BACKGROUND: Annually the Council reviews the City’s Fee Schedule and makes fee adjustments as necessary. The Fee Schedule was last updated on December 6, 2022. The proposed changes were recommended by department directors and are presented to be adopted by City Council.
ISSUE BEFORE THE CITY COUNCIL: Should the City Council update the fee schedule as proposed for 2024? DISCUSSION:
• Staff has reviewed the attached Fee Schedule and proposes the changes highlighted in yellow on the attached document. Also attached is the previously adopted Fee Schedule for comparison.
• Building Plan Review fees have been updated to require a pre-payment of a portion of the
fees. Language regarding escrows is updated on a number of items to reflect that requirement and process. Commercial roofing, siding, plumbing and HVAC permits have minimums added to match residential fees. Building escrows are recommended to be increased to reflect increased building costs and the potential enforcement of additional landscaping
requirements adopted in spring of 2023. Additional language related to Comm/Ind escrow
was added to clarify the process for applicants.
• Firefighter Standby rate was changed to reflect actual staff cost and a minimum standby time of 2 hours. Fire administration fee added to cover time invoicing for standby. Temp LP is
added; Permits would begin to be issued in the fall of 2024 in preparation for the 24-25
heating season. Fire staff will notify builders and developers in Q2.
• Mine Operation Inspection fee added to reflect City Code 9.04.050(d).
• Parks & Shelter fees were not changed but the damage deposit language was moved to the
next column. Non-Resident fee appears to decrease, but part of the fee was the damage deposit.
• Highlighted planning application fees were increased to reflect the amount of time tracking these applications.
• Water and Sewer Rates were increased per the Utility Financial Management Plan presented at the November 14 workshop. The plan proposes higher increases to water usage in Tiers 3-5 to encourage conservation. (See Table B from the Plan on the next page.) Sewer volume
charges were increased 4%, while the base fee is
held steady. No changes are recommended to
WAC/SAC, connection charges, or storm sewer rates at this time.
• Water and Sewer Lateral Benefit Charges have
also been increased ($400 for Water and $600 for
Sewer) per engineering cost estimates.
• Bulk Water increased to the highest commercial rate to help cover costs and deter contractors from
over-watering. It will also be more comparable to
other cities’ bulk water rates. Fee name and language regarding violations of the water use restrictions was clarified.
• Fence Permit was added per LEC 105.12.400
Fencing Regulations.
FISCAL IMPACT: Regularly analyzing, discussing and updating fees helps to ensure sound financial management. Further, review helps to ensure the proper fees are received for services.
RECOMMENDATION: The Council is required to adopt an ordinance in order to update the fee schedule. The proposed ordinance and summary publication are attached.

AN ORDINANCE ADOPTING A 2024 FEE SCHEDULE FOR THE CITY OF LAKE ELMO
The City Council of the City of Lake Elmo ordains:
SECTION I. Schedule Adopted. The attached fee schedule is hereby adopted. SECTION II. Not Codified. This ordinance is transitory in nature and shall not be codified in the
City Code. This ordinance and the fee schedule established hereby shall be placed on file and available for public inspection at City Hall. SECTION III. Effect. The fees set out in the attached fee schedule apply notwithstanding any
other fees the City has established which may be inconsistent. Any other fees imposed by the City
which do not appear on the attached fee schedule remain in full force and effect. SECTION IV. Effective Date. This ordinance shall become effective for all billings rendered after December 31, 2023, and upon adoption and publication in the official newspaper of the City
of Lake Elmo.
