A RESOLUTION VACATING AN EASEMENT OVER AND ACROSS THE
WESTERLY EIGHT (8) FEET OF LOT 14 -, BLOCK 3,
DEMONTREVILLE HIGHLANDS 4TH ADDITIOr?
WHEREAS, at a regular meeting of the City Council of the City of Lake
Elmo, Washington County, Minnesota, held on May 21, 1991, a Petition
was presented to the City Council praying for the vacation of a
certain eight (8) foot easement in the Plat of DeMontreville Highlands
4th Addition described as follows:
The westerly eight (8) feet of Lot 14, Block 3,
DeMontreville Highlands 4th Addition,
WHEREAS, said Petition came on for hearing before said City Council at
a regular meeting thereof on Tuesday, May 21, 1991 in the City Hall
pursuant to Notice thereof published and posted. as required by law,
and
WHEREAS, that part of Lot 14, Block 3 DeMontreville Highlands Ath
Addition has never been open or used for pedestrians as a means of
ingress and egress to DeMontreville Park, and. it is impro "ruble there
will ever be any public need. for said easement; moreover, by vacating
the sane, the property will be returned to the tax rolls ara ' Would the taxable value of the land abutting thereon or affected.

WHEREAS, for the foreaoina reasons, it appears to be in the pul -Ilic
interest to vacate said easement.
NOW, THEREFORE, BE IT RESOLVED, that the eight (8) foot easement
dedicatee;. in the plat of DeMontreville Highlands 4th Addition
described above be, and the sane hereby is, vacated..
BE IT FURTHER RESOLVED, that the Clerk shall prepare a Notice of
Completion of these proceedings which shall contain the name of the
City, and the identification of the vacation, a statement of the time
of completion thereof and. a description of the real estate and land
affected there?rJ, Such Notice shall be presented. to the Washington
County Auditor who shall enter the same in his transfer records and
note upon the instrun.e,it over his official signature the words
"entered in the transfer records ". The Notice shall then be filed.
with the County Recorder, all as required by Section 368.01
Subdivision 25 of the Minnesota Statues.
