BACKGROUND:
On March 21, 2023 the City Council conditionally approved Preliminary Plat and PUD requests by
Landucci Construction for a twin home development consisting of 15 buildings (30 units).
Since March, the Applicant’s team has worked
with City Staff to satisfy the conditions of
preliminary plat approval. They have since
revised plans according to the approvals
granted in March and are seeking the Final
approvals required to entitle their development.
The City does not require final plat or PUD
requests to be reviewed by the Planning
Commission. As such, City staff have reviewed
this application for conformance with the City’s
previous conditions and approvals, and for
conformance with existing City Standards. A
public hearing is required for adoption of the
PUD Ordinance and vacation of exiting
easements. Required notices have been
published and mailed.
ISSUE BEFORE THE CITY COUNCIL:
The City Council is asked to review and make a determination on the Final Plat, Final Planned
Unit Development (PUD), and easement vacation.

This interpretation is consistent with Metropolitan Council policy.
Final Plat and PUD Conformance
The development is being proposed as a PUD because the Applicant proposes deviation from the
zoning standards for such units. The Applicant also proposes to deviate from certain standards in
the City’s Engineering Design Standards Manual regulating public improvements in Lake Elmo.
A PUD is a negotiated zoning district, and according to the Lake Elmo Zoning Code Article 18,
Planned Unit Development Regulations, zoning flexibility can be granted in order to better
utilize site features and to obtain a higher quality of development.

PUD Deviations.
No changes have been proposed to the deviations requested by the Applicant since preliminary
plat approval. The submittals have been reviewed against the preliminary plat and zoning
standards.

Environmental Review. The entire Village Area was subject to an Alternative Urban Areawide
Review (AUAR) when the area was brought into the Municipal Urban Service Area (MUSA).
The AUAR was updated in early 2022 as required. No further environmental review is required.
Payment of the AUAR fee is a condition of approval.
Architecture and Site Design. City Code Section 105.12.840 requires design review against
standards in the Lake Elmo Design Standards Manual. City Code Sec. 105.12.820(a)(3) also
provides standards for this type of construction. At the time of preliminary plat review, this
project was found to be consistent with the City’s adopted building and site design requirements.
During the preliminary plat and PUD review, and after receiving feedback from the City’s
Planning Commission, the Applicant did revise plans to provide more variety in the design and
facades proposed on the 15 buildings. The buildings will vary in façade design, layout, exterior
building materials and colors. The Applicant has not otherwise changed the proposal as it relates
to the types and designs of the buildings and general orientation on the site, and thus the project
is consistent with preliminary approvals.
Parking and Driveways. With 2 enclosed stalls per unit, and space for another 2 in each unit’s
driveway, the Development provides 120 total parking spaces. This is nearly double the required

amount for this use, which is 60 plus 6 for visitors. Additional spaces may be available for on-
street parking as shown on the site plan along the cul-de-sac.
The PUD Ordinance will provide two deviations intended to allow for this type of residential unit
to have driveways compliant with City standards. With connected driveways going across an HOA
maintained common area, the development necessitates two PUD deviations which were approved
at the time of Preliminary Plat.
Trail Connection.
A trail connection was required as a condition of preliminary plat approval. The developer has
revised the plans to include a trail connecting the multi-purpose trail along Stillwater Boulevard
with both the Prairie Sky and Wildflower developments. This is seen as an important pedestrian
and bike connection in downtown Lake Elmo and is a priority of the City’s 2040 Comprehensive
Plan.
Parks. §103.00.150 Park Land Dedication Requirements. The City Code allows the City to
require cash in lieu of land for this zoning district. During its preliminary approvals, the City
determined it would require a cash fee instead of land dedication. As such, the dedication
requirement for this property is calculated by staff as follows.
Per ordinance, the applicant is paying 10% of the market value of the property.
Signs. The development plans indicate that one subdivision monument sign will be installed on
this site. As indicated to staff, one sign advertising the development’s name and logo will be
roughly 28 square feet in sign area and 6 feet tall. This sign appears to meet City sign requirements
established in Code Section 150.12.430.
The Applicant is required to submit a sign permit to the City for a final review and approval prior
to constructing the sign.
Landscaping and Tree Preservation. Through the preliminary plat and PUD process, staff and
the City’s Planning Commission and City Council heard community public comments relating to
the preservation of trees running east-west across the north property boundary. In further revisions
to the plan, the Applicant has taken effort to save the evergreens that the community has voiced
concern for.
The City’s Consultant Landscape Architect provided a review memo dated June 30, 2023, which
noted several deficiencies in the Applicant’s submittal relating to information provided on the
landscaping plan.
Revisions to the plan needed to address the City’s Landscape Architect’s comments, which are
summarized below:
• Modify tree composition.
• Include additional information for review.
• Modify the irrigation plan.

Staff will be recommending that any final required revisions occur as a condition of approval and
be satisfied prior to the release of the final plat.
Easement Vacation.
The Applicant is proposing a final plat which will combine two existing properties. There are
platted Drainage and Utility Easements on the existing PID 1302921210009 per the recorded plat
of Brookman 3rd Addition which will need to be vacated to allow for easements to be established
in the correct locations through the proposed plat. Findings supporting approval of this vacation
request are included in this report. Staff will require that a resolution vacating the drainage and
utility easements is recorded with the final plat.
Fire Chief Comments. The City’s Fire Chief provided a comment memo dated May 11, 2023
which details several requirements for plans to meet City standards for state fire code and local
policy.
Engineering Review. This project has been reviewed by the City Engineer for conformance with
the City’s Engineering Design Standards Manual. Detailed comments relating to the review are
included in the Engineer’s memo dated July 12, 2023. Ultimately, the City Engineer is
recommending that plans be revised to address all City comments. Key comments are:
• The Final Plat should not be recorded, and no construction shall begin until the City
Engineer approves the Final Construction Plans.
• All required easements and right of way must be dedicated to the City.
• Stormwater facilities and other infrastructure on the site will be privately owned and
maintained.
• Final Plat approval is contingent upon required ROW dedication along 39th Street.
Watershed Review. This property is located within the area regulated by the Valley Branch
Watershed District (VBWD). The Applicant has submitted a conditionally approved permit from
the VBWD for this project. Conformance with the conditions of the permit and VBWD will be
required for this project prior to, or throughout, any work beginning on site. The Applicant will be
required to follow their Stormwater Pollution Prevention Plan (SWPPP) throughout the
construction process.
PRELIMINARY PLAT/PUD CONDITIONS OF APPROVAL
1. Prior to the City finding any application for a final plat and final PUD complete, the applicant
shall fully address all comments in the following review memos to the satisfaction of the
requisite author:
a. City Engineer’s memo dated February 15, 2023. Condition met or in progress.
b. City Landscape Architect’s revised memo dated March 10, 2023. Condition met or in
progress.
c. City Fire Chief’s memo dated February 7, 2023. Condition met or in progress.
2. That prior to the City finding any application for final plat and final PUD complete, the
applicant shall demonstrate that the plans reflect compliance with Valley Branch Watershed
(VBWD) review requirements and that the applicant provide the City evidence that all
conditions attached to a VBWD permit will be met before the starting any grading activity on
the site. Condition met or in progress.

