HomeMy WebLinkAbout#25 - Northstar 1st Add Final Plat and PUDSTAFF REPORT CITY COUNCIL DATE: 8/15/2023 TO: Lake Elmo City Council FROM: Nathan Fuerst, Consulting Planner Jenni Faulkner, Consulting Planner AGENDA ITEM: PUBLIC HEARING: Final Plat/Planned Unit Development – North Star (Gonyea Homes) BACKGROUND: On December 20, 2022 the City Council conditionally approved Preliminary Plat and PUD requests by GWSA Land Development (dba Gonyea Custom Homes, hereafter the “Applicant”) for a single family home development consisting of 200 units on 101.39 gross acres northwest of the intersection of Lake Elmo Ave N and Stillwater Blvd N. Prior to the preliminary plat and PUD approval, the City approved a rezoning of the parcel from Rural Transition (RT) to Village – Low Density Residential (V-LDR) Since December 2022, the Applicant’s team has worked with City Staff to satisfy the conditions of preliminary plat approval. They have since revised plans according to the preliminary approvals and are seeking the final approvals required to entitle their development. The City does not require final plat or PUD requests to be reviewed by the Planning Commission. As such, City staff have reviewed this application for conformance with the City’s previous conditions and approvals, and for conformance with existing City Standards. A public hearing is required for adoption of the PUD Ordinance. Required notices have been published and mailed. ISSUE BEFORE THE CITY COUNCIL: The City Council is asked to review and make a determination on the Final Plat and Final Planned Unit Development (PUD). City Council Meeting August 15, 2023 Page 2 GENERAL INFORMATION: Applicant: GWSA Land Development, LLC (Gonyea) Property Owner: Sycamore Investment Partners, LLC (Gonyea) Location: Unaddressed parcel Northwest of the intersection of Stillwater Boulevard North, and Lake Elmo Avenue. PID#: 1402921140002 Request(s): Final Plat/Planned Unit Development (PUD) Site Area: 101.39 gross acres Land Use Map: Village Low Density Residential (V-LDR) Current Zoning: Village Low Density Residential (V-LDR) Proposed Zoning: V-LDR/PUD Surrounding: V-LDR/PUD, Rural Transition (RT), Village Mixed Use (V-MX), Public Facilities (PF) History: The parcel is mostly undeveloped and formerly rural, now zoned and guided for V-LDR. Deadline: Application Complete – 6/21/23 60 Day Deadline – 8/20/2023 Extension Letter – N/A 120 Day Deadline – N/A Regulations: Article 13 – Village Districts Article 18 – Planned Unit Development Regulations Title 103 – Subdivision Regulations City of Lake Elmo Design Standards PROPOSAL DETAILS/ANALYSIS: Overall Plat Summary: Gross Site Area - Total 101.39 acres Net Site Area - Total 87.9 acres Net Site Area - First Addition 64.23 acres Total Outlot Area 67.66 acres Wetland Area 13.49 acres Future Addition Outlot Area 23.67 acres Total Units 200 First Addition Units 105 Overall Net Density 2.27 units/acre First Addition Net Density 1.63 units/acre City Council Meeting August 15, 2023 Page 3 The first addition has all developable areas (including stormwater ponds) within the net density calculation and is thus going to be lower than the overall development once all future additions are platted. While future additions will be higher in terms of net density, the overall development is consistent with the Comprehensive Plan’s range of 1.5 to 2.5 dwelling units per net acre. This interpretation is consistent with Metropolitan Council policy. Final Plat and PUD Conformance The development is being proposed as a PUD because the developer proposes deviation from the zoning standards. The developer also proposes to deviate from certain standards in the City’s Engineering Design Standards Manual regulating public improvements in Lake Elmo. A PUD is a negotiated zoning district, and according to the Lake Elmo Zoning Code Article 18, Planned Unit Development Regulations, zoning flexibility can be granted in order to better utilize site features and to obtain a higher quality of development. PUD Deviations. No changes have been proposed to the deviations requested by the developer since preliminary plat approval. The submittals have been reviewed against the preliminary plat and zoning standards. Cells in the ‘As Proposed’ column shaded in blue indicate a deviation requested from City Code. The entire Village Area was subject to an Alternative Urban Areawide Review (AUAR) when the area was brought into the Municipal Urban Service Area (MUSA). The AUAR was updated in early 2022 as required. No further environmental review is required. The AUAR Fee will be required to be paid prior to release of the final plat. Architecture and Site Design. Sample elevations and site plans were submitted and reviewed at the time of preliminary plat approval. The Developer did not seek any flexibility to applicable City Council Meeting August 15, 2023 Page 4 design standards. Staff noted that the development would be consistent with Legacy at North Star at the time of preliminary plat approval. While the elevations submitted at that time appear to meet the City’s expectations for design, a final review will be completed at the time of building permit submittal. Building permits will be reviewed for conformance with site design, bulk standards, exterior materials, and fenestration prior to issuance. Parking and Driveways. No deviations are being