Charles Cadenhead, Mayor ATTEST: Julie Johnson, City Clerk STAFF REPORT DATE: 11/04/2025 Consent TO: CITY COUNCIL AGENDA ITEM: Lions Park Playground Replacement FROM: Assistant Public Works Director – Adam Swanepoel REVIEWED BY: Public Works Director – Marty Powers CORE STRATEGIES: ☒ Vibrant, inclusive, connected community ☐ Efficient, reliable, innovative services ☐ Responsive, transparent, adaptive governance ☐ Balanced Finances now and future ☒ Managed Growth ☐ Resilient Infrastructure BACKGROUND: The Lions Park playground, installed in 2000, has surpassed its lifespan and is slated for future replacement, as discussed in the 2024 and 2025 capital improvement plans. Survey results from the Parks Master Plan in 2024 showed 58% of those surveyed visited Lions Park. Lions Park was also listed as the #1 park most often visited by users. Survey results also showed playground use was the 2nd most common activity people used the park for. At the July Parks Commission meeting, commissioners agreed to move forward with the planning and design of a new play set. Recommendations for the playset were to design a park to serve kids ages 5-12+, incorporate an active play, add benches and offer items that would be suitable for teens. The following options were brought in front of the Parks Commission on August 18, 2025. The commission voted 6-0 all in favor of recommending option #4 to City Council. The recommendation at the time was to not exceed $317,000, knowing there will be landscaping to complete following the projects’ completion. City Council reviewed the Parks Commissions recommendation on 9/02/2025 and tabled the discussion to review the playground replacement topic along with future park amenities with the Parks Commission. A workshop was held in September with Council and the Parks Commission. Council directed the Parks Commission to review and consider other options in leu of playground replacements in neighborhood parks going forward. The Parks Commission reviewed the Lions Park playground replacement again at its October 2025 meeting. The commission agreed moving forward with the Lions playground replacement and begin reevaluation other park playground options. ISSUE BEFORE CITY COUNCIL: Would City Council like to approve a newly constructed playset at Lions Park using option #4 not to exceed $317,000? PROPOSAL DETAILS/ANALYSIS: Flagship Recreation and St. Croix Recreation have both provided options for a playset which incorporates the recommendations made by the Parks Commission. Option 1: Offers a single tower structure with three slides. An additional structure is attached by means of a cargo net. This second structure also provides a sliding option and a shade canopy and, in addition, a merry-go-round, Topsy Turny Spinner and a swing with six seating options. The area is expanded to incorporate additional equipment including a Flex Swing and Rhapsody Vibra Chimes. This option provides a Poured in Place rubber surfacing on approximately 2300sq ft., allowing access to equipment and swings. The remining area is filled with wood safety chips. Total equipment cost for this project is $176,958 with a total installed price of $298,723.62. Option 2: Offers a double tower with two slides connected by a Flex Climber. An additional Folio Balance Climber and Fox Den serve as a continued place to hang out and explore. A seesaw and two saddle spinners are offset from a merry go round. This option also offers a swing with six options as well as two ziplines. This playset does offer many ADA components including adaptable swings and poured in place rubber surfacing. The total equipment cost for this option is $192,289, with a total installed price of $297,705.05 Option 3: Offers a double tower with two slides, the tallest slide being 12 feet tall. Both towers are connected by means of an elevated tunnel. This structure offers a number of climbing options to access the tower in addition to a separate Forge Climber. A zipline, six swings, and multiple spinners add play features for active kids while the Fox Den provides a place for users to lay and relax. Several sensory features are incorporated throughout the site as well. Four benches are installed throughout the area for additional seating for parents or visitors. The total equipment cost for this option is $223,068, with a total installed price of $298,092.27 Option 4: Similar to option three with the tower structure and slides, this option offers a separate Crab Trap climbing structure which has multiple access points and challenges. This structure is ADA compliant and