The project is part of the revised Water Supply Plan to construct new production wells (Well 6, and Well 3 or 7) to be located in the south growth area and high‐pressure zone. Preliminary site investigations have identified approximately 8.2 acres to be acquired from parcel 28.029.142.0005, owned by Voran 711 Land Holdings LLC. ISSUE BEFORE COUNCIL: Should the City Council approve the engineering services task order with Stantec and geotechnical services contract with Braun Intertec for the South Water Treatment Plant and Well 6 Project? PROPOSAL DETAILS/ANALYSIS: The MPCA Grant Agreement Amendment #2 for the South Water Treatment Plant and Well 6 Project has been prepared to fund Phase 2 of the Preliminary Site Investigations, including a topographic survey and map of the existing conditions, wetland delineations, geotechnical investigations, and the construction of a test well for Well 6. The City is preparing to enter into a purchase option agreement with the property owner that will allow right-of-entry by the City and its’s consultants/contractors for the purpose of conducting due diligence investigations prior to closing on the property. The due diligence investigations to be completed are as identified above and as further detailed in the attached engineering services proposal prepared by Stantec and dated July 11, 2025, and the attached geotechnical services proposal prepared by Braun Intertec and dated June 27, 2025. FISCAL IMPACT: The Amended Grant Agreement provides for reimbursement to the City in the not to exceed amount of $265,000; an increase of $155,000. Grant Amendment #2 also extends the expiration date from December 31, 2025 to June 30, 2026. The Engineering Services Contract with Stantec includes Preliminary Design and Site Investigation Services and that will be reimbursed by the Amended Grant Agreement. The Braun Intertec Geotechnical Services will also be reimbursed by the Amended Grant Agreement. Construction and Engineering costs associated with the Test Well are not grant reimbursable, as they are deemed to be associated with population growth. Engineering Services related to the test well are estimated to be $30,000 and are part of the Stantec Task Order #5 Amendment. Test Well Construction costs are estimated at $125,000. Contractor quotes/bids will be presented to Council for approval at a future date. Test Well costs will be funded through the Water Enterprise Fund. RECOMMENDATION: Staff is recommending the City Council approve the Stantec Task Order #5, Amendment 2 for the South WTP and Wells in the not-to-exceed amended amount of $178,000 (an increase of $88,000), and approve the Braun Intertec Proposal for Geotechnical Services in the not-to-exceed amount of $53,000. The Recommended motion is as follows: Motion to approve the Stantec Task Order #5, Amendment 2 for the South WTP and Wells in the not-to-exceed amended amount of $178,000, and approve the Braun Intertec Proposal for Geotechnical Services in the not-to-exceed amount of $53,000, contingent upon the MPCA Grant Agreement, Amendment 2 being fully executed. PROFESSIONAL ENGINEERING SERVICES AGREEMENT In accordance with ARTICLE 1 of the Master AGREEMENT between the City of Lake Elmo (“CITY”) and Stantec Consulting Services Inc. (“ENGINEER”), dated May 1, 2012 (“AGREEMENT”), the ENGINEER agrees to provide Professional Engineering Support Services as follows: SOUTH WATER TREAMENT PLANT AND WELLS – AMENDMENT #2 PROJECT OVERVIEW/PROFESSIONAL ENGINEERING SERVICES: Task Order No. 5: The South Area Production Well and Treatment Study, Task Order 5, was authorized for Professional Engineering Services to review and identify potential sites for at least two new production Wells (Well 6, and Well 3 or 7), and identify the proposed scope of improvements for permanent PFAS treatment for the south area production Wells. Amendment #1: Task Order No. 5 Amendment #1 provides a partial engineering services budget increase to continue with preliminary design services necessary to secure property for the water treatment plant on the sites identified, and to continue working with the MPCA to refine and finalize the scope of improvements to be approved by the MPCA for the South Water Treatment Plat full project grant application. Amendment #2: Task Order No. 5 Amendment #2 provides a continuation of the preliminary design services necessary to secure property for the water treatment plant on the identified 8.2 acre site, and specifically includes services to complete Topographic Survey and Existing Conditions Mapping, Wetland Delineation, engineering services for design and construction services for Test Well 6, and a Preliminary Site and Utility Layout based on the topographic survey and added site conditions. The scope of services are further detailed in the attached engineering service proposal. CITY RESPONSIBILITIES: The CITY (or its consultants) will provide the following: 1. Meet with ENGINEER on a periodic basis to discuss the work in progress. 2. Assist with property access for site reviews. Provide property information and record drawings available for proposed sites to be evaluated. 3. Provide information on the existing water infrastructure as needed. TIMES FOR RENDERING SERVICES: The work to be completed under this Task Order is considered urgent due to the CITY’s need to have at least 1 new production well and the South Water Treatment Plant online by May 30, 2027. The work shall be prioritized to provide preliminary design findings and recommendations as needed to verify the feasibility of the proposed water treatment plant site, and the site for Well 6, so that the City may pursue the acquisition of the site. TASK ORDER No. 5 – South Water Treatment Plant and Wells – Amendment #2 Page 2 of 2 CITY’S REPRESENTATIVE AND CONTRACT ADMINISTRATION: The CITY’s representative with respect to services rendered by ENGINEER under this TASK ORDER shall be the City Engineer. ATTACHMENTS: Work to be implemented in accordance with the South Area Production Wells and Treatment Plant Technical Memorandum dated April 4, 2024; incorporated herein by reference, and Amendment #2 work to be completed in accordance with the Stantec Preliminary Investigations and Design Support Proposal dated July 11, 2025. APPROVAL AND ACCEPTANCE: Approval and Acceptance of this Task Order, including the attachment(s) listed above, shall incorporate this document as part of the AGREEMENT. ENGINEER is authorized to begin performance of services upon receipt of a copy of this Task Order signed by CITY. The Effective Date of this Task Order is August 6, 2025.
