HomeMy WebLinkAbout#04 - Highpointe Crossing Prelminary Plat & PUDSTAFF REPORT DATE: 9/17/24 CONSENT TO: Lake Elmo City Council FROM: Nathan Fuerst, AICP, Consulting Planner AGENDA ITEM: Highpointe Crossing | Resolutions and OP PUD Ordinance REVIEWED BY: Jason Stopa, Community Development Director BACKGROUND: Rachel Development is requesting Preliminary Plat and Open Space Planned Unit Development (OP-PUD) approval for a 65-unit development on approximately 78 acres of land. The project is to be called Highpointe Crossing and is located west of Inwood Avenue North between the existing Torre Pines and Lake Elmo Heights subdivisions. The developer is requesting flexibility from the Rural Residential zoning regulations to allow for an Open Space development. The City’s Planning Commission reviewed and discussed this item at its regular meeting on July 22, 2024. After consideration of the reports of Staff, the Applicant, and the public hearing, the Planning Commission voted 4-1 to recommend denial of the project. At its meeting on August 20, the City Council reviewed the recommendation of the Planning Commission, heard from City Staff, the Applicant and their Consultants, and member of the Public. The City Council ultimately voted 4-0 to approve the development with the findings and conditions proposed by staff, with the exception of allowing mowed grass trails to be installed as proposed by the Developer. Staff were directed to bring resolutions and an Ordinance formalizing the approval to a follow-up meeting. ISSUE BEFORE THE COUNCIL: Should the City Council approve the Resolutions and OP PUD Ordinance for Highpointe Crossing? GENERAL INFORMATION: Applicant: Rachel Development, 4180 Napier Court, NE, St. Michael, MN 55376 Property Owner: Allan Eberhard, Caroline M. Eberhard Trust, 1320 Ryan Ave. W. Roseville, MN 55113 Location: 2298 Inwood Avenue N, Lake Elmo (PID#: 2102921320001) City Council Meeting August 20, 2024 Page 2 Request: Preliminary Plat/ Open Space Planned Unit Development (OP PUD) Deadline: Application Complete – 6/7/2024 120 Day Deadline – 10/5/24 PROPOSAL DETAILS/ANALYSIS: Prior Review. A review of the proposed project against City standards and summary of Planning Commission review and the July 22 public hearing can be found in the August 20, 2024 staff report. That report can be accessed via the City’s website or through the following link - available here. Met Council Review. Staff confirmed on September 4, 2024 with the Metropolitan Council that no Met Council review or approval is required for this project. The project was reviewed and approved under the City’s current ordinance and found to be consistent with the goals, and allowable density range, adopted by the City in its 2040 Comprehensive Plan. FISCAL IMPACT: Approval of a Preliminary Plat and Preliminary OP PUD grants entitlements to a developer. Therefore, there would be no fiscal impact to the City at this time. When the property begins to develop, it will have municipal water service and will pay water connection charges, building permit fees, and the like. RECOMMENDATION If removed from the consent agenda, staff recommends the following motions: “Move to adopt Resolution 2024-093 approving the Preliminary Plat and OP PUD for Highpointe Crossing, as proposed by Rachel Development, with the findings and conditions listed therein.” “Move to adopt Ordinance 2024-16 approving the OP PUD Ordinance for the Highpointe Crossing development proposed by Rachel Development, subject to the approval of a Final Plat and PUD.” “Move to adopt Resolution 2024-094 approving summary publication of Ordinance 2024-XX.” ATTACHMENTS: 1.