has multiple climbing routes. Additional Music Chimes offer a means of sensory play while seesaw, Topsy spinner and six seat swing offer means of active play. Three benches are installed around the play structure in this option for parents and visitors. The total equipment cost for this option is $234,197.00, with a total price of $315,400.39. Option 5: Offered by St. Croix Recreation is a 24’ high double tower with seven slides. The towers are connected by an elevated rope tunnel. A four-placement swing set fits into the current swing location and offers a child swing and adaptive swing for users. Multiple access points to this structure offer means of active play and maze options. Equipment cost for this option is $227,493 with a total project cost of $300,000. On 08/5/2025 the Public Works Department surveyed families that attended the National Night Out Event in Lake Elmo. Visitors were able to see all 5 options and voted on their favorite playset. With nearly 120 votes from the evening, option three was the most popular followed by options two and five. Options 1-4 did expand the play area using a smaller concrete border. The play area would extend up to the future trail near the parking lot. As an oversite, the property lot lines in this area do not follow the current landscape. The city would need to update an easement and maintenance agreement if any of these options were pursued. The contractor has noted that a change in the equipment placement and adjusting the concrete border could keep all structures on city property. FISCAL IMPACT: Fiscal impacts are outlined in the 2026-2035 Capital Improvement Plan (CIP). CIP items are funded though the Parks Dedication Fund while Operations and Maintenance items are funded through the Public Works Budget. The current CIP has $300,000 allotted to the replacement of the playground set at Lions Park. RECOMMENDATION: “Motion to purchase and install a new playground set as proposed by city staff at Lions Park with expenses not to exceed $317,000.” STAFF REPORT DATE: November 5, 2025 CONSENT TO: City Council FROM: Mike Rusenovich, Project Engineer AGENDA ITEM: Approve Pay Request No. 1 for the 2025 Crack Seal Project REVIEWED BY: Nicole Miller, City Administrator Clarissa Hadler, Finance Director Marty Powers, Public Works Director Nate Stanley, City Engineer CORE STRATEGIES: ☐ Vibrant, inclusive, connected community ☐ Efficient, reliable, innovative services ☐ Responsive, transparent, adaptive governance ☒ Balanced Finances now and future ☐ Managed Growth ☒ Resilient Infrastructure BACKGROUND: StonePros,LLC DBA SealPros was awarded a construction contract on August 19, 2025 to complete the 2025 Crack Seal Project. Linda Kirst recently reached out to the city with the interest to donate money for the purchase of a park bench to be placed in Sunfish Lake Park near the entrance of the bike trail. ISSUE BEFORE CITY COUNCIL: Should City Council accept the donation of $1,650 from the Graf Family? PROPOSAL DETAILS/ANALYSIS: The Graf Family wishes to donate $1650 to fund an upgraded park improvement in Sunfish Lake Park. The donation would help purchase a bench to be placed near the entrance of the bike and hiking trail head. The family has asked that a plaque be added to the bench which would read: In memory of Neil Swenson who lived a life filled with Kindness, joy and love. "Let's Ride!" Items donated to the city should consider the following and be noted in the discussion for removal or maintenance of the item: (1) Is the gift of lasting value to the community? (2) Does it create potential liability issues for the City? That is, will people walk on it, sit on it, or under it? Will construction be inspected, is construction up to current standards (ADA accessible, for example?) Are the materials used acceptable for public construction? (3) Will some member of the public find the item offensive; can it be construed as having a religious content, or offending members of a protected class? (4) What will the potential annual maintenance cost of the gifted object be? Do the costs outweigh the value of the gift? (5) Does the gift carry implied duties that the City must perform? What is the cost of performance of such duties? Does the cost exceed the value of the gift? (6) If costs, direct or indirect exceed the value of the gift; acceptance of the gift may still be warranted if a public purpose is being served and all understand the costs as well as the value of the gift. (7) Also, does the acceptance of the gift imply that the City will replace the gift when worn out, destroyed by