HomeMy WebLinkAbout#17 - OV 7 Award Contract STAFF REPORT DATE: April 4, 2023 REGULAR AGENDA ITEM: Accept Bids and Award Contract for the Old Village Phase 7 Street and Utility Improvements SUBMITTED BY: Jack Griffin, City Engineer REVIEWED BY: Kristina Handt, City Administrator Marty Powers, Public Works Director Chad Isakson, Project Engineer ISSUE BEFORE COUNCIL: Should the City Council accept bids and award a contract for the Old Village Phase 7 Street and Utility Improvements? BACKGROUND: On February 21, 2023, the City Council approved the plans and specifications for the Old Village Phase 7 Street and Utility Improvements and authorized staff to advertise the project for bids. The improvements include the extension of sanitary sewer service, construction of a lift station, replacement of existing watermain, and the reconstruction of Legion Avenue south of 30th Street with storm sewer improvements. The Project was advertised on QuestCDN.com and in the Stillwater Gazette in accordance with the Minnesota Competitive Bidding requirements. PROPOSAL DETAILS/ANALYSIS: Bids were received and opened electronically on March 23, 2023. The City received 3 bids for this project, with Minger Construction Company providing the lowest base bid and combination of alternate bids. Full results can be viewed in the engineer’s letter of recommendation attached. The proposed sanitary sewer lift station was designed two different ways and bid as alternate line items to determine actual costs for each option. The lift station design for Alternate A is a prefabricated fiberglass structure with a concrete bottom while the lift station design for Alternate B is a city standard concrete wet well and separate concrete valve vault. In order to complete the project the City Council must award the Base Bid + Alternate A OR the Base Bid + Alternate B. Contractor references for Minger Construction Company were reviewed and verified. The City Engineer and the design engineer (SEH) are therefore recommending that the City award the contract to the lowest responsible bidder, Minger Construction Company for the Base Bid + Alternate B (concrete lift station structure) for a total amount contract amount of $2,296,658.75 as outlined in the attached letter. As a part of this award staff is requesting Council to provide the City Administrator authorization to enter into a material testing contract for the construction geotechnical work in the not-to-exceed amount of $28,000. Staff is receiving proposals from Braun Intertec and AET, Inc. to complete the work and will provide a recommendation on who to enter into contractor with to the City Administrator once a review is complete. Additionally, staff is requesting Council to provide the City Administrator authorization to enter into a construction services contract with SEH in the amount of $235,700 to provide construction staking, construction observation, and technical support for the project. These fees are included in the total project budget presented in the fiscal impact section. FISCAL IMPACT: Approval of this resolution commits the council to enter into a construction contract for the project. The post-bid estimated total project cost is $3,023,000 with the city cost share estimated to be $2,450,559, including $701,118 for the street and drainage improvements, $1,292,895 for sanitary sewer system improvements, and $456,546 for the water system improvements. The remaining costs are proposed to be assessed against the benefitting properties consistent with the city’s Special Assessment Policy including proposed assessments in the amount of $284,200 for the street and drainage improvements and $288,200 for the sanitary sewer improvements. The post-bid estimated total costs are summarized by infrastructure component and can be compared to the estimated project costs at the time of the feasibility report presentation. RECOMMENDATION: Staff is recommending that the City Council approve a resolution accepting bids and awarding a contract to Minger Construction Company for the base bid and alternate b in the amount of $2,296,658.75 for the Old Village Phase 7 Street and Utility Improvements. The recommended motion for this action is as follows: “Move to approve Resolution No. 2023–031, accepting bids and awarding a contract to Minger Construction Company for the base bid and alternate b in the amount of $2,296,658.75 for the Old Village Phase 7 Street and Utility Improvements.” Staff is also recommending that the City Council authorize the City Administrator to enter into a material testing contract for the project construction services, in the not-to-exceed amount of $28,000 and a construction services contract with SEH in the amount of $235,700. The recommended motion for this action is as follows: “Move to authorize the City Administrator to enter into a material testing contract for project construction services in the not-to-exceed amount of $28,000 and a construction services contract with SEH in the amount of $235.700 for the Old Village Phase 7 Street and Utility Improvements.” ATTACHMENTS: 1. CITY OF LAKE ELMO WASHINGTON COUNTY STATE OF MINNESOTA RESOLUTION NO. 2023-031 A RESOLUTION ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE OLD VILLAGE PHASE 7 STREET AND UTILITY IMPROVEMENTS WHEREAS, pursuant to an advertisement for bids for the Old Village Phase 7 Street and Utility Improvements, bids were received, opened, and tabulated according to law, and bids were received complying with the advertisement; and WHEREAS, bids were tabulated, checked and summarized to verify that all requirements of the submittal were met; and WHEREAS, the project engineer reviewed the bids and has provided a letter recommending the award of the contract to the lowest responsible bidder, Minger Construction Company, for the base bid and alternate b in the amount of $2,296,658.75. NOW, THEREFORE, BE IT RESOLVED, 1. That the Mayor and City Clerk are hereby authorized and directed to enter into a Contract in the accordance with the above ordered Project, in the amount of the Contractor’s lowest responsible bid, and according to the plans and specifications thereof approved by the City Council. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next two lowest bidders shall be retained until a contract has been signed. Inc. in the amount of $1,898,658.75. In reliance on our experience with Minger Construction and/or materials and information provided by the contractor, we have determined that they have a sufficient understanding of the project and equipment to perform the construction for which it bid. SEH makes no representation or warra nty as to the actual financial viability of the contractor or its ability to complete its work. Minger Construction has completed similar work in Lake Elmo and the surrounding communities. SEH concludes that Minger Construction has the experience and ability to complete a project of this size and scope. Accordingly, and since a lift station is needed to serve the project area, we recommend the project be awarded to Minger Construction with Bid Alternate B in the amount of $2,296,658.75.
