BACKGROUND: The City Council approved a Development Agreement for the Wildflower at Lake Elmo 4th Addition, dated February 2, 2022. The Watermain and Sanitary Sewer Improvements have been completed and accepted as of January 17, 2023, and the 2-year warranty period has been initiated. PROPOSAL DETAILS/ANALYSIS: Staff has received and processed a request for city reimbursement for the trunk watermain and trunk sanitary sewer pipe oversizing costs related to the Wildflower 4th Addition. This request has been reviewed and is being recommended for approval in accordance with the approved Development Agreement, and contingent on the developer being current with all other payments and obligations in accordance with the Development Agreement, including a positive escrow balance as required by the City. FISCAL IMPACT: Oversize payments are recommended in the amounts of $20,512.00 for trunk watermain oversize costs, and $9,102.00 for trunk sanitary sewer oversize cost. RECOMMENDATION: Staff is recommending that the City Council, as part of the Consent Agenda, and approve payment for the city oversize cost reimbursements for the Wildflower at Lake Elmo 4th Addition, contingent on the developer being current with all other payments and obligations in accordance with the Development Agreement, including a positive escrow balance as required by the City. If removed from the consent agenda, the recommended motion for the action is as follows: “Move to approve payment for the city oversize cost reimbursements for the Wildflower 4th Addition, contingent on the developer being current with all other payments and obligations in accordance with the Development Agreement, including a positive escrow balance as required by the City”.