vandals, etc? If the gift is found to be no longer of use in the future, may the City at that time, sell, dismantle or convert to another use? (8) All agreements, prohibitions, etc, with respect to the gift should be noted in the minutes or Memorandum of Agreement for future reference. The Parks Commission reviewed the donation at its scheduled meeting on 10/20/2025. The commission voted unanimously to accept the donation. FISCAL IMPACT: The proposed donation would be placed into the parks general maintenance fund for the purchase of a park bench. The request is to reconfigure the property boundaries to ensure that the former creamery building (building on west side of the site) is fully contained within its own dedicated parcel, so that this parcel may be sold by CHAMA Mission LLC to a different owner (John Pecchia). The proposed subdivision will result in the creation of two tracts. Registered Land Survey (RLS): An RLS is a means of subdividing a Torrens parcel into separate tracts of land. Minnesota Statutes Section 508.47 outlines the standards and requirements for conveying Torrens property in Minnesota. The statute notes that “[t]he County Registrar of Title may require the owner of a registered parcel who wishes to convey any part of the Parcel to prepare a drawing known as a registered land survey.” Additionally, the statute states that an RLS must be approved by the City in the manner required for approval of subdivision plats. For this reason, the RLS is being processed as a minor subdivision instead of an administrative lot line adjustment/consolidation process. In the past, staff have held a public hearing for the RLS through the Planning Commission and subsequently put the item on City Council’s consent agenda. Current staff are following past precedent. PLANNING COMMISSION: The Planning Commission reviewed this request at their October 15th, 2025 meeting. The Commission voted to recommend approval of the request (Vote 5-0). GENERAL INFORMATION Applicants: CHAMA Mission LLC and John Pecchia, 3481 Laverne Ave, Lake Elmo Location:3481 Laverne Ave N., Lake Elmo | PIDs: 1302921320083, 1302921310003, 1302921310016 2 Request:The request is to reconfigure the property boundaries to ensure that the former creamery building (building on west side of the site) is fully contained within its own dedicated parcel. Existing Zoning: VMX – Village Mixed Use Future Zoning: VMX - Village Mixed Use History:The western building on the site was formerly the Lake Elmo Creamery. The east side of the site was previously used as a lumber yard. Buildings on the site are currently used for storage and there is not a proposed change in use at this time. Deadline Application Complete – 09/09/2025 for Action: 60 Day Deadline – 11/08/2025 City Council – 11/05/2025 Applicable Code Provisions: Registered Land Survey: 103.00.040 Registered Land Survey Subdivision Regulations: 103.00.070 Minor Subdivisions VMX Zoning District REQUEST DETAILS Registered Land Survey. Chama Mission LLC and John Pecchia are requesting City approval of an RLS to reconfigure the property lines at 3481 Laverne Ave. The proposed subdivision will result in the creation of two tracts. The former creamery building (3481 Laverne) is located on Tract A. Tract B is directly to the East which includes storage buildings that will remain the same use. This request would not create any additional building sites. Washington County is requiring a RLS instead of a lot line adjustment/consolidation process due to the property being Torrens property. REVIEW AND ANALYSIS Registered Land Survey (RLS): An RLS is a means of subdividing a Torrens parcel into separate tracts of land. For this reason, the RLS is going through the minor subdivision process instead of an administrative lot line adjustment/consolidation process. Property Ownership: There are two different ways of owning and indexing real property in Minnesota: Abstract and Torrens (Registered). With Torrens property, the owner is issued a Certificate of Title, which forgoes the need for a chain of title (an abstract). A person who owns Torrens property is assured that no one else has a claim to the property. Each time an owner voluntarily transfers property, a new Certificate of Title is created and only information that is currently relevant to title is shown on the Certificate. This process keeps the title of a Torrens property up to date. Once a property’s title is registered and becomes Torrens, no one can gain adverse possession rights against the title, including any prescriptive easement or statutory user