A RESOLUTIONAPPROVING THE DEVELOPMENT AGREEMENT FOR ROYAL GOLF
CLUB 6T" ADDITION
WHEREAS, the City of Lake Elmo (the "City") is a municipal corporation, organized a
existing under the laws of the State of Minnesota; and I
WHEREAS, U.S. Home, LLC, a limited liability company (the "Applicant") previously
submitted an application to the City for a final plat and final PUD plan for Royal Golf Club 6 th
Addition; and
WHEREAS, the Lake Elmo City Council adopted Resolution No. 2024-038 on April 2 d
2024 approving the final plat and final PUD plan for Royal Golf Club 6t" Addition (the
"Resolution"); and
WHEREAS, the conditions of approval of the final plat and final PUT) plan in t
Resolution included a requirement that the Applicant enter into a development agreeme
acceptable to the City Attorney and approved by the City Council that delineates who
responsible for the design, construction, and payment of the required improvements with financi
guarantees therefore; and 11
I . Approves the Development Agreement for Royal Golf Club 6 1h Addition and authorizes
the Mayor and City Clerk to execute it. The City Attorney is authorized to insert or
modify the security amounts set forth in paragraphs 36, 37, and Exhibit C of the
Development Agreement as they are determined by the City Engineer. The City
Attorney is also authorized to insert a list of the plan documents approved by the City
Engineer in Exhibit B of the Development Agreement.
Passed and duly adopted this 7th day of May, 2024 by the City Council of the City of Lake Elmo,
Minnesota,