3. That the applicant shall obtain all necessary permits including but not limited to all applicable
City permits (building, grading, sign, etc.), NPDES/SWPPP permits and Valley Branch
Watershed District approval before starting any grading or construction activities. Condition
met or in progress.
4. Additional size, height, and area regarding the proposed monument sign shall be submitted
with final PUD application. Condition met.
5. The applicant/developer is responsible, at their own expense, for installing all required right of
way improvements. Any improvements in Stillwater Boulevard shall be consistent with
Washington County standards. Condition met or in progress.
6. A storm water maintenance and easement agreement in a form acceptable to the City shall be
executed and recorded with the final plat. Condition met or in progress.
7. No stormwater impacts shall be created on CSAH 14 (Stillwater Boulevard). Condition met
or in progress.
8. The applicant/developer shall provide the City a fee in lieu of park land dedication as required
by Section 103.00.150 to be paid prior to recording of the final plat. Condition met or in
progress.
9. The applicant/developer shall pay the City the required AUAR fee prior to recording of the
final plat. Condition met or in progress.
10. A landscape and irrigation license agreement in a form acceptable to the City shall be executed
and recorded with the final plat. Condition met or in progress.
11. Existing drainage and utility easements shall be vacated prior to recording final plat. Condition
met or in progress.
12. Finalization, adoption, and publication of an overlay PUD district ordinance shall occur before
the recording of any future final plat. Condition met or in progress.
13. If necessary, the applicant shall provide the City with a copy of written permission for any off-
site grading work and storm sewer discharges to adjacent properties before starting any site
work, grading and as part of any final plat or final PUD application. Condition met or in
progress.
14. Before the execution and recording of a final plat for the development, the developer or
applicant shall enter into a Developer’s Agreement or a Site Work Agreement with the City.
Such an Agreement must be approved by the City Attorney and by the City Council. The
Agreement shall delineate who is responsible for the design, construction and payment for the
required improvements with financial guarantees therefore. The Agreement shall outline any
approved phasing plan. Condition met or in progress.
15. The applicant or developer shall enter into a separate grading agreement with the City before
starting any grading activity in advance of final plat/ PUD approval. The City Engineer shall
review any grading plan that is submitted in advance of a final plat or final PUD, and said plan
shall document the extent of any proposed grading on the site. Condition met or in progress.
16. The applicant or developer shall detail why existing trees along the northerly property lot line
can or cannot be preserved in future submittals. Condition met.
17. The applicant or developer shall detail whether additional visitor parking stalls can be added
into the site plan in future submittals. Condition met.
RECOMMENDED FINDINGS:
Recommended Findings for Final Plat/ PUD. Staff recommends approval of the Final Plat
and Final Planned Unit Development (PUD) for PIDs 1302921210009 and 1302921210017 based
on the following findings:

1. That all the requirements of City Code Section 103.00.100 related to the Final Plans and
Final Plat have been met by the Applicant.
2. That the Prairie Sky Final Plat and PUD Plan consists of 30 twin-home units for
residential use.
3. That the Prairie Sky Final Plat and PUD is generally consistent with the Preliminary Plat
and PUD Plans as approved by the City of Lake Elmo on March 21, 2023.
4. That the Prairie Sky Final Plat and PUD Plan are consistent with the intent of the 2040
Lake Elmo Comprehensive Plan and the 2040 Land Use Map for this area.
5. That the Prairie Sky Final Plat and PUD Plan complies with the general intent of the
Village Mixed-Use (V-MX) zoning district with PUD modifications.
6. That the Prairie Sky Final Plat and PUD Plan generally complies with the Lake Elmo
Design Guidelines and Standards Manual.
7. That the Prairie Sky Final Plat and PUD generally comply with the City’s Subdivision
regulations.
8. That the Prairie Sky Final Plat and PUD generally comply with the City’s Zoning Code
(including Shoreland Zoning) with the exceptions provided for in the PUD and associated
Variance request.
9. That the Prairie Sky Final Plat and PUD Plan is generally consistent with the City’s
engineering standards with the exceptions noted by the City Engineer in his review
comments to the City dated July 12, 2023, and as otherwise identified in future reviews.
Recommended Findings for Easement Vacation
1. The City is the holder of the drainage and utility easement; and
2. The areas encumbered by the drainage and utility easement and the utility easement areas
needs to be changed due the development of the property.
3. New drainage and utility easements and right-of-way will be dedicated to the City in the
final plat.
4. Pursuant to Minnesota Statutes Section 412.851, the City scheduled a public hearing for
August 15, 2023, to consider the proposed vacation of the easements; and
5. Notice of the public hearing was posted, published in the City’s official newspaper, and
mailed to the owners of affected properties, all in accordance with law.
Recommended Conditions of Approval. Staff recommends approval of the Final Plat and Final
Planned Unit Development (PUD) with the following conditions:
1. Prior to the City signing or approving recording of the Final Plat or Development
Agreement, the Applicant shall fully address all comments in the following review
memos, or any subsequently revised memo, to the satisfaction of the City:
a. City Engineer’s memos dated July 12, 2023,
b. City Landscape Architect’s memo dated June 30, 2023,
c. City Fire Chief’s memo dated May 11, 2023.
2. That prior to the City permitting the recording of the Final Plat and Development
Agreement, the applicant shall demonstrate that the plans reflect compliance with Valley

Branch Watershed District (VBWD) review requirements and provide the City evidence
that all conditions attached to a VBWD permit will be met before the starting any grading
activity on the site.
3. That the applicant shall obtain all necessary permits for the Subdivision Improvements
including but not limited to all applicable City permits (building, grading, sign, etc.),
MDH, MPCA, County R/W, NPDES/SWPPP permits and Valley Branch Watershed
District approval before starting any grading or construction activities.
4. No deviations are provided for signage. When construction of the subdivision monument
sign is desired, the Applicant must apply for a sign permit with the City, and will provide
a complete sign plan detailing signage proposed.
5. The applicant/developer is responsible, at their own expense, for installing all
required improvements to the property. Any improvements in Stillwater Boulevard shall
be consistent with Washington County standards.
6. A storm water maintenance and easement agreement in a form acceptable to the City
shall be executed and recorded with the final plat.
7. No stormwater impacts shall be created on CSAH 14 (Stillwater Boulevard).
8. The applicant/developer shall provide the City a fee in lieu of park land dedication as

starting any site work, grading and as part of any final plat or final PUD application.