granted for parking and driveways associated with the future single-family homes in this development. Conformance will be reviewed at the time of building permit submittal. Parks. §103.00.150 Park Land Dedication Requirements. The City Code allows the City to require cash in lieu of land for this zoning district. During its preliminary approvals, the City determined it would take ownership of Outlot A, which is roughly 30 acres, with 16.5 acres not covered in wetlands. Due to the land in Outlot A being both difficult to access, and to use as parkland, the City determined to provide a credit for that area of 50% of the overall land dedication requirement. The Developer is also proposing trails as part of the development, those areas shall not exceed 25 percent of the total required park dedication. The dedication requirement for this property is calculated by staff as follows. • Step 1: 10% of 101.39 gross acres equates to 10.14 gross acres required for parkland dedication. • Step 2: The fair market value per acre is 40,518.64 dollars per acre. • Step 3: 10.14 ac x 40,518.64 $/ac = $410,859.01 • Step 4: $410,859.01 x .5 (Outlot A credit) = $205,429.51 • Step 5: $205,429.51 x .75 (trail credit) = $154,072.13 Signs. The development plans do not include any proposed signage. The Developer has indicated they are planning to seek sign permits for signage after the development has received final approvals. Therefore, any proposed signage will need to be in conformance with City standards established in Code Section 150.12.430. Landscaping and Tree Preservation. The City’s Consultant Landscape Architect provided a review memo dated July 11, 2023, which found the developer’s plans consistent with City requirements. Approval of the plans is recommended. Fire Chief Comments. The City’s Fire Chief provided a comment memo dated June 22, 2023 which details several requirements for plans to meet City standards for state fire code and local policy. Engineering Review. This project has been reviewed by the City Engineer for conformance with the City’s Engineering Design Standards Manual. Detailed comments relating to the review are included in the Engineer’s memo dated July 24, 2023. Ultimately, the City Engineer is recommending that plans be revised to address all City comments. Key comments are summarized below: • The Final Plat should not be recorded, and no construction shall begin until the City Engineer approves the Final Construction Plans. City Council Meeting August 15, 2023 Page 5 • All required easements and right of way must be dedicated to the City. • Stormwater facilities and other infrastructure on the site will be owned by the City. • A stormwater reuse system will be required for this development and will need to meet VBWD and City permitting requirements for both the North Star and Legacy subdivisions. • Final Plat approval is contingent upon required improvements including trails, turn lanes, and intersections taking place. Watershed Review. This property is located within the area regulated by the Valley Branch Watershed District (VBWD). A permit was received by this developer for the project under the name Schiltgen South, that permit is still valid for this project. The Developer has already proceeded with grading activities under their watershed permit and grading agreement with the City. The Developer will be required to follow their Stormwater Pollution Prevention Plan (SWPPP) throughout the construction process. Minnesota DNR Review. The MNDNR determined that the preliminary plat was reviewed and approved consistent with the State’s shoreland rules. Since the final plat is consistent in terms of density and PUD deviations, Staff consider this project to remain compliant with the City’s shoreland ordinance, and thus the State’s rules. PRELIMINARY PLAT/PUD CONDITIONS OF APPROVAL 1. That the applicant shall submit revised preliminary plat and project plans meeting all conditions of approval for City review and approval. C. Subdivision and Lot Information GWSA Land Development, LLC is proposing to develop one parcel of land in the City of Lake Elmo that will create a community of 200 detached single family homes. The preliminary plat included an amenity lot with a gathering area, pool and playground along with 20 acres of upland open space in an outlot next to Sunfish Lake. The approved plan proposed 72 lots 65’ wide and 128 lots 51’ wide. The 1st Addition Final Plat to be named North Star, will consist of 36 lots 65’ wide and 69 lots 51’ wide plus the amenity lot. The proposed development is located on the former Schiltgen Farms property at the corner of Stillwater Boulevard and Lake Elmo Avenue North. The site consists of approximately 101.39 gross acres with wooded slopes, wetlands and Sunfish Lake to the west, Legacy at North Star to the north and Lake Elmo Elementary to the east. The remaining Schiltgen Parcel is south separated by Stillwater Boulevard. There are three access points to the North Star development. The entire development will provide 43.97 acres of open space, 56% of the upland area excluding ROW. North Star will be a mixture of one- and two-story single-family homes on 65’ and 51’ lots. Most of the neighborhood will back up to natural open space or ponds with very few back- to-back lots that will provide a very open feel to the neighborhood. The architecture