The project includes the construction of a water treatment facility at the Well No. 2 Wellhouse for the removal of PFAS. The project has a substantial completion date of May 30, 2025 and a final completion date of July 18, 2025. ISSUE BEFORE COUNCIL: Should the City Council approve Change Order No. 1 for the Well No. 2 PFAS WTP project? PROPOSAL DETAILS/ANALYSIS: Magney Construction, Inc. has submitted Change Order No. 1 in the amount of $3,775.22 for items found during construction but not included in the original contract documents. The change order items are eligible for reimbursement from the grant and necessary to complete the improvements. The itemization is included in the attachment and the total amount requested is within the overall project budget and contingencies. Additionally, the change order recommends changing the substantial completion date from May 30, 2025 to July 3, 2025. Staff recommend the completion date be adjusted as requested. The delay in completing the work is due to the treatment vessels arriving to the site later than stated in the contract documents due to reasons outside of the control of Magney Construction, Inc. FISCAL IMPACT: This change order will increase the contract amount by $3,775.22 bringing the revised construction contract to $1,364,425.22. RECOMMENDATION: Staff is recommending that the City Council approve, as a part of the Consent Agenda, Change Order No. 1 for the Well No. 2 PFAS WTP Project. If removed from the consent agenda, the recommended motion for the action is as follows: Motion to approve Change Order No. 1 for the Well No. 2 PFAS WTP Project, thereby increasing the contract amount by $3,775.22 and changing the substantial completion date to July 3, 2025. Addition of block at location of removed hollow core plank. The upper course of block was originally cut and needs to be replaced. The course below it had flashing nailed into the block at frequent intervals. Replace and reconfigure house water line. $ 890.18 $ 890.18 Totals: $ 9,625.22 $ (5,850.00) Net Total: $ 3,775.22 ATTACHMENT B Change Order Proposals Well No. 2 PFAS WTP Stantec No. 173420153 Magney Project Number 616 5/29/25 Re: Time Extension for Substantial Completion Dear Brian Lintgen, This letter is to request a time extension for substantial completion, moving this date from 5/30/25 to 7/3/25 due to the delayed delivery of the AqueousVets Filters, Cartridge Filter, and Valve Tree and the subsequent media installation delay. Per the contract, the filters, cartridge filter and valve tree were anticipated to deliver on April 30, 2025 and the media installation was anticipated the week of May 12, 2025. Unfortunately, and out of Magney’s control, the filters and associated equipment didn’t get delivered until 5/28/25 and we are currently anticipating delivery of the media on 6/17/25 - essentially 30 day delays on both activities. Per the attached start up plan, we have received and installed the filters and are currently installing the DIP to tie the filters into the existing well piping. We are anticipating being complete with the piping and the Bac-T tests complete the week of June 9th. This will put us on track to have AqueousVets install the media the week of June 16th and take Bac-T and the 5 day Nitrocimine Tests that week. If these tests pass during these first attempts, we should be able to turn the filters over to the City of Lake Elmo on June 24th. If these tests don’t pass, we’re going to have to retake the respective tests and will need additional days which is why we’re requesting until 7/3/25. Please confirm that this time extension is acceptable to Stantec and the City of Lake Elmo and we can move the Substantial Completion back to 7/3/25. Thanks.