16. The Applicant must notify all home builders about the City’s outdoor watering
restrictions and that all home builders must notify all home buyers that the City has
imposed limits on outdoor water use including a limit of 2 days per week of watering.
Said decision about whether this notice is no longer required shall be made at the sole
discretion of the City.
17. The Applicant shall have the City approve the notification message before the release of
the Final Plat by the City.
FISCAL IMPACT: Prior to recording the Final Plat, the Applicant will pay the City fees for
Utility Area and Impact Charges and Parkland Dedication. Building Permit fees will be collected
at the time of permit issuance. The City is not providing financial assistance as part of this project.

OPTIONS:
Given the statutory review timeline, the City Council must take one of the following actions:
• Approve the requests.
• Approve the requests with conditions.
• Deny the requests, citing findings of fact.
RECOMMENDATION:
Should the City Council agree with staff’s recommendations and findings, it should conditionally
approve the proposed Final Plat and Final PUD for the subject property with the recommended
findings and conditions of approval listed in the staff report. The following approvals will be
required:
“Move to adopt Resolution 2023-076 approving the final plat, and PUD requested by Landucci
Construction for the Prairie Sky project on the subject property with the findings of fact and
recommended conditions of approval listed therein.”

“Move to adopt Ordinance 2023-17 adopting the PUD standards requested by Landucci
Construction for the Prairie Sky project on the subject property.”

“Move to adopt Resolution 2023-077 authorizing summary publication of Ordinance 2023-

development.
We believe that the enclosed Final Plat application materials substantially address the 17
conditions that were cited as part of the City Council’s Resolution No. 2023-024 approving the
preliminary plat.
While being in attendance at the City Council meeting on March 21, 2023 one of the main issues
discussed by the public and the Council was that the Applicant should preserve the mature trees
along the north property line of the subject property. As you will find on the proposed plans, the
development roadway and associated twinhomes were shifted to the south slightly and the
proposed stormwater basin at the northwest corner of the site was moved to the south side of the
plat. In making these adjustments, our proposed plans are preserving all of the mature coniferous

desirable trees in the same area.
Additionally, the City Council asked if the Applicant could provide detail as to where visitor
parking can be shown on the plans. As discussed during the Council meeting, each residence
provides a total of four (4) off-street parking spaces (2 in the garages and 2 in the driveways).
With the city street is being proposed as 32-feet wide we are able to provide 15 on-street parking
stalls along the new roadway that can be used by all residents in the neighborhood. Refer to
Sheet C200.
Lastly, nearby residents expressed concern over the proposed pickle ball court. As you will see
in the attached revised application materials, the pickle ball court has been removed from the
project.
e. Final Density
As shown above, the combined are for the two existing parcels is 5.4 Acres. With the proposed
thirty (30) single-family attached dwelling units being proposed, the final density is:

f. Proposed Infrastructure Improvements:
The proposed infrastructure improvements for the project are in accordance with the latest
version of the City’s Engineering Design Standards Manual (January 2022). Infrastructure
includes a 66-foot wide dedicated right-of-way that contains a 32’ wide roadway, 8” sanitary
sewer main and lateral services, 8” watermain and lateral services, storm sewer catch basins /
manholes / pipes, and a stormwater management system. The proposed improvements also
include a 5’ concrete sidewalk within the right-of-way and an 8’ wide trail that is placed in a
separate trail easement.

Given that the residential subdivision’s proposed density falls within the lower end of the
permitted density, we do not anticipate any excessive burden on the city’s public infrastructure.
Also, given that the residential units are approximately 1,600 square feet of livable space we are
anticipating that the end-users will be retired-aged, empty nesters, and/or young families who
would typically generate a lesser amount of traffic trips to and from the neighborhood, and a
lesser demand on the city’s water and sewer infrastructure.

We are not proposing to provide a public park within the proposed development, with that said

