RESOLUTION NO. 2025-073
RESOL UTIONAPPRO VING A NEGATIVE DECLARATION ON THE NEED FOR AN
ENVIRONMENTAL IMPACT STATEMENT FOR THE LIMERICK VILLAGE DE FEL OPMENT
PROJECT
WHEREAS, the City of Lake Elmo is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the laws of the State of Minnesota require that an Environmental
Assessment Worksheet (EAW) be prepared for construction of a permanent or potentially
permanent residential development located in the seven -county Twin Cities metropolitan area
equal to or in excess of the thresholds listed in Minnesota Rules 4410.4300 Subpart 19; and
WHEREAS, an EAW was prepared for the Limerick Village Development Project on
the properties in Washington County as described in Exhibit A, and reviewed by the City of
Lake Elmo, and the draft document was circulated for comments to the required State and
Federal agencies, as provided by law; and
WHEREAS, notice of availability of the EAW was published in the EQB Monitor on
August 26, 2025, and the thirty -day conu-nent period ended on September 25, 2025, and during
such period comments were received from two public agencies; and
WHEREAS, the City Council is required by law to make a finding on the adequacy of
the EAW and to determine whether an Environmental Impact Statement (EIS) should be
prepared; and
WHEREAS, the City Council met at a regularly scheduled meeting on October 21, 2025,
and considered the EAW, the reports of its staff, and the comments received from the parties as
noted above.
NOW, THEREFORE, BE IT RESOLVED THAT by the City Council of the City of
Lake Elmo that the City Council makes the following findings with regard to the environmental
impact of the proposed Limerick Village Development Project:
1. The Environmental Assessment Worksheet (EAW) and related documentation for the
Limerick Village Development Project were prepared in compliance with the procedures
of the Minnesota Environmental Policy Act and Minnesota Rules 4410. 1000 to 4410.1700.
All requirements for environmental review of the proposed project have been met.
2. The EAW and the pertinent development processes related to the project have generated
information that is adequate to determine whether the project has the potential for
significant environmental effects.
3. Based on criteria in Minnesota Rules, part 4410.1700, the project does not have the
potential for significant environmental effects.
4. An Environmental Impact Statement (EIS) is not required for the proposed Limerick
Village Development Project. The Responsible Government Unit (RGU) makes a
Negative Declaration and does not require the preparation of an EIS for the Limerick
Village Development Project.
BE IT FURTHER RESOLVED THAT based on the findings above, the City Council has
determined that the Limerick Village Development Project does not have the potential for
significant environmental effects and that preparation of an EIS is not mandated in this instance.
BE IT FURTHER RESOLVED THAT that nothing in this determination that the EAW is
adequate should be interpreted in any way to suggest that the City has approved of the proposed
Project.
Passed and duly adopted this 21 st day of October, 2025, by the City Council of the City of Lake
Elmo, Minnesota.

That part of the Northeast Quarter of the Southeast Quarter of Section 36, Township 29 North,
Range 21 West, Washington County, Minnesota which lies westerly of the westerly right of way
line of Minnesota Department of Transportation Right of Way Plat No. 82-35 recorded as
Document No. 424557 in the office of the County Recorder, Washington County, Minnesota and
westerly of the westerly right of way line of Washington County Highway Right of Way Plat No.
36 recorded as Document No. 449905 in said office of the County Recorder.

Range 21 West, Washington County, Minnesota; EXCEPT the following described tract:
Commencing at the Southwest comer of said Northwest Quarter of the Southeast Quarter; thence
North along the West line a distance of 152 feet to a point; thence Southeasterly in a straight line
to a point on the South line of said Northwest Quarter of the Southeast Quarter to a point, said
point being located 33 feet East of the Point of beginning; thence West 33 feet to the point of
beginning.
