PRESENT: Mayor Charles Cadenhead and Councilmembers Katrina Beckstrom, Dale Dorschner, Jeff Holtz and Lisa McGinn. Staff present: Administrator Handt, City Attorney Sonsalla, City Engineer Griffin, Planning Director Just and City Clerk Johnson APPROVAL OF AGENDA Councilmember McGinn, seconded by Councilmember Holtz, moved TO APPROVE THE AGENDA AS PRESENTED. Motion passed 5 – 0. ACCEPT MINUTES Councilmember Dorschner, seconded by Councilmember Beckstrom, moved TO ACCEPT THE MINUTES OF THE DECEMBER 6, 2022 CITY COUNCIL MEETING AS PRESENTED. Motion passed 5 – 0. PUBLIC COMMENTS/INQUIRIES None PRESENTATIONS City Administrator Handt presented an appreciation award to Councilmember Dorschner for his service on the City Council. Motion passed 5 - 0. ITEM 23: Public Hearing – Vacation of Drainage & Utility Easement within Royal Golf Club of Lake Elmo 4th Addition Planning Director Just presented the request for vacation of a drainage and utility easement in an outlot to allow for the platting of the outlot into lots and blocks for Royal Golf Club 5th Addition. Director Just noted that replacement drainage and utility easements would be granted with the platting of the 5th Addition. Councilmember Holtz, seconded by Councilmember Dorschner, moved TO OPEN THE PUBLIC HEARING. Motion passed 5 – 0. No comments received. Councilmember Holtz, seconded by Councilmember Dorschner, moved TO CLOSE THE PUBLIC HEARING. Motion passed 5 – 0. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO ADOPT RESOLUTION 2022-120 APPROVING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT ON OUTLOT B OF THE ROYAL GOLF CLUB AT LAKE ELMO 4TH ADDITION, WITH CONDITIONS BASED ON THE FINDINGS LISTED IN THE STAFF REPORT. Motion passed 5 – 0. LAKE ELMO CITY COUNCIL MINUTES December 20, 2022 Page 3 of 5 ITEM 24: Final Plat and Final PUD Plan Royal Golf Club of Lake Elmo 5th Addition Planning Director Just reviewed the proposed final plat and PUD for Royal Golf Club 5th Addition. Councilmember Holtz, seconded by Councilmember Beckstrom, moved TO APPROVE RESOLUTION 2022-121 APPROVING THE FINAL PLAT AND FINAL PUD PLAN FOR ROYAL GOLF CLUB LAKE ELMO 5TH ADDITION BASED ON THE FINDINGS OF FACT AND CONDITIONS OUTLINED IN THE STAFF REPORT. Motion passed 5 – 0. ITEM 25: Shiltgen Farmstead Preliminary Plat and PUD Planning Director Just reviewed the site plan and PUD details. Parkland dedication options were reviewed, noting that the developer is proposing a combination of cash, land along the lake and credit for trails. Craig Allen spoke on behalf of the developer and provided additional information on the proposed parkland dedication. Todd Bruchu, 3150 Klondike Ave. N., commented on the density of the proposed development, stating it is too high. Councilmember McGinn, seconded by Councilmember Beckstrom, moved TO APPROVE RESOLUTION 2022-124, APPROVING THE PRELIMINARY PUD AND PRELIMINARY PLAT FOR SCHILTGEN FARMSTEAD BASED ON THE FINDINGS OF FACT AND CONDITIONS OUTLINED IN THE STAFF REPORT WITH AN AMENDMENT TO CONDITION 3 STATING THAT THE CITY WILL TAKE OWNERSHIP OF OUTLOT A AND REQUIRE THE DEVELOPER TO OBTAIN PERMITTING FOR TRAILS TO THE SATISFACTION OF THE CITY. Motion passed 3 – 1 – 1. (Cadenhead – not voting, Dorschner – nay) ITEM 26: 9450 Hudson Blvd. PUD Plans Planning Director Just presented final PUD plans for construction of an apartment building and daycare center at 9450 Hudson Blvd. N. Councilmember Holtz, seconded by Councilmember McGinn, moved TO APPROVE RESOLUTION 2022-124, APPROVING THE FINAL PUD PLANS FOR 9450 HUDSON BOULEVARD BASED ON THE FINDINGS OF FACT AND CONDITIONS OUTLINED IN LAKE ELMO CITY COUNCIL MINUTES December 20, 2022 Page 4 of 5 THE STAFF REPORT. Motion failed 1 – 1 – 3. (Cadenhead – not voting. Beckstrom, Dorschner, Holtz – nay). Discussion held regarding density and bonus points. Staff and City Attorney Sonsalla provided a reminder regarding statutory rules that apply to consideration of final plats and PUDs. Councilmember Holtz, seconded by Mayor Cadenhead, moved TO RECONSIDER THE PREVIOUS MOTION BASED ON FEEDBACK RECEIVED FROM STAFF AND THE CITY ATTORNEY. Motion passed 4 – 1. (Dorschner – nay) Councilmember Holtz, seconded by Mayor Cadenhead, moved TO APPROVE RESOLUTION 2022-124, APPROVING THE FINAL PUD PLANS FOR 9450 HUDSON BOULEVARD BASED ON THE FINDINGS OF FACT AND CONDITIONS OUTLINED IN THE STAFF REPORT. Motion passed 3 – 1 – 1. (Beckstrom – abstained, Dorschner – nay) COUNCIL REPORTS Mayor Cadenhead: Noted winter storm is coming and provided information on package thefts in the city. Councilmember Beckstrom: Thanked Councilmember Dorschner for his service on the Council. Councilmember Dorschner: Commented on his final Council meeting, thanked the citizens for electing him and recognized his fellow Councilmembers. Councilmember Holtz: Thanked the Fire Department for hosting the Cub Scouts and providing a tour of the fire station. STAFF REPORTS AND ANNOUNCEMENTS Administrator Handt: Asked residents to consider applying for vacancies on the Parks and Planning Commissions. City Engineer Griffin: Provided an update on the Parkview-Cardinal Ridge project. CLOSED SESSION Councilmember Holtz, seconded by Councilmember McGinn, MOVED TO ENTER CLOSED SESSION PURSUANT TO MINN. STAT. 13D.05, SUBD. 3(A) TO DISCUSS THE PERFORMANCE OF EMPLOYEE MOLLY JUST. Motion passed 5 – 0. Closed session held. Councilmember Holtz, seconded by Councilmember McGinn, moved TO RETURN TO OPEN SESSION. Motion passed 5 – 0. LAKE ELMO CITY COUNCIL MINUTES December 20, 2022 Page 5 of 5 Mayor Cadenhead, seconded by Councilmember Dorschner, moved TO TERMINATE EMPLOYMENT OF MOLLY JUST FOR PERFORMANCE WITH AN EFFECTIVE DATE OF 1/3/23, OR WHEN HER PTO BALANCE IS EXHAUSTED, WHICHEVER IS SOONER.