Stabilization is not required on temporary stockpiles without significant silt, clay ororganic components (e.g., clean aggregate stockpiles, demolition concrete stockpiles, sandstockpiles) but sediment controls must be placed at the base of the stockpile.5.For Public Waters that the Minnesota Department of Natural Resources has promulgated “work inwater restrictions” during specified fish spawning time frames, all exposed soil areas that are within200 feet of the water's edge, and drain to these waters must complete the stabilization activitieswithin 24 hours during the restriction period.6.Stabilize the normal wetted perimeter of the last 200 linear feet of temporary or permanentdrainage ditches or swales that drain water from the site within 24 hours after connecting to asurface water or property edge. Stabilize remaining portions of temporary or permanent ditches orswales within 14 calendar days (or 7 days if within one mile of an identified impaired water) afterconnecting to a surface water or property edge and construction in that portion of the ditchtemporarily or permanently ceases.7.Temporary or permanent ditches or swales being used as sediment containment systems duringconstruction (with properly designed rock-ditch checks, bio rolls, silt dikes, etc.) do not need to bestabilized during the temporary period of use as a sediment containment system. These areasmust be stabilized within 24 hours after no longer being used for as a sediment containmentsystem.8.Applying mulch, hydromulch, tackifier, polyacrylamide or similar erosion prevention practices is notacceptable within any portion of the normal wetted perimeter of a temporary or permanentdrainage ditch or swale section with a continuous slope of greater than 2 percent.9.Pipe outlets must be provided with temporary or permanent energy dissipation within 24 hoursafter connection to a surface water or permanent stormwater treatment system.10.Route water around unstabilized areas on the site and to reduce erosion, unless infeasible. Useerosion controls and velocity dissipation devices such as check dams, sediment traps, riprap, orgrouted riprap at outlets within and along the length of any constructed stormwater conveyancechannel, and at any outlet, to provide a non‐erosive flow velocity, to minimize erosion of channelsand their embankments, outlets, adjacent stream banks, slopes, and downstream waters duringdischarge conditions.11.Unless infeasible due to lack of pervious or vegetated areas, direct discharges from BMPs tovegetated areas of the site (including any natural buffers) in order to increase sediment removaland maximize stormwater infiltration. Use velocity dissipation devices if necessary to preventerosion when directing stormwater to vegetated areas.12.Infiltration areas shall not be excavated until all upstream areas have been stabilized and/orupstream BMPs are in place to properly prevent sediment deposition. Only low impact equipmentshall be allowed in infiltration areas which shall be clearly identified, staked, and marked/fencedoff.13.Project phasing shall be implemented to ensure land disturbance and temporary erosion controlmeasures can be effectively inspected and maintained throughout the duration of the project inaccordance with the Inspection and Maintenance requirements of Section 11.TEMPORARY SEDIMENT CONTROL PRACTICES (SECTION 9)1.Sediment control practices must be established on all down gradient perimeters and be locatedupgradient of any buffer zones. The perimeter sediment control practices must be in place beforeany upgradient land‐disturbing activities begin. These practices shall remain in place until FinalStabilization has been established.2.If downgradient sediment controls become overloaded, based on frequent failure or excessivemaintenance requirements, additional upgradient sediment control practices or redundant BMPsshall be installed to eliminate the overloading concerns. All changes shall be recorded in theSWPPP.3.Temporary or permanent drainage ditches and sediment basins designed as part of a sedimentcontainment system (e.g., ditches with rock-check dams) require sediment control practices onlyas appropriate for site conditions.4.A floating silt curtain placed in the water is not an acceptable sediment control BMP except whenworking on a shoreline or below the waterline. Immediately after the short term construction activity(e.g., installation of rip rap along the shoreline) in that area is complete, upland perimeter controlpractices shall be installed if exposed soils still drain to a surface water.5.Re‐install all sediment control practices that have been adjusted or removed to accommodateshort‐term activities such as clearing or grubbing, or passage of vehicles, immediately after theshort‐term activity has been completed. Complete any short‐term activity that requires removal ofsediment control practices as quickly as possible and re‐install sediment control practices beforethe next precipitation event even if the short‐term activity is not complete.6.All storm drain inlets must be protected by appropriate BMPs during construction until all sourceswith potential for discharging to the inlet have been stabilized. Inlet protection may be removed fora particular inlet if a specific safety concern (street flooding/freezing) has been identified by thePermittee(s) or the jurisdictional authority (e.g., city/county/township/MnDOT engineer).ThePermittee(s) must document the need for removal in the SWPPP.7.Temporary soil stockpiles must have silt fence or other effective sediment controls, and cannot beplaced in any natural buffers or surface waters, including stormwater conveyances such as curband gutter systems, or conduits and ditches unless there is a bypass in place for the stormwater.8.Where vehicle traffic leaves any part of the site (or onto paved roads within the site) install avehicle tracking BMP to minimize the track out of sediment from the construction site. Examples ofvehicle tracking BMPs include (but are not limited to) rock pads, mud mats, slash mulch, concreteor steel wash racks, or equivalent systems. Use street sweeping if such vehicle tracking BMPs arenot adequate to prevent sediment from being tracked onto the street.9.The Permittee(s) must install temporary sedimentation basins as required in accordance withpermit requirements.10.Minimize soil compaction by restricting vehicle access in areas where final vegetative stabilizationwill occur, unless otherwise infeasible.11.Discharges from BMPs shall be directed to vegetated areas unless infeasible.12.Preserve a 50 foot natural buffer or (if a buffer is infeasible on the site) provide redundant (double)perimeter sediment controls when a surface water is located within 50 feet of the project's earthdisturbances and stormwater flows to the surface water.13.Perimeter sediment controls shall be installed at least 5 feet apart unless limited by lack ofavailable space. Natural buffers are not required adjacent to road ditches, judicial ditches, countyditches, stormwater conveyance channels, storm drain inlets, and sediment basins. If preservingthe buffer is infeasible, the reasons for which shall be recorded in the SWPPP.14.The use of polymers, flocculants, or other sedimentation treatment chemicals, if used on theproject, shall be used in accordance with accepted engineering practices, dosing specifications,and sediment removal design specifications provided by the product manufacturer or supplier. Useconventional erosion and sediment controls prior to the chemical addition to ensure effectivetreatment. Chemicals may only be applied where treated stormwater is directed to a sedimentcontrol system which allows or filtration of settlement of the floc prior to discharge.15.If the proposed project as shown on the plans has 10 or more acres draining to a common locationor 5 acres or more if the site is within one mile of a special or impaired water (as identified inSection II - Receiving Waters and Environmentally Sensitive Areas), then a temporary sedimentbasin must be constructed as shown on the plans. Temporary sediment basins will have aminimum of 3,600 cubic feet of storage per acre draining to the basin. The basin outlet shallprovide for discharging water from the surface to minimize discharging of pollutants. A stabilizedemergency overflow shall be constructed.DEWATERING AND BASIN DRAINING (SECTION 10)1.Discharge turbid or sediment‐laden waters related to dewatering or basin draining (e.g., pumpeddischarges, trench/ditch cuts for drainage) to a temporary or permanent sediment basin on theproject site unless infeasible. Discharge from the temporary or permanent sedimentation basins tosurface waters if the basin water has been visually checked to ensure adequate treatment hasbeen obtained in the basin and that nuisance conditions will not result from the discharge. If thewater cannot be discharged to a sedimentation basin prior to entering the surface water, it must betreated with the appropriate BMPs, such that the discharge does not adversely affect the receivingwater or downstream properties.2.Discharge water that contains oil or grease, must use an oil‐water separator or suitable filtrationdevice (e.g. cartridge filters, absorbents pads) prior to discharging the water.3.All water from dewatering or basin‐draining activities must be discharged in a manner that doesnot cause nuisance conditions, erosion in receiving channels or downslope properties, erosion orscour in the immediate vicinity of discharge points, or inundation in wetlands causing significantadverse impact to the wetland.4.The use of filters with backwash water, haul the backwash water away for disposal, return thebackwash water to the beginning of the treatment process, or incorporate the backwash water intothe site in a manner that does not cause erosion. Discharge backwash water to the sanitary sewerif permission is granted by the sanitary sewer authority. Replace and clean the filter media used indewatering devices when required to retain adequate function.INSPECTIONS AND MAINTENANCE (SECTION 11)1.Owner and Contractor shall ensure that a trained person (as identified in item 21.2.b) of the permit willinspect the entire construction site at a minimum:- Once every seven (7) days during active construction, and- Within 24 hours after a rainfall event greater than 1/2 inch in 24 hours2.Inspect all erosion prevention and sediment control BMPs and Pollution Prevention ManagementMeasures to ensure integrity and effectiveness during all routine and post‐rainfall event inspections. Allnonfunctional BMPs must be repaired, replaced, or supplemented with functional BMPs by the end of thenext business day after discovery, or as soon as field conditions allow access unless another time frameis specified below. Investigate and comply with the following Inspection and Maintenance requirements:a.All perimeter control devices must be repaired, replaced, or supplemented when they becomenonfunctional or the sediment reaches one‐half (1/2) of the height of the device. These repairs mustbe made by the end of the next business day after discovery, or thereafter as soon as field conditionsallow access.b.Temporary and permanent sedimentation basins must be drained and the sediment removed whenthe depth of sediment collected in the basin reaches one‐half (1/2) the storage volume. Drainage andremoval must be completed within 72 hours of discovery, or as soon as field conditions allow access.c.Surface waters, including drainage ditches and conveyance systems, must be inspected for evidenceof erosion and sediment deposition during each inspection. Remove all deltas and sedimentdeposited in surface waters, including drainage ways, catch basins, and other drainage systems, andrestabilize the areas where sediment removal results in exposed soil. The removal and stabilizationmust take place within seven (7) days of discovery unless precluded by legal, regulatory, or