RESOLUTION NO.2026 - 012
A RESOL UTION APPR 0 VING A REGISTERED LAND SURVEY (RLS) FOR THE
PR OPER TY LOCA TED AT 3481 LAVERNE AVENUE
WHEREAS, the City of Lake Elmo (the "City") is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, Chama Mission LLC and John Pecchia (the "Applicants") submitted an
application to the City for a Registered Land Survey ("RLS No. 132") to reconfigure the
property with the address of 3481 Laverne Avenue into two separate parcels as shown on RLS
No. 132, a copy of which is on file in the City of Lake Elmo Planning Department; and
WHEREAS, the Lake Elmo Planning Department has reviewed the proposed RLS No.
132 for consistency with the City of Lake Elmo Zoning and Subdivision ordinances; and
WHEREAS, the Lake Elmo Planning Commission held a public hearing on October
1511i, 2025, to review and consider RLS No. 132; and
WHEREAS, the consensus of the Lake Elmo Planning Commission was to recommend
to the City Council approval of RLS No. 132 subject to conditions of approval; and
WHEREAS, the City Council reviewed and approved RLS No. 132 at its February 17,
2026, meeting and made the following findings of fact:
*That the Registered Land Survey No. 132 is consistent with the Lake Elmo
Comprehensive Plan and the Future Land Use Map for this area.
• That RLS No. 132 is consistent with the future development plans of the area and
with the standards of the City's Village Mixed Use zoning district.
• That RLS No. 132 meets the requirements of the City's registered land survey and
minor subdivision regulations.
NOW, THEREFORE, BE IT RESOLVED THAT the City Council does hereby
approve RLS No. 132 subject to the following conditions:
1. The Applicants must obtain all other necessary City, state, and other governing body
permits and approvals prior to release of RLS No. 132 for recording.
The City Attorney's comments set forth in the RLS No. 132 opinion memo shall be
addressed prior to release of RLS No. 132 for recording.
3. Any special assessments currently levied against the property subject to RLS No. 132
shall be transferred or paid in full prior to release of RLS No. 132 for recording.

4. The driveway access area must be brought up to code ahead of any building permits for
redevelopment, per the Engineering memo dated September 23, 2025.
5. Prior to recording RLS No. 132, the Applicants must dedicate right of way by separate
easement to the satisfaction of the City, per the Engineering memo dated September 23,
2025.
6. All proposed easements shall be subject to review and approval by the City Attorney
and the City Engineer prior to the release of RLS No. 132 for recording. The drainage
and utility easement must be established along the entire north side of the building,
extending from the eastern property line to the western property line, and shall
encompass all areas outside of the building's footprint, or as reduced based on water and
sewer plans for Tract A and Tract B. The final location and dimensions of the easement
shall be approved by the City Engineer prior to recording of RLS No. 132.
7. The Applicants shall record RLS No. 132 and this Resolution within 180 days after
approval of this Resolution by the City Council and provide proof of recording to the
City. If both are not recorded within 180 days, approval of RLS No. 132 shall be
considered void, unless a request for a time extension is submitted in writing and
approved by the City Council.