will be similar to Legacy at North Star. Due to the fact the proposed development falls within the shoreland of Sunfish Lake, it is subject to the City’s Shoreland Regulations. To get flexibility and develop to the existing land use designation and guidance in the 2040 Comprehensive Plan of V-LDR, a PUD is required. V-LDR guidance allows 1.5-3.0 units/acre. We are proposing 2.30 units/acre. i. Final Plat Name: North Star ii. Lot Tab included with plans iii. Open Space dedicated along Sunfish Lake (Outlot F) = 29.932 acres total , 20.826 acres above OHWL. The overall development will have .851 acres of dedicated trail, .594 acres of dedicated trail in the 1st Addition. iv. 13.486 ac of wetland v. Dedicated ROW: Stillwater Blvd = 3.38 acres, Lake Elmo Avenue = 2.96 acres, Interior ROW 1st Addition = 6.78 acres, Future Addition ROW = 4.70 acres vi. Lot Legal Descriptions included on Lot Tab with plans D. Issues Addressed since Preliminary Plat All issues that were raised during the preliminary plat have been addressed. The engineering, landscaping, fire, and Washington County comments were addressed. The legal descriptions of the property have been corrected to only include the north Schiltgen Parcel, MNDNR approved the shoreland tiering, all conditions were met for VBWD approval and all other required permits are in place. E. Density and Open Space Land Areas: Overall Development Area: 101.39 gross acres Steep Slopes/Bluffs: .86 acres Wetlands: 13.49 acres Site Area for Density Calculations: 87.04 (101.39 - .86 – 13.49) Total Proposed Dwelling Units: 200 Density – (200 / 87.04): 2.30 Shoreland: 53.20 acres Opens Space within Shoreland: 28.38 acres Total Open Space: 43.97 acres F. Infrastructure Improvements The proposed development will have access to Lake Elmo Avenue and Legacy at North Star development. The main access will be via Lake Elmo Avenue with two additional accesses from the north via Legacy at North Star. The proposal will dedicate additional right of way to the County on both Lake Elmo Avenue and Stillwater Avenue for future road improvements. The stormwater will be designed to meet the City and Watershed standards. Additional storage will be provided for all future County Road improvements and for City regional ponding. The entire development will utilize water reuse. The sanitary sewer is stubbed south of the railroad and will access the entire development. Water will connect in multiple locations. The proposal will connect the trail from Legacy at North Star along Lake Elmo Avenue to the south and eventually connect to a future trail along the south side of Stillwater Boulevard. Another trail connection will be provided in the northwest corner of the site to the trail in Legacy at North Star. North Star 1st Addition will bring the sewer underneath the railroad and across Stillwater Boulevard. The water will make one connection to the south and one at the northwest entrance to the site. The trail will be connected along Lake Elmo Avenue to the south at the intersection of Stillwater Boulevard and Lake Elmo Avenue. Additional trail, sidewalk and streets will be provided in front of platted lots. G. Neighbor Concerns This development will provide an outlot that will be deeded to Chavez to access their property in the northwest corner of the site. Due to the phasing of the 1st Addition, this access will be provided in a future phase. H. Conflicts With Nearby Land Uses Our proposal is in-line with future guidance for the property. The proposal doesn’t impact any wetlands and the PUD within a Shoreland Overlay District will guarantee that Sunfish Lake isn’t impacted. All development will be clustered away from the lake with over 50% open space in the Shoreland District and permanent restrictive covenants protecting that open space. I. Burden on Infrastructure Our proposal is in-line with the future guidance for the property per the Comprehensive Plan. The City has an AUAR in place that would have studied the impacts prior to guiding the property. We are connecting to a new sewer extension that was intended to serve this property. Most of the traffic will enter and exit via County roads. The site is proposing water re-use for irrigation to help ease the burden on the water supply. J. Lakeshore Access The City has accepted the open space adjacent to Sunfish Lake for park dedication which will provide lake access to the public. K. Parks and Open Space The development will have a 1.35-acre private HOA amenity lot with a gathering space and other amenities for the residents. As part of the preliminary plat approval, the City voted to accept over 20 acres of land adjacent to Sunfish Lake for 50% of the park dedication fee. We are proposing to dedicate the land with North Star 1st Addition and pay the remaining amount owed in cash in future additions. L. Development Schedule We are currently grading the site and plan to start installing the infrastructure improvements for North Star 1st Addition later this summer or fall. Depending on when we get the necessary approvals and weather, construction could continue into next spring. Approved Variance Request V-LDR Standard 65 ft. SF 51 ft. The field work was completed on April 2nd, 2021.Date of Plat or Map: April 20, 2021________________________________________________________Daniel L. Schmidt, PLS Minnesota License No. 26147 L2 