physicalaccess constraints. Use all reasonable efforts to obtain access. If precluded, removal and stabilizationmust take place within seven (7) calendar days of obtaining access. Contact all local, regional, stateand federal authorities and receiving any applicable permits, prior to conducting any work in surfacewaters.d.Construction site vehicle exit locations must be inspected for evidence of off‐site sediment trackingonto paved surfaces. Tracked sediment must be removed from all paved surfaces both on and off sitewithin 24 hours of discovery, or if applicable, within a shorter time.e.Streets and other areas adjacent to the project must be inspected for evidence of off‐siteaccumulations of sediment. If sediment is present, it must be removed in a manner and at a frequencysufficient to minimize off‐site impacts (e.g., fugitive sediment in streets could be washed into stormsewers by the next rain and/or pose a safety hazard to users of public streets).5.Inspection frequency adjustment:a.Inspections of areas with permanent cover can be reduced to once per month, even if constructionactivity continues on other portions of the site; orb.where sites have permanent cover on all exposed soil and no construction activity is occurringanywhere on the site, inspections can be reduced to once per month and, after 12 months, may besuspended completely until construction activity resumes. The MPCA may require inspections toresume if conditions warrant; orc.where construction activity has been suspended due to frozen ground conditions, inspections may besuspended. Inspections must resume within 24 hours of runoff occurring, or upon resumingconstruction, whichever comes first.3.All inspections and maintenance activities within 24 hours of being conducted must be recorded andretained in the SWPPP. These records must include:a.Date and time of inspectionsb.Name of person(s) conducting inspectionsc.Findings of inspections, including the specific location where corrective actions are neededd.Corrective actions taken (including dates, times, and party completing maintenance activities)e.Date and amount of all rainfall events greater than 1/2 inch (0.5 inches) in 24 hours. Rainfall amountsmust be obtained by a properly maintained rain gauge installed onsite, a weather station that is within1 mile of your location or a weather reporting system that provides site specific rainfall data from radarsummaries.f.If any discharge is observed to be occurring during the inspection, a record of all points of the propertyfrom which there is a discharge must be made, and the discharge should be described (i.e., color,odor, floating, settled, or suspended solids, foam, oil sheen, and other obvious indicators of pollutants)and photographed.g.Any amendments to the SWPPP proposed as a result of the inspection must be documented withinseven (7) calendar days.4.All infiltration areas must be inspected to ensure that no sediment from ongoing construction activity isreaching the infiltration area. All infiltration areas must be inspected to ensure that equipment is not beingdriven across the infiltration area.POLLUTION PREVENTION MANAGEMENT MEASURES (SECTION 12)Implement the following pollution prevention management measures on the site:1.Storage, Handling, and Disposal of Construction Products, Materials, and Wastes shall comply with thefollowing to minimize the exposure to stormwater of any of the products, materials, or wastes. Productsor wastes which are either not a source of contamination to stormwater or are designed to be exposed tostormwater are not held to this requirement:a.Building products that have the potential to leach pollutants must be under cover (e.g., plasticsheeting or temporary roofs) to prevent the discharge of pollutants or protected by a similarly effectivemeans designed to minimize contact with stormwater.b.Pesticides, herbicides, insecticides, fertilizers, treatment chemicals, and landscape materials must beunder cover (e.g., plastic sheeting or temporary roofs) to prevent the discharge of pollutants orprotected by similarly effective means designed to minimize contact with stormwater.c.Hazardous materials, toxic waste, (including oil, diesel fuel, gasoline, hydraulic fluids, paint solvents,petroleum‐based products, wood preservatives, additives, curing compounds, and acids) must beproperly stored in sealed containers to prevent spills, leaks or other discharge. Restricted accessstorage areas must be provided to prevent vandalism. Storage and disposal of hazardous waste orhazardous materials must be in compliance with Minn. R. ch. 7045 including secondary containmentas applicable.d.Solid waste must be stored, collected and disposed of properly in compliance with Minn. R. ch. 7035.e.Portable toilets must be positioned so that they are secure and will not be tipped or knocked over.Sanitary waste must be disposed of properly in accordance with Minn. R. ch. 7041.2.Fueling and Maintenance of Equipment or Vehicles; Spill Prevention and Response: Take reasonablesteps to prevent the discharge of spilled or leaked chemicals, including fuel, from any area wherechemicals or fuel will be loaded or unloaded including the use of drip pans or absorbents unlessinfeasible. Conduct fueling in a contained area unless infeasible. Ensure adequate supplies are availableat all times to clean up discharged materials and that an appropriate disposal method is available forrecovered spilled materials. Report and clean up spills immediately as required by Minn. Stat. § 115.061,using dry clean up measures where possible.3.Vehicle and equipment washing: Wash the exterior of vehicles or equipment on the project site, washingmust be limited to a defined area of the site. Runoff from the washing area must be contained in asediment basin or other similarly effective controls and waste from the washing activity must be properlydisposed of. Properly use and store soaps, detergents, or solvents. No engine degreasing is allowed onsite.4.Concrete and other washouts waste: Provide effective containment for all liquid and solid wastesgenerated by washout operations (concrete, stucco, paint, form release oils, curing compounds and otherconstruction materials) related to the construction activity. The liquid and solid washout wastes must notcontact the ground, and the containment must be designed so that it does not result in runoff from thewashout operations or areas. Liquid and solid wastes must be disposed of properly and in compliancewith MPCA rules. A sign must be installed adjacent to each washout facility that requires site personnelto utilize the proper facilities for disposal of concrete and other washout wastes.SWPPP AMENDMENTS (SECTION 6):1.One of the individuals described in item 21.2.a or 21.2.b of the permit or another qualifiedindividual must complete all SWPPP changes. Changes involving the use of less stringent BMPsmust include a justification describing how the replacement BMP is effective for the sitecharacteristics.2.The SWPPP shall be amended to include additional or modified BMPs as necessary to correctproblems identified or address situations whenever there is a change in design, construction,operation, maintenance, weather or seasonal conditions having a significant effect on thedischarge of pollutants to surface waters or groundwater.3.The SWPPP shall be amended to include additional or modified BMPs as necessary to correctproblems identified or address situations whenever inspections or investigations by the site owneror operator, USEPA or MPCA officials indicate the SWPPP is not effective in eliminating orsignificnatly minimizing the ischarge of pollutants to surface waters or groundwater or thedischarges are cuasing water quality standard exceedances (e.g., nuisance conditions as definedin Minn. R. 7050.0210, subp. 2 or the SWPPP is not consistend with the ofjectives of the USEPAapproved TMDL.BMP SELECTION AND INSTALLATION (SECTION 7):1.All BMPs identified in the SWPPP document and construction plans shall be selected, installed,and maintained in an appropriate and functional manner in accordance with relevant manufacturerspecifications and accepted engineering practices.PERMIT TERMINATION (SECTIONS 4 AND 13)1.Permittees must submit a NOT within 30 days after all termination conditions listed in Section 13are complete.2.Permittees must submit a NOT within 30 days after selling or otherwise legally transferring theentire site, including permit responsibility for roads (e.g., street sweeping) and stormwaterinfrastructure final clean out, or transferring portions of a site to another party. The permittees'coverage under the permit terminates at midnight on the submission date of the NOT.3.Permittees may terminate permit coverage prior to completion of all construction activity if theymeet all of the following conditions:a.Construction activity has ceased for at least 90 days; andb.at least 90 percent (by area) of all originally proposed construction activity has been completedand permanent cover has been established on those areas; andc.on areas where construction activity is not complete, permanent cover has been established;andd.the site complies with items 13.3 through 13.7 of the permit.After permit coverage is terminated under this item, any subsequent development on the remainingportions of the site will require permit coverage if the subsequent development itself or as part ofthe remaining common plan of development or sale will result in land disturbing activity of one (1)or more acres in size.4.Permittees may terminate coverage upon MPCA approval after submitting informationdocumenting the owner canceled the project.5.Permittees must complete all construction activity and must install permanent cover over all areasprior to submitting the NOT. Vegetative cover must consist of a uniform perennial vegetation with adensity of 70 percent of its expected final growth. Vegetation is not required where the function of aspecific area dictates no vegetation, such as impervious surfaces or the base of a sand filter.6.Permittees must clean the permanent stormwater system of any accumulated sediment and mustensure the system meets all applicable requirements in Section 15 through 19 of the permit and isoperating as designed.7.Permittees must remove all sediment from conveyance systems prior to submitting the NOT.8.Permittees must remove all temporary synthetic erosion prevention and sediment control BMPsprior to submitting the NOT. BMPs designed to decompose on-site may be left in place.9.For residential construction only, permit coverage terminates on individual lots if the structures arefinished and temporary erosion prevention and downgradient perimeter control is complete, theresidence sells to the homeowner, and the permittee distributes the MPCA's "Homeowner FactSheet" to the homeowner.10.For construction projects on agricultural land (e.g., pipelines across cropland), disturbed land mustbe returned to its preconstruction agricultural condition prior to submitting the NOT.11.When submitting the NOT, permittees must include either ground or aerial photographs showingvegetative cover requirements have been met as listed above. All submitted photographs shallinclude the date and specific site location.LONG TERM OPERATION AND MAINTENANCE:1.Upon the completion of construction activity and NPDES permit termination, in accordance withSections 4 and 13, the Property Owner shall become the responsible party for long term operationand maintenance (O&M) of all permanent stormwater management features under this project.2.All associated operations, inspections, maintenance, and record keeping shall be performed bytrained individual(s) familiar with the site stormwater management system.3.Record keeping of inspections and maintenance items shall be maintained by the Owner inaccordance with applicable Maintenance Agreements/Declarations as required by localjurisdictional authorities.

