HomeMy WebLinkAbout#03 - Planning Commission Meeting Time Change1 STAFF REPORT DATE: 5/21/2024 REGULAR MOTION TO: City Council FROM: Jason Stopa, Community Development Director AGENDA ITEM: Planning Commission Meeting Start Time Change REVIEWED BY: Sophia Jensen, City Planner BACKGROUND: The Planning Commission start time is 7pm and is set by city ordinance LEC 3.12.190(b) Meetings, which states: “Regular meetings shall be held in the city hall at 7:00 p.m. on the second and fourth Mondays of each month. No action shall be taken in the absence of a quorum except to adjourn the meeting to a subsequent date. A regular meeting may be canceled or rescheduled by the chair at a prior meeting or if there are no scheduled agenda items on the Thursday prior to the meeting. All action taken by the commission shall be by the affirmative vote of a majority of the members present.” The department of community development would like to change the meeting start time to 6:30pm to align with the earlier start times of other boards and commissions. The Economic Development Authority, Parks Commission, and Council Workshop meetings start before 7:00 pm. The change would also save the City money by reducing staff overtime. ISSUE BEFORE THE CITY COUNCIL: The City Council is being asked to decide on the proposed text amendment to the Planning Commission meeting start time. PROPOSAL DETAILS/ANALYSIS Proposed changes are attached. PUBLIC COMMENT This item does not require a public hearing. The item was discussed at Planning Commission meetings. PLANNING COMMISSION The commissioners have agreed to the proposed change. If any commissioner objected to the time change, staff would not have recommended changing the meeting’s start time. FISCAL IMPACT The change would reduce staff overtime. OPTIONS •Recommend approval of the proposed amendment. 2 •Recommend changes to the proposed amendment. •Recommend denial of the proposed amendment. The City Council of the City of Lake Elmo hereby amends Title 3 Administration; Chapter 3.12: City Organizations, 3.12-II Planning Commission, Section 190 Meetings is hereby amended by changing the following section (Proposed language is underlined, deleted language is shown with strikethrough): 3.12.190 Meetings (a) The first available meeting of the New Year with a quorum shall be dedicated to the election of officers and other business as scheduled. (b) Regular meetings shall be held in the city hall at 7:00 6:30 p.m. on the second and fourth Mondays of each month. No action shall be taken in the absence of a quorum except to adjourn the meeting to a subsequent date. A regular meeting may be canceled or rescheduled by the chair at a prior meeting or if there are no scheduled agenda items on the Thursday prior to the meeting. All action taken by the commission shall be by the affirmative vote of a majority of the members present. (c) Special meetings for the commission may be called by the chair following three days posted notice at City Hall. SECTION 2. Effective Date. This ordinance shall become effective immediately upon adoption and publication in the official newspaper of the City of Lake Elmo. SECTION 3. Adoption Date. This Ordinance 2024-11 was adopted on this 21st day of May, 2024 by a vote of __ Ayes and ___Nays. CITY OF LAKE ELMO COUNTY OF WASHINGTON STATE OF MINNESOTA RESOLUTION NO. 2024-062 RESOLUTION AUTHORIZING PUBLICATION OF A SUMMARY OF ORDINANCE 2024-11 WHEREAS, the Lake Elmo City Council has adopted Ordinance No. 2024-11, an ordinance that amends Title 3 Administration; Chapter 3.12: City Organizations; 3.12-II Planning Commission, Section 190 Meetings WHEREAS, the ordinance is lengthy; and WHEREAS, Minnesota Statutes, section 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the City Council believes that the following summary would clearly inform the public of the intent and effect of the ordinance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elmo that the City Clerk shall cause the following summary of Ordinance No. 2024-11 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The City Council of the City of Lake Elmo has adopted Ordinance No. 2024-11, an ordinance that amends the City Code language related to City Organizations, Planning Commission. This ordinance alters language in the City Code to change the Planning Commission meeting start time. The following is a summary of the adopted ordinance language: Ordinance 2024-11 includes the following elements to amend Title 3 Administration; Chapter 3.12: City Organizations, 3.12-II Planning Commission, Section 190 Meetings language regarding meeting start time. The full text of Ordinance 2024-11 is available for inspection at Lake Elmo City Offices during regular business hours. 1. Amended the Planning Commission meeting start time. BE IT FURTHER RESOLVED by the City Council of the City of Lake Elmo that the City Administrator keep a copy of the ordinance at City Hall for public inspection and that a full copy of the ordinance be placed in a public location within the City.
