT OF WAYEASEMENT , A
DRAINAGE AND UTILITY EASEMENT AND A UTILITY EASEMENT IN RELATION TO
THE DPS LAKE ELMO 3" ADDITION PLAT WITH CONDITIONS BASED ON THE
FINDINGS LISTED IN THE STAFF REPORT. Motion passed 5-0.

ITEM 19: PUD Code Text Amendments
City Planner Jensen presented proposed amendments to the City's Planned Unit Development code
based on discussion at the October 11, 2022 City Council Workshop.
Councilmember Holtz, seconded by Councilmember Hirn, moved TO ADOPT ORDINANCE
2023-02, AMENDING ARTICLE XVIII PLANNED UNIT DEVELOPMENT (PUD)
REGULATIONS. Motion passed 5 — 0.
Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE
SUMMARYPUBLICATION OF ORDINANCE 2023-02 WITHAPPROVAL OF
RESOLUTION2023-008. Motion passed 5 — 0.
ITEM 20: Parks Commission 2023 Work Plan
Assistant Public Works Director Swanpoel presented the proposed 2023 Parks Commission Work
Plan. Brief discussion was held regarding other amenities to be added to Pilot Park such as soccer
nets and benches.
Councilmember Holtz, seconded by Councilmember Hirn, moved TO ADOPT THE 2023
PARKS COMMISSION WORK PLAN. Motion passed 5 — 0.
ITEM 21: Approve Job Description and Authorize Advertising for Community
Development Director
City Administrator Handt provided a brief summary of the job description and position posting
for the Community Development Director position as outlined in the job classification and
compensation study performed for the City by Baker Tilly.
Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE THE
COMMUNITYDEVELOPMENT DIRECTOR JOB DESCRIPTION WITHAN
AMENDMENT TO ALLOW DEGREE REQUIREMENTS TO BE SUBSITUTED WITH AN
ADDITONAL FIVE YEARS EXPERIENCE, AND A UTHORIZE AD VER TISING THE
POSIITION. Motion passed 5 — 0.
ITEM 22: Lobbyist
City Administrator Handt reported on meetings with a potential lobbying firm to assist the City
with legislation related to water supply issues.
Councilmember Holtz, seconded by Councilmember McGinn, moved TO AUTHORIZE THE
CITYADMINISTRA TOR TO ENGAGE IN NEGOTL4 TIONS FOR A CONTRACT TO

LOBBY ON WATER ISSUES AT THE 2023 LEGISLATURE TO BE SIGNED BY THE
MAYOR AND CITY CLERK. Motion passed 5 — 0.
ITEM 23: Planning Commission Appointment
Councilmember Beckstrom, seconded by Councilmember McGinn, moved TO APPOINT JIM
WILLIAMS TO THE PLANNING COMMISSION FOR A TERM ENDING 12131125.
Motion passed 5 — 0.
COUNCIL REPORTS
Councilmember Holtz: Reported on school district needs for capacity in the southern boundary
area of Lake Elmo.
STAFF REPORTS AND ANNOUNCEMENTS
Administrator Handt: Provided a reminder that the upcoming City Council Workshop will be
held on Wednesday, February 15th
CLOSED SESSION
Councilmember Holtz, seconded by Councilmember Hirn, moved TO ENTER CLOSED
SESSION PURSUANT TO MINN STAT SECTION 13D. 03 TO DISCUSS LABOR
NEGOTIATIONS. Motion passed 5 — 0.

Councilmember Holtz, seconded by Councilmember Hirn, moved TO RETURN TO OPEN
SESSION. Motion passed 5 — 0.
