CITY OF LAKE ELMO WASHINGTON COUNTY STATE OF MINNESOTA RESOLUTION NO.2026-025 A RESOLUTION APPROVING COOPERATIVE CONSTRUCTION AGREEMENT MNDOT CONTRACT NO. 1060495 WHEREAS, Washington County intends to construct and maintain a roadway interchange at the intersection of Trunk Highway (TH) 36 and Lake Elmo Avenue (CSAH 17), and to construct a South Frontage Road from Keats Avenue to approximately 0.4 miles east of Lake Elmo Avenue (CSAH 17), according to County -prepared plans, specifications, and special provisions designated by the City and the State as State Project No. 206-020-005, by the County and the State as State Project No. 082-617-014, and by the State as State Project No. 8204-57 (TH 36=118), herein referred to as the "Project"; and WHEREAS, the County requests the State participate in the costs of the interchange constriction and the State is willing to participate in the trunk highway eligible costs of said construction as set forth in this Agreement; and WHEREAS, MnDOT Contract Number 1052258, which has been executed between the County and the State, appoints the State as the County's agent to receive and disburse transportation related federal funds and sets forth duties and responsibilities for letting, payment, and other procedures for a federally funded contract let by the County; and WHEREAS, the State Federal -Aid funds will be paid to the County, up to a capped amount, under the Delegated Contract Process on a reimbursable basis after expenses have been incurred, as set forth in this Agreement, the State funds will be paid to the County as set forth in this Agreement, and the Catalog of Federal Domestic Assistance number or CFDA number is 20.205; and WHEREAS, Agreement No. 1062311 between the State and the City will address the turnback of a portion of 60th Street North (South Frontage Road); and WHEREAS, Agreement No. 1060495 between the State, County and the City addresses Project delivery responsibilities by the Comity, the State's cost and payment for the Project, the Keats Avenue Access Modification performance measure monitoring and future closure responsibilities, and maintenance responsibilities by the State, County and City upon completion of the Project; and WHEREAS, this agreement will terminate Signal Agreement No. 85526M for the intersection of TH 36 at CSAH 17/Lake Elmo Avenue; and WHEREAS, Minnesota Statutes § 161.20, subdivision 2 authorizes the Commissioner of Transportation to make arrangements with and cooperate with any governmental authority for the purposes of constructing, maintaining, and improving the trunk highway system.