The Lake Elmo Fire Department has completed a Final Plat and PUD review of the Prairie Sky Twin Homes -
Landucci Construction townhome project (PID 13.029.21.21.0009) based on submittals dated 4/26/23 with the
following comments:
1) All roads and drive lanes shall meet the Lake Elmo Fire Department requirements for widths and
turning radiuses.
2) An approved signage and marking plan shall be determined for all No Parking and Fire Lane access
roads.
3) Fire hydrants shall be provided in approved locations following review by Engineering and Public
Works.
4) Building address numbers shall be plainly visible from the street fronting the property and shall
contrasting color from the background. Addresses may be required to be posted adjacent to driveways
or other access ways.

An engineering review has been completed for the Prairie Sky Twinhomes Final PUD Plat/Plans located at 39th
Street North and Wildflower Drive (PID 1302921210009) received on June 23, 2023. The submittal consisted of
the following documentation:

STATUS/FINDINGS: Engineering review comments have been provided in two separate memos; one for Final
PUD/Plat approval, and one to assist with the completion of the Final Construction Plans. Please see the following
review comments relating to the Final PUD/Plat application.
FINAL PLAT AND EASEMENTS
1. The Final Plat shall not be recorded until the City Engineer approves the Final Construction Plans.
2. The existing Lot Easements as shown on the Preliminary Plat are to be vacated prior to the recording of
the Final Plat.
3. Drainage and utility easements are shown to be dedicated on the Final Plat along all lot lines as required.
4. All easements as required by the City Engineer and Public Works Director shall be documented on the
Final Plat prior to the release of the Final Plat for recording. Revisions to the Final Plat, Outlot boundaries
and easements may be necessary as the Construction Plans are reviewed and finalized.
5. All easement areas must be free from all encroachments other than those approved by the City Engineer
and upon execution of an easement encroachment agreement. Prohibited encroachments include, but
are not limited to trees, landscaping, fences, retaining walls, graded slopes, and building structures.
6. Final Plat approval must be contingent upon the dedication of 5‐feet of additional right‐of‐way along 39th
Street North as shown on the Preliminary and Final Plat.
7. Future Intersection Improvements. A financial contribution to the future traffic signal or roundabout at
Stillwater Boulevard (CSAH 14) and 39th Street should be considered.
8. Outlot A is proposed as HOA owned and maintained. Additional drainage and utility easements will be
required over the private storm water management system.
9. Outlot B is proposed as City owned for stormwater management as required.

