RESOLUTION NO.2026-026
A RESOLUTION APPROVING THE CHANGE OF ROADWAY JURISDICTION
AGREEMENT FOR 60TH STREET NORTH (SOUTH FRONTAGE ROAD)
MNDOT CONTRACT NO. 1062311
WHEREAS, Washington County intends to construct, under SP 8204-57, a South Frontage Road
from Keats Avenue to approximately 0.4 miles East of Lake Elmo Avenue (CSAH 17), hereinafter referred
to as ("Roadway Segment'); and
WHEREAS, MnDOT has determined that a portion of the Roadway Segment is no longer needed
for trunk highway purposes; and
WHEREAS, the City of Lake Elmo is a Road Authority as defined in Minnesota Statutes § 160.02
(subd. 25); and
WHEREAS, MnDOT and the City of Lake Elmo agree that the City of Lake Elmo is the proper
road authority for the Roadway Segment; and
WHEREAS, Cooperative Construction Agreement #1060495 between MnDOT, Washington
County and the City of Lake Elmo addresses cost participation and maintenance not covered in this
Agreement; and
WHEREAS, MnDOT and the City of Lake Elmo have entered into this Agreement to provide for
the orderly release of the Roadway Segment to the jurisdiction of the City of Lake Elmo; and
WHEREAS, Minnesota Statutes §161.20 authorizes MnDOT to enter into agreements with other
governmental authorities to carry out the purposes of Minnesota Statutes Chapter 161.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LAKE ELMO, that the
City of Lake Elmo enter into MnDOT Agreement No. 1062311 with the State of Minnesota, Department
of Transportation to provide for transfer of a portion the Roadway Segment to the City, under State Project
No. 8204-57.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk and hereby authorized to execute
MnDOT Contract No. 1062311 and any amendments, on behalf of the City of Lake Elmo.