rights. Review of Registered Land Survey: 3 The City may review the proposed RLS as a minor subdivision, as the proposed subdivision (RLS) is a division of land that results in no more than four parcels. The City may consider and review an RLS with one set of actions. This review process is the equivalent to the City reviewing a preliminary and a final plat simultaneously. No registered land survey of land in the City shall be recorded with the Registrar of Titles until the registered land survey has been approved by the City. The approval shall be indicated by resolution endorsed on or attached to the registered land survey signed by the Mayor and City Clerk. CITY AGENCY REVIEW: Fire Memo dated 9.23.2025 Provided standard fire comments regarding addressing, alarms and sprinkler system. Engineering Memo dated 9.23.2025. Provided comments on utilities and access to properties. Conditions have been added regarding this memo. Landscaping Memo dated 9.26.2025 City Attorney: Provided a RLS opionion dated 9.26.25 with request revisions. Conditions have been added regarding this memo. Valley Branch Watershed District email (9.29.25) states that a VBWD permit must be obtained. Utilities and Access: The engineering memo addresses concerns related to utilities to the site and how they will connect to the site to the east. The proposed easement through the parking area shall include the existing water and sewer stubs along with the vehicle access lane, which may result in an easement wider than the proposed 33 feet. To ensure flexibility for future development to the east, the City may require a utility easement along Upper 33rd Street. PUBLIC COMMENT: A public hearing notice was sent to surrounding properties on September 30, 2025. A public hearing notice was published in the City’s official newspaper on October 3, 2025. Staff has not received any public comment at this time. I have reviewed Certificate of Title No. 81072 (the “Certificate”). I have also reviewed a registered land survey prepared by Cornerstone Land Surveying, Inc., which is titled REGISTERED LAND SURVEY NO. 132 (the “RLS”). This minor subdivision letter is in response to an application made to the City of Lake Elmo dated July 16, 2025. The Commitment purports to cover the following legal description: Parcel 7: All that part of the West Half of Section 13, Township 29 North, Range 21 West, City of Lake Elmo, Washington County, Minnesota, and all that part of Lots 8 through 13, Block 1, ELMO PARK and all that part of Lots 21 through 25, Block 4, CLOVERDALE and all that part of Lot 40, COUNTY AUDITOR’S PLAT NO. 8, according to the plats thereof, on file and of record in the office of the County Recorder, Washington County, Minnesota, described as follows: Beginning at Judicial Landmark No. 8 which is on the southerly line of said Block 1, ELMO PARK, and which is 21.25 feet northeasterly from the southwesterly corner of said Lot 13, Block 1, ELMO PARK, and as measured along said southerly line of said Lot 13, Block 1, ELMO PARK; thence South 71 degrees 44 minutes 52 seconds West, along said southerly line of said Block 1 ELMO PARK, a distance of 228.65 feet to Judicial Landmark Ms. Ashley Monterusso September 26, 2025 Page 2 LA515\161\1051418.v2 No. 9 and its intersection with the west line of the east 7.40 feet of Lot 8, of said Block 1, ELMO PARK; thence North 18 degrees 15 minutes 08 seconds West, perpendicular to last described line, along said west line of the east 7.40 feet of said Lot 8, Block 1, ELMO PARK, a distance of 100.00 feet to Judicial Landmark No. 10 and to its intersection with the northerly line of said Block 1, ELMO PARK; thence north 71 degrees 44 minutes 52 seconds East, along said northerly line of Block 1, ELMO PARK, a distance of 1.70 feet to Judicial Landmark No. 11 and to its intersection with a southerly extension of the west line of Block 4, of said CLOVERDALE; thence North 00 degrees 53 minutes 36 seconds West, along said southerly extension of the west line of Block 4, CLOVERDALE, and along the west line of Block 4, CLOVERDALE, a distance of 93.26 feet to Judicial Landmark No. 12 and to the middle of Lot 22, said Block 4 CLOVERDALE; thence North 75 degrees 01 minutes 44 seconds East, a distance of 123.67 feet to Judicial Landmark No. 13 and to the northeast corner of said Lot 21 Block 4 CLOVERDALE; thence North 89 degrees 47 minutes 31 seconds East, a distance of 79.57 feet to Judicial Landmark No. 16 and to its intersection with a line that is perpendicular to said southerly line of Block 1, ELMO PARK, and which bears North 18 degrees 