10. Site Access. Access to the proposed development is generally consistent with city requirements. The plans
show a new public street extended approximately 600‐feet in length from 39th Street North and
terminates at a new cul‐de‐sac. The new public street has been shown to align with the existing
commercial driveway for Lake Elmo Bank as required. A public street is proposed in accordance with city
design standards with a 32‐ft wide street within a 66‐ft right‐of‐way.
11. Secondary Access. No secondary access is proposed or needed. The total number of residential units must
remain at 30 or less, or secondary access will be required.
12. Sidewalks are shown along both sides of the street as required in multi‐family subdivisions. As a condition
of Final Plat approval, consideration should be given to requiring a public pedestrian connection from the
end of the proposed cul‐de‐sac to the Stillwater Boulevard Trail, and to Sunflower Lane with a mid‐block
crossing of Sunflower Lane. This recommendation is consistent with the goal for a walkable Downtown.
13. The subdivision improvements are subject to a storm water management plan (SWMP) meeting State,
Valley Branch Watershed District (VBWD) and city rules. Storm water facilities proposed as part of the
development to meet State and watershed permitting requirements must be constructed in accordance
with the City Engineering Design Standards Manual dated January 2022, whether the facilities are public
or privately owned and maintained.
14. A Storm Water Maintenance and Easement Agreement in the city’s standard form of agreement must be
executed and recorded with the Final Plat for all privately owned stormwater drainage facilities.
15. Public watermain and sanitary sewer are available to serve the subdivision with existing utilities located in
the right‐of‐way of 39th Street North. The developer will be responsible for all costs to extend utilities
within and throughout the subdivision to fully serve each proposed lot. Hydrant locations and system
valves must be placed as directed by the Lake Elmo Public Works and Fire Departments. All internal site
hydrants, and watermains feeding any hydrant, will remain city owned and operated. No utility pipe
oversize costs are anticipated for this development.
16. Phasing Plan. A condition of Final Plat approval must include the requirement to complete the
construction of all utilities, stormwater management, street and sidewalk improvements including curb
and gutter and the first lift of asphalt, and any off‐site public improvements (if required) prior to issuance
of any building permits. The development sequencing will be important for this very tight construction
site and dead‐end cul‐de‐sac.
17. Any off‐site permanent and temporary easements, if necessary to construct the proposed subdivision
improvements, must be provided to the city prior to the approval of the Final Construction Plans. Each
easement, if needed, must be provided in the city standard form of easement agreement.
FINAL CONSTRUCTION PLANS & SPECIFICATIONS
1. Final Construction Plans and Specifications must be prepared in accordance with the latest version of the
City Engineering Design Standards Manual dated January 2022, using City standard details, plan notes and
specifications and meeting City Engineering Design Guidelines, unless otherwise approved by the City.
2. The Construction Plans dated June 23, 2023 and submitted with the Final Plat application must be revised
in accordance with the Construction Plan engineering review memorandum dated July 12, 2023.
3. The Final Construction Plans must include a construction parking and staging plan internal to the
development site. No parking or construction staging, including the loading and unloading of materials
and equipment will be allowed at any time on or along 39th Street North or Stillwater Boulevard (CSAH
14) during the construction of the site improvements and buildings, unless specifically allowed through
right‐of‐way permit or during city approved roadway closures. All street, curb and boulevard damage
caused by the construction activities must be repaired or replaced by the developer(s) at no cost to the
city and must meet city design standards and specifications.
4. No construction on the Project may begin until the applicant has received City Engineer approval for the
Final Construction Plans; the applicant has obtained and submitted to the City all applicable permits,
easements and permissions needed for the project; and a preconstruction meeting has been held by the
City’s engineering department.

RESOLUTION NO. 2023-076
RESOLUTION APPROVING THE FINAL PLAT AND PUD REQUEST FOR PRAIRIE SKY
(PIDS 13.029.21.21.0009 AND 13.029.21.21.0017)
WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing under
the laws of the State of Minnesota; and
WHEREAS, the City of Lake Elmo has established a Comprehensive Plan that includes
background data, policy statements, standards, and maps that help to guide the future physical,
social, and economic development of the City; and
WHEREAS, Landucci Construction, (the “Applicant) has requested a Final Plat and PUD
for Prairie Sky, on property legally described on Exhibit A attached hereto (the “Property”),
consisting of approximately 5.35 acres for development of 15 twinhome buildings with 30 units;
and,
WHEREAS, the final plat is further depicted on Exhibit B attached hereto; and
WHEREAS, the plans submitted to the City on April 28, 2023 along with subsequent
revisions; and
WHEREAS, the applications for Final Plat and PUD were not found by the city to be
complete until June 23, 2023; and
WHEREAS, the Lake Elmo City Council reviewed the Final Plat and PUD requests at its
meeting held on August 15, 2023 and voted to approve the item with the following findings of fact:
1. That all the requirements of City Code Section 103.00.100 related to the Final Plans and
Final Plat have been met by the Applicant.
2. That the Prairie Sky Final Plat and PUD Plan consists of 30 twin-home units for residential
use.
3. That the Prairie Sky Final Plat and PUD is generally consistent with the Preliminary Plat and
PUD Plans as approved by the City of Lake Elmo on March 21, 2023.
4. That the Prairie Sky Final Plat and PUD Plan are consistent with the intent of the 2040 Lake
Elmo Comprehensive Plan and the 2040 Land Use Map for this area.
5. That the Prairie Sky Final Plat and PUD Plan complies with the general intent of the Village
Mixed-Use (V-MX) zoning district with PUD modifications.
6. That the Prairie Sky Final Plat and PUD Plan generally complies with the Lake Elmo Design
Guidelines and Standards Manual.
7. That the Prairie Sky Final Plat and PUD generally comply with the City’s Subdivision
regulations.
8. That the Prairie Sky Final Plat and PUD generally comply with the City’s Zoning Code
(including Shoreland Zoning) with the exceptions provided for in the PUD and associated
Variance request.
9. That the Prairie Sky Final Plat and PUD Plan is generally consistent with the City’s
engineering standards with the exceptions noted by the City Engineer in his review
comments to the City dated July 12, 2023, and as otherwise identified in future reviews.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council does hereby approve Prairie
Sky Final Plat, and PUD requests subject to the following conditions:
1. Prior to the City signing or approving recording of the Final Plat or Development Prior to
the City signing or approving recording of the Final Plat or Development Agreement, the
Applicant shall fully address all comments in the following review memos, or any
subsequently revised memo, to the satisfaction of the City:
a. City Engineer’s memos dated July 12, 2023,
b. City Landscape Architect’s memo dated June 30, 2023,
c. City Fire Chief’s memo dated May 11, 2023.
2. That prior to the City permitting the recording of the Final Plat and Development
Agreement, the applicant shall demonstrate that the plans reflect compliance with Valley
Branch Watershed District (VBWD) review requirements and provide the City evidence that
all conditions attached to a VBWD permit will be met before the starting any grading
activity on the site.
3. That the applicant shall obtain all necessary permits for the Subdivision Improvements
including but not limited to all applicable City permits (building, grading, sign, etc.), MDH,
MPCA, County R/W, NPDES/SWPPP permits and Valley Branch Watershed District
approval before starting any grading or construction activities.
4. No deviations are provided for signage. When construction of the subdivision monument
sign is desired, the Applicant must apply for a sign permit with the City, and will provide a
complete sign plan detailing signage proposed.
5. The applicant/developer is responsible, at their own expense, for installing all
required improvements to the property. Any improvements in Stillwater Boulevard shall be
consistent with Washington County standards.
6. A storm water maintenance and easement agreement in a form acceptable to the City shall
be executed and recorded with the final plat.
7. No stormwater impacts shall be created on CSAH 14 (Stillwater Boulevard).
8. The applicant/developer shall provide the City a fee in lieu of park land dedication as
required by Section 103.00.150 to be paid prior to recording of the final plat.
9. The applicant/developer shall pay the City the required AUAR fee prior to recording of the
final plat.
10. A landscape and irrigation license agreement in a form acceptable to the City shall be
executed and recorded with the final plat.
11. Existing drainage and utility easements shall be vacated prior to recording final plat.
12. All easements as requested by the City Engineer and Public Works Department shall be
documented on the Final Plat before the execution of the final plat by City Officials.
13. Finalization, adoption, and publication of an overlay PUD district ordinance shall occur
before the recording of the final plat.
14. If necessary, the applicant shall provide the City with a copy of written permission for any
off-site grading work and storm sewer discharges to adjacent properties before starting any
site work, grading and as part of any final plat or final PUD application.
15. Before the execution and recording of a final plat for the development, the developer or
applicant shall enter into a Developer’s Agreement or a Site Work Agreement with the City.
Such an Agreement must be approved by the City Attorney and by the City Council. The
Agreement shall delineate who is responsible for the design, construction and payment for
the required improvements with financial guarantees, therefore.
16. The Applicant must notify all home builders about the City’s outdoor watering restrictions
and that all home builders must notify all home buyers that the City has imposed limits on
outdoor water use including a limit of 2 days per week of watering. Said decision about
whether this notice is no longer required shall be made at the sole discretion of the City.
17. The Applicant shall have the City approve the notification message before the release of the
Final Plat by the City.