L3 L4 L5 POND #6 POND #5 POND #4 POND #2 POND #3 POND #1 L3 EXECUTION Ground Preparation Prior to seeding, the Contractor shall spray the proposed seeding area with a non-selective glyphosate herbicide such as Round-Up. Approximately three to four weeks later the site should be cultivated using a deep-tine plow and then disked to produce a smooth firm seed bed. Allow weeds to germinate and grow. When weed seeds and roots have reached a height of 2-4 inches, the site should again be sprayed with a second herbicide application. Wait 10 days and then shallow till the soil to a depth of 1 inch. Tilling deeper will bring additional weed seeds to the surface. Once the area to be planted has been properly prepared, the Contractor shall commence with seeding. SEEDING A.Native plant community seeding can take place during two periods of the year. The first window of opportunity is from the time the site preparation work is concluded in the spring, until approximately July 15. The second period is in the fall between October 1st and freeze- up. The latter is considered a dormant seeding and the seedlings do not germinate until late spring of the following growing season. It is recommended that the native seeding be conducted in June and early July. B.All native grass seed should be applied with a Truax native seed drill, at a rate as specified according to individual specifications PLS (pure live seed) per acre. In areas too narrow or steep for equipment, grass seed may be hand broadcast. Cover crop of oats shall be applied after Native Mix has been seeded. C.Raking or dragging and rolling shall follow all seeding to insure good soil contact. *The Contractor shall mulch all seeded areas with clean straw or marsh hay at a rate of 2 tons/acre and shall be disc anchored into place *All seeded areas to receive 50 oats cover at 50 lbs. per acre Year 1 During the first season, the seeded area shall be cut back approximately once each month to prevent the production of weed seeds and to reduce shade on the maturing native plantings. When the seeded area has reached a height of 8-10 inches, a flail-type mower shall be used to cut weeds and native plantings to a height of 4-6 inches. Rotary mowers and sickle bar mowers are not acceptable. In no case shall the seeded area be allowed to exceed 10 inches in height during the first season. Pulling weeds is not recommended as this can uproot small, undeveloped native seedlings. Spot spray thistle, reed canary grass and any other problematic weeds. Year 2 In the spring of the second season, the plantings should be mowed again. Mowing should occur approximately 3-4 times during the second season. If weeds continue to persist during the second year additional mowings may be required. Do not let weeds go to seed. Seeded areas shall not be burned during the second year. L6 February 4, 2023 Ben Hetzel, City Planner City of Lake Elmo 3800 Laverne Avenue North Lake Elmo, MN 55042 Re: DNR Approval of the Preliminary Plat and PUD for Schiltgen South Dear Mr. Hetzel, Thank you for submitting to the Department of Natural Resources (DNR) the Preliminary Plat and PUD for Schiltgen South PUD in Lake Elmo. Minnesota’s shoreland management rules provide a comprehensive set of standards to preserve and enhance the quality of surface waters, conserve the economic and natural environmental values of shorelands, and provide for the wise use of water and related land resources. In accordance with Item #9 in the city’s conditions of approval for the Preliminary Plat and PUD, we reviewed the PUD and tiering plan submitted by GWSA Land Development, and determined it is compliant with the requirements in state rules and the city’s shoreland ordinance for residential PUDs in shoreland. • The developer properly conducted a tiering and density evaluation to determine the allowable number of dwelling units in the shoreland district. • The PUD sets aside over 50% of the area within the shoreland district as open space. Per Item #3 in the city’s conditions of approval, the city will be taking ownership of the large Outlot A along Sunfish Lake and will be requiring the developer to obtain permits for any passive recreational features such as walking trails in Outlot A. • Per Item #10 in the city’s conditions of approval, the applicant shall provide for the preservation and maintenance, in perpetuity, of the open space required by the Shoreland Overlay Zone. The easement must prohibit commercial uses, vegetation and topographic alterations other than routine maintenance, construction of additional buildings or storage of vehicles and other materials, and uncontrolled beaching of watercraft. • The plans and resolution do not propose any water-based recreational facilities such as watercraft mooring facilities or docks. DNR’s approval is contingent upon no docking or mooring facilities at this development. Given that the city will be taking ownership over much of the protected open space, DNR wishes to remind the City of Lake Elmo of the need to manage the open space consistent with the terms of the resolution. Will the developer provide any financial contribution to the city to ensure the open space is maintained in perpetuity as required in Condition #10? Thank you for applying the shoreland PUD standards to this development and for working to preserve and enhance surface water quality.