15 minutes 08 seconds West from the point of beginning; thence South 18 degrees 15 minutes 08 seconds East, along said perpendicular line, a distance of 157.29 feet to Judicial Landmark No. 8 and to the point of beginning. The boundaries of Parcel 7 have been marked by Judicial Landmarks set pursuant to Order in Torrens Case No. C5-88-5613. Torrens Property: Certificate of Title No. 81072. (the “Property”). Based on my review of the Commitment, the Certificate, and the RLS, I have the following comments regarding the minor subdivision application: 1. Ownership Interests. According to the Commitment and the Certificate, the owner of the Property is Chama Mission, LLC, a Minnesota limited liability company. a. The fee owner of the Property does not need to sign the RLS. A Brian Zeller signed both the minor subdivision application and the affirmation of sufficient interest. From reviewing the Minnesota Secretary of State records, Brian Zeller’s affiliation with Chama Mission, LLC is unclear. The fee owner should provide documentation that Brian Zeller is affiliated with the fee owner of the Property and may sign on its behalf. b. According to the Commitment and the Certificate, Royal Credit Union has a mortgagee interest in the Property. The mortgage will likely need to be amended or partially released to reflect the legal description of the Property after the subdivision Ms. Ashley Monterusso September 26, 2025 Page 3 LA515\161\1051418.v2 and the sale of a portion of the Property to the Applicant. No further action is required. 2. Application for Subdivision. a. The surveys depict the Property before and after the subdivision. The application conforms with City Code Sec. 103.00.070(b), allowing for minor subdivisions resulting in four or fewer parcels. The surveys prepared by Cornerstone Land Surveying identify the intent to adjust the lot lines of three parcels, resulting in two parcels. The resulting parcels will have access to Upper 33rd Street North. There is an existing building that will extend across the property line created by the RLS. The fee owner of the Property will need to enter into either a party wall or an encroachment agreement to address their rights and responsibilities with respect to the wall. PID Nos. 13.029.21.31.0016, 13.029.21.31.0003, and are each zoned C - Commercial 13.029.21.32.0083. Both Tract A and Tract B resulting from the RLS must comply with the lot dimension and setback requirements for the C – Commercial District located in City Code Sec. 105.12.930, Table 12-2. As described above, the fee owner should provide documentation that Brian Zeller is affiliated with the fee owner of the Property and may sign the subdivision application materials on its behalf. The Applicant and the Owner have not yet signed the deposit agreement. 3. Commitment Exceptions. The Commitment is subject to the following exceptions: a. A Mortgage in favor of Royal Credit Union, filed April 18, 2022, as Document No. 1280979; and Assignment of Rents and Leases in favor of Royal Credit Union, filed April 18, 2022, as Document No. 1280980. The mortgage will likely need to be amended or partially released to reflect the legal description of the Property after the subdivision and the sale of a portion of the Property to the Applicant, as described above in Paragraph 1.b. No further action is required. The Certificate additionally discloses a temporary construction easement in favor of Washington County, filed July 20, 2015 as Document No. 1235230. The easement has expired by its terms. No further action is required. 4. Registered Land Survey. I require review of the following revisions. Ms. Ashley Monterusso September 26, 2025 Page 4 LA515\161\1051418.v2 a. The legal description on the RLS must match the Commitment and the Certificate exactly. “Block 1 ELMO PARK, a distance of 228.65” must be revised to “Block 1, ELMO PARK, a distance of 228.65” and “1. 