within the V-MX, Village Mixed-Use, zoning district.
2. Accessory Uses - Accessory uses shall be incidental to the principal uses of the
property and as allowed in the V-MX, Village Mixed-Use zoning district.
3. Design and Performance Standards – Unless a PUD deviation has been granted or
conditions imposed, the standards for this property shall be those found in the V-
MX, Village Mixed-Use Zoning District, Article XII of the Zoning Ordinance. The
following deviations are granted as proposed:
a. Minimum Lot Area of 1736 Square Feet.
b. Minimum Lot Width of 28 Feet.
c. Maximum Setback Between Buildings of 10 Feet.
d. Driveway Setback from Side Lot Line of 0 feet.
e. Driveway width of 36 feet for two combined driveways.
SECTION 3. Zoning Map. The zoning map of the City of Lake Elmo shall be republished
in the ordinary course to show the aforesaid zoning, and in the interim the Clerk shall
appropriately mark the zoning map on file in the Clerk’s Office for the purpose of
indicating the rezoning hereinabove provided for in this ordinance, and all of the notations,
references, and other information shown thereon are hereby incorporated by reference and
made a part of this ordinance.
SECTION 4. Effective Date. This ordinance shall become effective immediately upon
adoption and publication in the official newspaper of the City of Lake Elmo.
SECTION 5. Adoption Date. This Ordinance 2023-17 was adopted on this 15th day of

RESOLUTION AUTHORIZING SUMMARY PUBLICATION OF ORDINANCE 2023-17
WHEREAS, the Lake Elmo City Council has adopted Ordinance No. 2023-17, an
ordinance that amends the City’s Zoning Code Chapter 105 of the Lake Elmo City Code by
rezoning all property at PIDs 13.029.21.21.0009 and 13.029.21.21.0017 from V-MX, Village
Mixed Use District, to VMX-PUD –Village Mixed Use Planned Unit Development
WHEREAS, the ordinance is lengthy; and
WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the City Council believes that the following summary would clearly inform
the public of the intent and effect of the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo
that the City Clerk shall cause the following summary of Ordinance No. 2023-17 to be published in
the official newspaper in lieu of the entire ordinance:

The City Council of the City of Lake Elmo has adopted Ordinance No. 2023-17, an ordinance that
amends the Zoning Ordinance by rezoning all property at PIDs 13.029.21.21.0009 and
13.029.21.21.0017 from V-MX (Village Mixed Use District) to VMX-PUD (Village Mixed Use
Planned Unit Development). This ordinance creates land use standards consistent with the
requested Planned Unit Development for the Prairie Sky project by Landucci Construction which
was approved by the Lake Elmo City Council on August 15, 2023.
The full text of Ordinance 2023-17 is available for inspection at Lake Elmo City Offices during
regular business hours.
BE IT FURTHER RESOLVED by the City Council of the City of Lake Elmo that the City
Administrator keep a copy of the ordinance at City Hall for public inspection and that a full copy of
the ordinance be placed in a public location within the City.

RESOLUTION VACATING DRAINAGE AND UTILITY EASEMENTS IN RELATION TO
THE PRAIRIE SKY FINAL PLAT (PIDS 13.029.21.21.0009 AND 13.029.21.21.0017)
WHEREAS, the City of Lake Elmo (the “City”) is a municipal corporation organized and
existing under the laws of the State of Minnesota; and
WHEREAS, the City has received a request from Landucci Construction, LLC, a limited
liability company (the “Applicant”) to vacate the existing Drainage and Utility Easements that were
established on the Final Plat of Brookman 3rd Addition; and
WHEREAS, the land encumbered by the existing easements is on property legally
described on Exhibit A attached hereto; and
WHEREAS, the property encumbered by the Drainage and Utility Easements will be
encumbered by new Drainage and Utility Easements in association with the Prairie Sky Final Plat
reflecting current City standards; and
WHEREAS, pursuant to Minnesota Statutes Section 412.851, the City scheduled a public
hearing for August 15, 2023, to consider the proposed vacation of the Drainage and Utility
Easements; and
WHEREAS, notice of the public hearing was posted, published in the City’s official
newspaper, and mailed to the owners of affected properties, all in accordance with the law; and
WHEREAS, the City held the public hearing on the proposed vacations on August 15, 2023
at which hearing all interested parties were heard; and
WHEREAS, following the public hearing, the City determined that the vacation of the
Drainage and Utility Easements are in the public interest because replacement of easements will be
dedicated to the City in the Prairie Sky final plat; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo as
follows:
1. The City hereby declares that the Drainage and Utility Easements detailed in Exhibit A are
vacated upon all of the following conditions being satisfied:
a. The recording of the plat of Prairie Sky that includes the drainage and utility
easments as required by the City;
2. Upon satisfaction of all of the above conditions, the City Clerk or her designee is authorized
and directed to prepare and present to the Washington County Auditor a notice that the City
has completed these vacation proceedings and record with Washington County Recorder the
notice of completion of the vacation proceedings.
Passed and duly adopted this 15th day of August, 2023 by the Lake Elmo Minnesota City Council.
