RESOLUTION NO.2026-024
A RESOLUTION APPROVING COOPERATIVE AGREEMENTS WITH WASHNGTON
COUNTY FOR THE TH 36 AND CSAH 17 (LAKE ELMO AVENUE) INTERCHANGE AND
SOUTH FRONTAGE ROAD IMPROVEMENTS
WHEREAS, Washington Courtly intends to construct and maintain a roadway interchange at the
intersection of Trunk Highway (TH) 36 and Lake Elmo Avenue, and to construct a South Frontage Road
from Keats Avenue to approximately 0.4 miles east of Lake Elmo Avenue (CSAH 17), with portions of the
improvements located in the City of Lake Elmo, herein referred to as the "Project' and located as shown
on Exhibit A; and
WHEREAS, items included in the Project require City cost participation in accordance with
"Washington County Cost Participation Policy #8001 for Cooperative Highway Improvement Projects";
and
WHEREAS, the City agrees to the apportionment of costs outlined within this agreement
conditioned on the receipt of the outside funding being applied toward the City cost share, also as outlined
within this agreement; and
WHEREAS, upon completion of this project, MnDOT, the County, and City agree to their
respective ownership and maintenance responsibilities as identified in the attached Cooperative
Maintenance Agreement; and
WHEREAS, a cooperative effort between the County and City is the appropriate method to
facilitate the construction of these transportation improvements, project cost sharing and facilitate the
maintenance of the items constructed by the Project; and
WHEREAS, this Agreement is made pursuant to statutory authority contained in Minnesota
Statute 162.17 sub.1 and Minnesota Statute 471.59.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKE ELMO,
1. That Cooperative Cost Share Agreement #18223 for the project costs of TH 36 and CSAH 17 (Lake
Elmo Avenue) Interchange and South Frontage Road Improvements, between the City of Lake
Elmo and Washington County is hereby approved and the Mayor and City Clerk are hereby
authorized to execute the agreement on behalf of the City of Lake Elmo.
2. That Cooperative Maintenance Agreement #18224 for maintenance of TH 36 and CSAH 17 (Lake
Elmo Avenue) Interchange and South Frontage Road Improvements, between the City of Lake
Elmo and Washington County is hereby approved and the Mayor and City Clerk are hereby
authorized to execute the agreements on behalf of the City of Lake Elmo.
ADOPTED BY THE LAKE ELMO CITY COUNCIL ON THE FIFTH DAY OF MAY 2026.