70 feet to Judicial Landmark No. 11” must be revised to “1.70 feet to Judicial Landmark No. 11”. b. The City governing body approval certificate must be revised to: We do hereby certify that on the ___ day of ________________, 20__, the City Council of the City of Lake Elmo, Minnesota, has approved this Registered Land Survey. c. The RLS must be signed by both the City Clerk and the Mayor, pursuant to City Code 103.00.040. d. The County surveyor certificate must be revised as follows: Pursuant to Minnesota Statutes, Section 389.09, Subd. 1, this Registered Land Survey is approved this ____ day of _____________, 20__. ______________________________ (insert County Surveyor’s name here) Washington County Surveyor 5. Taxes and Special Assessments. All real estate taxes due in the year the RLS is to be recorded (including delinquent taxes and any deferred Green Acres taxes) must be paid prior to recording the RLS. All special assessments must be paid prior to recording the RLS. Any special assessments against any part of the Property can be reapportioned among the new lots as provided in Minnesota Statutes Section 429.071(3). Ms. Ashley Monterusso September 26, 2025 Page 5 LA515\161\1051418.v2 This letter does not purport to set forth every matter relevant to a determination of whether title to the Property is marketable, and no one should rely upon it for that purpose. The sole purpose of this letter is to identify required signatories to the RLS and related issues of interest to the City in connection with the subdivision, as evidenced by the Commitment. Please contact me if you have any questions regarding this information. Thank you. Sincerely, Samantha C. Zuehlke Samantha C. Zuehlke STAFF REPORT DATE: November 5th 2025 CONSENT AGENDA ITEM: Approve Landscape Security Reduction for Wildflower 4th Addition Development SUBMITTED BY: Sophia Jensen, City Planner ISSUE BEFORE COUNCIL: Should the City Council approve release of warranty security for landscaping for Wildflower 4th Addition? PROPOSAL DETAILS/ANALYSIS: Staff has received and processed the request to reduce the development security for landscaping improvements for the Wildflower 4th Addition Development. These phases were inspected and accepted by the Landscape Architect on 10/16/2025. Current Security Amount Proposed Security Amount $6,250 $1,5631.Wildflower 4th Addition FISCAL IMPACT: It is the City’s goal to retain, at all times during the subdivision improvements, a security amount that is adequate to ensure completion of all elements of the improvements as protection to the City tax payers against the potential of developer default. Comments must be received by November 7, 2025 for consideration when adopting the final CIP. As part of the annual budget process, Washington County prepares a five-year Capital Improvement Plan (CIP), which includes the county's tentative plans for roads, bridges, parks, land, trails, transit, and public facilities. A full copy of the draft CIP document is available online at the County website. The attached packet highlights the substantial transportation roadway projects included within the City of Lake Elmo over the next five years. Parks and Public Facility projects are not included in this review. It should also be noted that the County completes intersection control projects, safety & traffic capacity projects (turn lanes, signal timing, etc.), and pavement preservation projects each year but the work related to these improvements are not specifically identified within the CIP document. The County is budgeting an average of $750,000 per year for intersection control project(s), $210,000 per year for safety improvements, and has budgeted $24M over 5 years for various pavement maintenance and preservation projects. Future projects may include improvements to County State Aid Highway (CSAH) 14 (34th Street North) at High Point Drive, CSAH 2 (Broadway Avenue) Signal Timing Updates, and CSAH 19 (Woodbury Drive) Signal Timing Updates. Justification High-level intersection controls (roundabouts and traffic signals) may be constructed at county highway intersections meeting criteria set forth in the ICRS. The county proactively plans for the installation of intersection controls to improve the safety and efficiency of traffic flow on the County Highway System. The annual ICRS determines the priority of these installations. The number of projects programmed varies depending on actual budget funding, the availability of matching funds, unforeseen development, or intersection safety problems. Examples of solutions include: 1) turn-lane construction 2) signal-timing studies 3) flasher installations 4) minor curve corrections 5) pedestrian and trail projects 6) signing and striping improvements Justification This annual program is needed to provide the county with the ability to be responsive to small safety or traffic-capacity problems throughout the year that are not programmed into a larger capital project. The county proactively plans for safety/capacity projects in its budget. Keeping an allotment in the budget for these types of projects eliminates future safety hazards for vehicular and pedestrian traffic. Proactively improving/reducing safety or traffic- capacity problems is cost-efficient and keeps the potential for larger expenditures minimal. The work is expected to include: 1) a grade-separated crossing of TH 36 2) ramps to provide access between CSAH 17 and TH 36 3) retaining walls 4) storm water treatment facilities 5) pedestrian facilities 6) intersection controls for frontage roads 7) frontage road extension on the south side Justification TH 36 users currently experience congestion (capacity constraints) during both A.M. and P.M. peak hours, resulting from the existing signal at CSAH 17 (Lake Elmo Avenue). This congestion results in an unacceptable level of service during peak hours, which is expected to worsen as traffic volumes are forecasted to increase. Due to the extended cycle lengths, CSAH 17 has long wait times before being served by the signal. The existing, closely-spaced frontage road intersection on the north of TH 36 consistently queues traffic through the intersection. This CSAH 17 intersection has a crash and severity rate that is significantly higher than the Minnesota Department of Transportation (MnDOT) statewide system average for similar signalized intersections. To date, $10 million in federal grants and $26 million in state bonds/grants have been secured for the construction of this project. Justification Stillwater Public School District is currently constructing a new elementary school in the northwest corner of CSAH 10 and CSAH 17. This new school will increase traffic volumes at this intersection, which is currently controlled with all-way stop signs. As a part of the site development approval process, Washington County partnered with the City of Lake Elmo and the Stillwater Public School District to install transportation infrastructure to ensure that the immediate area will operate safely at the time of school opening, which is planned for fall 2026. THANK YOU! STAFF REPORT DATE:11/5/2025 Regular Agenda TO: Lake Elmo City Council FROM:Jason Stopa, Community Development Director AGENDA ITEM: Tree Fund | Right-of-way (ROW) Boulevard Tree Program REVIEWED BY: Ashley Monterusso, City Planner CORE STRATEGIES: ☐ Vibrant, inclusive, connected community ☒ Efficient, reliable, innovative services ☒ Responsive, transparent, adaptive governance ☐ Balanced Finances now and future ☐ Managed Growth ☒ Resilient Infrastructure BACKGROUND: The City received a $50,000 payment from Greater Stillwater Schools as part of tree mitigation when the new elementary school was approved. The current code allows for a fee-in-lieu but doesn’t specify how the funds should be spent. Using the funds to replace trees was discussed during the approval process. The City does not have a tree fund separate from park dedication funds. The City does not have a right -of-way (ROW) boulevard tree replacement program. 105.12.470 Tree Preservation(f)(2). The City Council may require payment to the City of a fee-in-lieu of tree replacement, payment of additional park dedication fees; the implementation of woodland management practices by the applicant; or the planting of replacement trees on City property by the applicant under direction of the City Public Works Director; or a combination of these methods as a condition of the City approving relief or an exception from the City tree preservation and replacement standards. The amount of the fee-in-lieu of tree replacement is set forth in the City's fee schedule. This item was presented at the June 2025 workshop and was well received by the Council. ISSUE BEFORE COUNCIL: Would the Council consider creating a Tree Fund and Boulevard Tree program? PROPOSAL DETAILS/ANALYSIS: The City could amend chapter 105.12.470 Tree Preservation and add section (g) Tree Fund. Proposed Language: g) Tree Fund. (1) Purpose. The purpose is to provide a dedicated fund for tree replacement throughout the city. (2) Funding Sources. The primary funding sources will be from fee-in-lieu of tree replacement, funds allocated by the City Council, and individual and business donations. (3) Eligible Expenses. Funds shall be spent on programs approved by the City Council, which include but are not limited to a boulevard tree program. This would allow for the City to receive donations directly for tree preservation and replacement. It would also provide a fund for the $50,000 payment from the school district. A draft ordinance has been included as an attachment. The fund could be used on boulevard trees and/or other programs approved by the Council. Currently, the city does not have a ROW boulevard tree replacement program or funds dedicated for replacement. The parks dedication fund does allow for tree planting at city parks. A tree fund could provide the revenue needed to start a ROW Boulevard Tree Program. The details of a potential ROW Boulevard Tree Program are attached. Staff discussed the potential program with the City’s landscape architect, HKGi, and would model it based on Oakdale (Boulevard Tree Stewardship) and Columbia Height (Adopt- a-Tree) programs. The basic program details are a resident is provided with a boulevard tree (planted by a nursery/contractor), a watering bag, and a mulch ring. The residents would be responsible for watering the tree. FISCAL IMPACT: Costs would be offset by the $50,000 payment and future donations. Program administration and project delivery costs, not including trees and materials, are estimated to be $5,000-$10,000 per year. The ROW Boulevard Tree Program’s impact will be measured yearly with demand monitored throughout the year. RECOMMENDATION: Staff recommend that the City Council approve both the Tree Fund and ROW Boulevard Tree Program. Move to adopt ordinance 2025-16 approving the text amendment to create a Tree Fund Move to adopt the Boulevard Tree Program as presented by staff ATTACHMENTS: Ordinance – Tree Fund ROW Boulevard Tree Program Details CITY OF LAKE ELMO COUNTY OF WASHINGTON STATE OF MINNESOTA ORDINANCE NO. 2025-16 AN ORDINANCE AMENDING CITY CODE SECTION 105.12.470 TREE PRESERVATION TO CREATE A TREE FUND SECTION 1. This Ordinance 2025-16 was adopted on this 5th day of November 2025, by a vote of __ Ayes and ___Nays. LAKE ELMO CITY COUNCIL ________________________________ Charles Cadenhead, Mayor ATTEST: ______________________________ Julie Johnson, City Clerk Boulevard Tree Program The purpose of the program is to provide tree replacement within city rights-of-way. Trees must be placed in the boulevard right-of-way in established neighborhoods. (A subdivision’s two-year warranty period must be completed and closed out by the City.) The boulevard tree program process: 1.Resident completes an online form a.Selects from a list of trees b.Name, Address, Phone, Email c.Must agree to water the tree 2.HKGi with Public Works ensure that the sites do not have utility conflicts 3.Trees are planted once a year depending on funding. (A waitlist will be created if there are not enough trees) 4.Trees are planted by a nursery/landscape company with HKGi monitoring the program 5.Trees come with a watering bag that the residents are responsible for filling 6.HKGI completes an inspection to ensure the work is done correctly FAQs What does the selection process look like? Is it an open application, first-come-first- served, or prioritized based on ROW conditions? After completing the online form, the sites are verified to ensure that a boulevard tree could be placed along the front or corner yard side of the home. It is a first-come-first-served program. Can residents choose from a pre-approved list of species? What if the tree is unavailable? Yes, but they will be limited to what the nursery has in stock . The residents will selected a few trees in their preferred order. Will the City track and document tree locations? The City uses ArcGIS Online and can map the data from the online form . Will pre-install training or planting guidelines be issued to ensure consistency across contractors? If possible, t he City prefer s to use one nursery/contractor. Training is limited. How many inspections will take place? An i nitial site inspection and a n installation inspection are the only planned inspections. What happens if a tree dies or if there are residents’ concerns post-install? Trees do not have a warranty. The tree health is the respon si bility of the resident. What level of care is expected from residents (e.g., watering, avoiding damage), and how is that communicated? The resident receive s a how-to-care for the tree document , which will be on our website . Is this a pilot phase to test this out in a limited area first? We plan to open the program throughout the city in eligible neighborhoods. We will monitor the program to determine its success. Am I eligible to receive a tree? The main criteria to qualify are 1) the tree must be on public land in the boulevard, 2) spacing must be adequate between existing trees, and 3) the spacing between utilities must meet engineering requirements . The requirements are included on the web site. 4) The subdivision must be beyond the two-year warranty period. Is there a cost for the residents? There is no cost but residents that receive a tree can donate to the Tree Fund to ensure that other residents get a tree.
